A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCED FUNDING
AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN
THE AMOUNT OF $9,790,622.00 WITH CITY PARTICIPATION IN THE
AMOUNT OF $465,000.00 AND TRANSPORTATION DEVELOPMENT CREDITS
IN THE AMOUNT OF 1,860,000, PLUS ANY COST OVERRUNS, FOR
CONSTRUCTION OF THE VA: EVERMAN SAFE STREETS PROJECT.
WHEREAS, federal law establishes federally funded programs for transportation improvements
to implement its public purposes; and
WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall
design, construct and operate a system of highways in cooperation with local governments, and Section
222.052 authorizes the Texas Transportation Commission to accept contributions from political
subdivisions for development and construction of public roads and the state highway system within the
political subdivision; and
WHEREAS, federal and state laws require local governments to meet certain contract standards
relating to the management and administration of State and federal funds; and
WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that
describe federal, state, and local responsibilities for cost participation in highway improvement and other
transportation projects; and
WHEREAS, the City of Fort Worth (" City"), in conjunction with the City of Everman and Tarrant
County, desires to improve safety by installing multimodal bicycle and pedestrian infrastructure within
the project area, which connects four schools generally along Everman Parkway and South Race Street,
within the Cities of Fort Worth and Everman; and
WHEREAS, the Everman Parkway Safe Streets Project will improve safety for pedestrians,
bicyclists and motorists as well as enhance the aesthetics of the roadways within the project area by
installing cycle tracks, bike lanes, green -stamped sharrows and associated safety infrastructure; and
WHEREAS, the City desires to enter into an Advance Funding Agreement with the Texas
Department of Transportation for the Va: Everman Safe Streets Project in the amount of $9,790,622.00
with Federal Participation in the amount of $9,300,00.00, State Costs in the amount of $25,622.00, and
City Participation in the amount of $465,000.00 and Transportation Development Credits in the amount
of 1,860,000.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
The City Council authorizes the City Manager or Assistant City Manager to execute an Advance
Funding Agreement with the Texas Department of Transportation for the Va: Everman Safe Streets
Project (CSJ: 0902-90-334) in the amount of $9,790,622.00 with City Participation in the amount of
$465,000.00 plus transportation development credits in the amount of 1,860,000, plus any cost overruns.

RECOMMENDATION:
It is recommended that the City Council:
1. Rescind Resolution No. 6235-01-2026; and
2. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ#
0902-90-334) for the Everman Safe Streets project (City Project No. 106479) in the amount of $9,790,622.00 with Local Participation in the
Amount of $465,000.00 and Transportation Development Credits in the amount of 1,860,000, plus any cost overruns.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to rescind Resolution No. 6235-01-2026, adopted by M&C 26-0043, and adopt
a new resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the
amount of $9,790,622.00 with Local Participation by Transportation Development Credits (TDCs) in the amount of 1,860,000 and City Funds in
the amount of $465,000.00 for the Everman Safe Streets project (City Project No. 106479). The Federal participation portion will be in the amount
of $9,300,000.00, and revised State participation will be in the amount of $25,622.00. The initial payment for the City participation is $232,500.00.
The Transportation Development Credits (TDCs) in the amount of 1,860,000 will be applied and tracked as a non -spendable item in the Grants
Capital Project Other Fund.
The scope of work for the project remains as described in M&C 26-0043. All other actions in M&C 26-0043 remain valid.
