AN ORDINANCE DECREASING APPROPRIATIONS IN THE PARK PLANNING
FEES IN THE PARK PLANNING DISTRICT 4.13-5 (CITY PROJECT NO. UN8155)
PROJECT OF THE PARD DEDICATION FEES FUND BY $550,000.00 AND
INCREASING APPROPRIATIONS IN THE PARD NEW ENHANCEMENTS
PROGRAMMABLE (CITY PROJECT NO. P00132) PROJECT OF THE PARD
DEDICATION FEES FUND BY THE SAME AMOUNT TO REFLECT
REALLOCATION OF FUNDS AMONG PROJECTS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
SECTION 1.
The budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-
09-2025 as amended, is hereby further amended to reduce appropriations in the Park Planning Fees in the
Park Planning district 4.13-5 (City Project No. UN8155) Project of the PARD Dedication Fees Fund by
$550,000.00, and to increase appropriations in the PARD New Enhancements Programmable (City Project
No. P00132) Project of the PARD Dedication Fees Fund by the same amount to reflect reallocation of funds
among projects.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
This ordinance shall be cumulative of Ordinance No. 27979-09-2025 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Plaza, John Peter Smith Park and the Fort Worth Water Gardens, Adopt Appropriation Ordinance, and Amend the Fiscal Years 2026-2030

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of an Infrastructure Construction Agreement with Downtown Fort Worth Initiatives, Inc. in an amount not to exceed
$500,000.00 for the City's reimbursement of eligible construction costs for the purpose of funding improvements at Burnett Memorial
Park, General Worth Square, Hyde Park, Lanham Plaza, John Peter Smith Park and the Fort Worth Water Gardens project (City Project No.
106790); and
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the PARD Dedication Fees Fund, by
increasing receipts and appropriations in the PARD New Enhancements Programmable Project (City Project No. P00132) in the amount of
$550,000.00 and decreasing Park Planning Fees in the Park Planning District 4.13-5 Project (City Project No. UN8155) by the same
amount for the purpose of funding the Infrastructure Construction Agreement with Downtown Fort Worth Initiatives, Inc. and park surveys; and
3. Amend the Fiscal Year 2026-2030 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to appropriate $550,000.00 and authorize an Infrastructure Construction
Agreement (ICA) with Downtown Fort Worth Initiatives, Inc. (DFWII). The ICA in an amount up to $500,000.00 is for the reimbursement of eligible
construction costs for improvements at Burnett Memorial Park, General Worth Square, Hyde Park, Lanham Plaza, John Peter Smith Park and the
Fort Worth Water Gardens. The additional appropriation in the amount of $50,000.00, is for boundary surveys at Burnett Memorial Park, General
Worth Square, Hyde Park, Al Hayne Park, John Peter Smith Park and Lanham Plaza.
DFWII provides operations and maintenance services for several downtown parks pursuant to a Management Services Agreement (MSA) (M&C
25-1086), which consolidates the maintenance agreements for individual parks into a single agreement. Additionally, DFWII has undertaken
improvement projects in downtown parks, including the renovation of Burnett Memorial Park and General Worth Square. Through this ICA, the City
will provide reimbursement funding up to $500,000.00 from Park Dedication Fee Funds to DFWII for the installation of eligible improvements
Funding is budgeted in the PARD Dedication Fees Fund within the PPD 4.13-5 project for the Park & Recreation Department for the purpose of
funding the PARD New Enhancements programmable project to fund the DFWII - PDF Improvements project.
Funding for this project was not included in the FY2026-2030 Capital Improvement Program because funding needs were unknown at the time of
its development. This M&C will amend the FY2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-
2025.
After completion of construction, DFWII will maintain the park improvements in accordance with the MSA or other maintenance agreements.
This project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the PARD Dedication Fees Fund PPD 4.13-5 project (City Project No.
UN8155) and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the
PARD New Enhancements Programmable project (City Project No P00132) to support the above recommendations and execution of the
agreement. Prior to an expenditure being incurred, the Park & Recreation Department has the responsibility of verifying the availability of funds.
