HomeMy WebLinkAbout28497-05-2026 - City Council - OrdinanceORDINANCE NO.28497-05-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARD DEDICATION FEES FUND, FROM AVAILABLE FUNDS, IN THE AMOUNT OF $600,000.00, FOR NEIGHBORHOOD IMPROVEMENT STRATEGIES PROGRAMMABLE PROJECT (CITY PROJECT NO. P00080); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. In addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated appropriations in the PARD Dedication Fees Fund, from available funds, in the amount of $600,000.00, for Neighborhood Improvement Strategies Programmable Project (City Project No. P00080). SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. This ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize execution of a contract with Northstar Construction, LLC, in the amount of $1,334,995.00 for the Smiley Park Improvements project (City Project No. 101405); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the PARD Dedication Fees Fund, Neighborhood Improvement Strategies Programmable project (City Project No. P00080) in the amount of $600,000.00, from available Central City Fees within the Neighborhood Park Unit 4.4-2 (City Project No. UN8105), 4.5-2 (City Project No. UN8110), and 4.5-3 (City Project No. UN8111), for the purpose of funding the Smiley Park Improvements project; and 3. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to reject the bids of six apparent low bidders and authorize execution of a construction contract with Northstar Construction, LLC for the Smiley Park improvements. The project base bid items include the installation of new playground equipment, safety surface material, a pickleball court, fencing, a trellis structure, concrete sidewalks, an ADA ramp, exercise equipment, site furniture, a drinking fountain, tree plantings, and an irrigation system. This project was advertised for bid on February 18 and February 25, 2026, in the Fort Worth Star -Telegram. On March 19, 2026, the following bids were received and tabulated. Green Scaping, LP $1,341,342.12 Ratliff Handscape, Ltd. $1,626,140.00 None of the six lowest bidders met the City's Small Business goal. Staff recommends rejection of the bids for the six lower bidders listed above. Northstar Construction, LLC, met the City's Small Business goal of 30%. Northstar Construction, LLC, is a certified small business. Funding for this project was not included in the FY2026-2030 Capital Improvement Program due to unforeseen increases in construction costs. The action in this M&C will amend the FY2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09- 2025. Funding is available in the Park Dedication Fees Fund, General Capital Projects Fund and the General Fund for the Park & Recreation Department for the purpose of funding the Smiley Park Improvements project. Smiley Park is in COUNCIL DISTRICT 8. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the PPD 4.4-2, PPD 4.5-2 and PPD 4.5-3 projects within the PARD Dedication Fees Fund and upon approval of the above recommendations and adoption of the appropriation ordinance, funds will be available in the PARD Dedication Fees Fund for the AC 18 - Smiley Park Imps project to support the execution of the contract. Prior to an expenditure being incurred, the Park & Recreation Department has the responsibility of verifying the availability of funds.
