COUNTY OF TARRANT
WHEREAS, The City of Fort Worth and RPGA Design Group, Inc. (Architect) made and entered into City
Secretary Contract No. 40667 (The Contract)which was authorized by the City Council by M&C G-16991,
the 20th day of July, 2007; and amended as Amendment No. 1 on 23`d day of September, 2010 in the
amount of$33,850.00 plus$6,000.00 in reimbursable expenses; and
WHEREAS, further amendment is necessary to reimburse the Architect as part of the design services
agreement for additional design services for Site Adaptation and ARFF Modifications of the "Prototype
Fire Station" ; and to attain LEED Certification Level-Silver
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I - SERVICES OF THE ARCHITECT, the following paragraphs are added to read
as follows:
"Provide additional design services for additional structural design modifications of the"Prototype
Fire Station"for Fire Station#42. The cost of this additional service is$17,400.00 plus up to$0.00
in reimbursable expenses. The scope of services is described more fully in the RPGA letter dated
April 19, 2011, subject: Fire Station#42-Structural Engineer Additional Compensation Request,
Fort Worth, Texas which is attached hereto as Attachment"A"and made a part of this Agreement
and in the R. L. Woods and Associates letter dated April 14, 2011, subject: Fort Worth Fire
Station 42-Spinks Airport, which is attached hereto as Attachment"B"."
2.
Paragraph 1 of SECTION V-COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of
$266,547.00 plus up to$11,750.00 in reimbursable expenses. "
3.
All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

RE: Fire Station #42—Structural Engineer Additional Compensation Request

Mr. Murayama:
As we have discussed, attached is a letter from our structural engineer, R. L. Woods and
Associates, requesting additional compensation for the structural design of Fire Station
#42. In her letter, Ms. Woods explains her basis for her original fee of$13,000 based on a
site adaption of FS#5. As we have developed FS#42, the changes that we have made
structurally do not allow for duplication of the Fire Station#5 design as we originally
anticipated. The current design, which includes larger spans and relocation of columns to
simplify the structural framing from the perimeter framing, requires her to redesign the
system without the ability to reuse the design she provided for FS#5. I'm' in agreement
with Ms. Woods' description of the structural design requirements exceeding what we
asked.her to include in her original proposal and I'm in agreement with her request for an
additional $17,400 in fees. Please note that her requested total fee of$30,400 equals
approximately 1% of the anticipated construction cost for the fire station which is in line for
a new facility of this type and size with a structured foundation system. In hindsight it would
have been better for us to establish the extent of the changes to FS #42 before asking Ms.
Woods for a proposal for her services. As you are aware, it has always been RPGA's
position to adhere to our compensation agreements with all of our clients and we ask that
of all of our consultants as well. However, in this instance we feel Ms. Woods has a
legitimate reason to request additional compensation for the structural design of Fire
Station #42.
We ask that you please review this request for additional compensation as soon as
possible to allow us to continue with the completion of this project. l appreciate your
assistance in reviewing this matter and if you have any questions regarding this request
please call me at your earliest convenience.

Dear Mr.Lucio:
R. L. Woods &Associates is requesting additional compensation due to the increased scope of
work required for the above referenced project. Our original fee proposal from 2009 was based
on our understanding that we would be essentially reusing a prototype (designed as FS #5) and
modifying that prototype to duplicate framing for an additional apparatus bay, duplicating
framing at the opposite end of the building to include an additional bay of sleeping quarters,and
changing pier sizes as appropriate based on the site specific geotechnical report. As such, we
provided a significantly reduced fee presuming most of the engineering design and drafting
performed for Fire Station 95 could be reused for the new fire station.
However,the numerous changes that occurred for FS 42 since the time of our proposal (many at
the request of Owner)have made it impractical to reuse any of the previous structural engineering
design. This project has now become a total redesign, and as such, requires a fee commiserate
with the full scope of services required. Applying the same fee percentage rate that we used on
FS #5 to this project, our fee would be $30,400, which is $17,400 greater than the fee we
currently have in place. We respectfully request that our contract sum be increased from the
current$13,000 to$30,400
