P00001) IN THE AMOUNT OF $1,059,280.00, FROM AVAILABLE TRANSPORTATION IMPACT FEE AND INTEREST EARNINGS COLLECTED WITHIN THE REVENUE -SERVICE AREA Z - TRANSPORTATION IMPACT FEES PROJECT (CITY PROJECT NO. UN9928) FOR THE PURPOSE OF FUNDING THE EAST RISINGER ROAD EXTENSION FROM OLD BURLESON ROAD TO OAK GROVE ROAD AND OAK GROVE ROAD IMPROVEMENTS PROJECT (CITY PROJECT NO.106868); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025- 2026 in the Budget of the City Manager, there shall also be increasing receipts and appropriations in the Transportation Impact Fee Capital Fund by increasing receipts and appropriations in the Community Facilities Agreement project (City Project No. P00001) in the amount of $1,059,280.00, from available Transportation Impact Fee and interest earnings collected within the Revenue -Service Area Z - Transportation Impact Fees project (City Project No. UN9928) for the purpose of funding the East Risinger Road Extension from Old Burleson Road to Oak Grove Road and Oak Grove Road Improvements project (City Project No.106868). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is for the City to participate with TCRG Opportunity VII, L.L.C, (Developer), in the engineering services for roadway improvements to serve the Patton Industrial Park Development and anticipated future growth in South Fort Worth. The Developer's proposed project requires extension of a portion of East Risinger Road. To provide a critical regional connection, the City desires to participate with Developer to construct the East Risinger Road Extension from Old Burleson Road to Oak Grove Road and Oak Grove Road Improvements project (Project). The Project is located within Transportation Impact Fee Service Area Z and was identified as impact fee eligible in the most recent transportation impact fee study. Funds are currently available in the Revenue Service Area Z-Transportation Impact Fees project within the Transportation Impact Fee Capital Fund for the purpose of funding the CFA Bucket project to fund the East Risinger Road Extension from Old Burleson Road to Oak Grove Road and Oak Grove Road Improvements project. The estimated cost of the City's portion of the engineering design, coordination, and construction documents is $1,059,280.00. The engineering design will be reviewed through the City's Infrastructure Plan Review Center (IPRC) process. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Revenue - SA Z - Transp Imp Fees projects within the Transportation Impact Fee Cap Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Transportation Impact Fee Cap Fund for the East Risinger Road Extension from Old Burleson Road to Oak Grove Road and Oak Grove Road Improvements project to support the execution of the agreement. Prior to any expenditure being incurred, the Development Sevices Department and the Transportation and Public Works Department have the responsibility to validate the availability of funds.
