HomeMy WebLinkAbout28337-02-2026 - City Council - OrdinanceOrdinance No.28337-02-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND, IN THE AMOUNT UP TO $25,000,000.00, SUBJECT TO THE RECEIPT OF THE GRANT, FOR THE PURPOSE OF FUNDING THE HERITAGE TRACE PARKWAY GRADE SEPARATED RAILROAD CROSSING PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount of $25,000,000.00, subject to the receipt of the grant, for the purpose of funding the Heritage Trace Parkway Grade Separated Railroad Crossing project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the application for and acceptance of, if awarded, the Better Utilizing Investments to Leverage Development (BUILD) Grant, in an amount up to $25,000,000.00 for the design and construction of a grade -separated railroad crossing on Heritage Trace Parkway at the Burlington Northern Santa Fe rail lines; 2. Authorize execution of the Federal Grant Agreement with the United States Department of Transportation; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount up to $25,000,000.00, subject to the receipt of the grant, for the purpose of funding the Heritage Trace Parkway Grade Separated Railroad Crossing Project. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize an application for and acceptance of, if awarded, a Better Utilizing Investments to Leverage Development (BUILD) Grant in the amount up to $25,000,000.00 for the design and construction of a grade -separated railroad crossing on Heritage Trace Parkway at the Burlington Northern Santa Fe (BNSF) rail lines. The United States Department of Transportation (DOT) is making this discretionary grant available for infrastructure projects that improve safety and mobility for people and goods. Eligible projects include grade -separated crossings. The application deadline is February 24, 2026, and it is unknown when the notice of award will be communicated. Heritage Trace Parkway currently dead -ends at both sides of the BNSF rail lines, creating increased travel times and congestion along adjacent arterials such as Bonds Ranch Road and Bailey Boswell Road. The project supports the City's goals of improving network connectivity, reducing congestion, and enhancing multimodal access to nearby residential and commercial areas for vehicles, bicycles, and pedestrians. The City will be responsible for providing a 20% local match or up to $12,500,000.00 as part of the grant. The current estimated total project cost is $60,675,388.00. A separate M&C will be presented to Council once funding has been identified to meet the grant match requirement. Should no funding be available, then the Transportation and Public Works (TPW) Department will not accept the grant award and will be responsible for all costs incurred. A grant application has been entered into the Grant Application Repository. The number is GRNT-APPL-0000000174. City salaries will be charged to the grant. Indirect cost recovery does not apply. The proposed project is located in COUNCIL DISTRICT 10. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: USDOT FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the capital budget, as appropriated, in the Grants Cap Projects Federal Fund for the Heritage Trace Parkway Grade Separated Railroad Crossing project. Transportation and Public Works (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Transportation and Public Works Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
