HomeMy WebLinkAbout059214-A2 - Construction-Related - Contract - Kimley-Horn & Associates, Inc.AMENDMENT No . 02 TO CITY SECRETARY CONTRACT No. 59214 CSC No. 59214-A2 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 59214, (the CONTRACT) which was authorized by M&C 23-0187 on the 28th day of February, 2023 in the amount of $ 475,000.00; and WHEREAS, the CONTRACT was subsequently revised by:Amendment Number 1 in the amount of $1,255,000.00 which was authorized by M&C # 24-0524 on June 11, 2024,; and WHEREAS, the CONTRACT involves engineering services for the following project: Gateway Park Phase 1 Design, CPN 104192; and WHEREAS, it has become necessary to execute Amendment No. 02 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $96,900.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the ont act as amended so that the total fee aid by the ity fo all work and services shall be an amount of $1,826,900.00. IPRC Review Fees : The ENGINEER will pay the fees to the City of Fort Worth on behalf of the City of Fort Worth Parks Department for IPRC Pre -Submittal and Review Fees for Gateway Park and the required Off -Site Public Utility Infrastructure improvements. Task 2 — Oncor Power Easement Exhibits A. Oncor Power Easement Exhibits: The ENGINEER will coordinate with Oncor Power Delivery and prepare the required easement exhibits and staking for power poles and easement limits. Task 3 — Subsurface Utility Engineering (SUE) A. Subsurface Utility Engineering (SUE) : The ENGINEER will utilize a subsurface utility engineer to provide and perform SUE information regarding the park project area. The scope includes Quality Level (QL) "B" SUE. Utilities to be designated including gas, telecommunications, electric, traffic signals, storm, water, and sanitary sewer. Designated marks using project control points will be provided. Any necessary Right -of -Entry (ROE) permits will be provided prior to the start of field work. Work to be performed as required for proposed utility lines to encroach at existing gas easements. Task 4 — Public Infrastructure Plans (IPRC A. Public Infrastructure Plans (IPRC). Project Manual, and Community Facilities Agreement (CFA): The ENGINEER shall perform the following tasks related to preparation of plans and CFA for the Gateway Park Off -Site Public Utility Infrastructure improvements. Prepare and submit public infrastructure plans to serve the proposed project. The design specifications will be in general accordance with published City guidelines. ENGINEER will route the plans through the Infrastructure Plan Review Committee (IPRC) and address up to two (2) sets of revisions based on City review comments. Public infrastructure to serve the project consists of approximately 430 linear feet of public water 8-inch main, public domestic and irrigation taps in Beach Street, and one sanitary sewer tap to an existing manhole within the park. The 8-inch water main will be shown in plan view only. A profile will not be required. 2. Prepare a contract book and bid documents as required by the City for the purposes of a CFA (as described below). This document will include standard city details and specifications to construct the public improvements for this project. It will also include the documentation on: Notice to Bidders, Special Instructions to Bidders, Proposal, General Conditions, Special Conditions, City of Fort Worth Engineering Special Provisions, Certificate of Insurance, Contractor Compliance with Worker's Compensation Law, Performance Bond, Payment Bond, Maintenance Bond, and Standard Form Agreement. This task also includes coordinating with the contractor for obtaining the documents needed for the contract book. This task assumes a maximum of two rounds of revisions. Rev. 7/18 3. Prepare exhibits and cost projections (based on unit costs provided by the Client or its contractor) required by the City for a Community Facilities Agreement (CFA). This scope includes preparation of a CFA application and supporting documents and submitting to the City for review and processing for the public improvement plans. This task includes coordination with the Client for obtaining the necessary documents required for the city to execute the CFAs. Task 5 —Additional Schematic Design A. Additional Schematic Design: The ENGINEER shall provide additional schematic design plans and OPCC for Gateway Park to include all areas located west of North Beach Street, as illustrated in the approved Master Plan. The City will review the overall schematic design plans and OPCC and select the final improvements to be included in the Final Construction Documents. Task 6 — Additional Final Design for Alternate Bid Items A. Additional Final Design for Alternate Bid Items: Following City approval of the Schematic Design Plan and selection of the final improvements to be included in the Final Construction Documents, the ENGINEER shall provide the additional design for the selected alternate bid items located in the expanded soccer field and paring areas that exceed the $12M estimated construction budget. The additional design will include the following scope, associated with the expanded field and parking areas: 1. Site Plans and Dimension Control Plans: The ENGINEER will provide the additional paving layout and design for the additional soccer fields and the proposed parking lot located south of the additional soccer fields. This task includes two (2) additional Site Layout Plan Sheets and two (2) additional Dimension Control Plans for the expanded park areas. 2. Storm Water Quality Plans: The ENGINEER will provide design for the required Stormwater Quality BMPs associated with the expanded parking and soccer field areas. Design includes associated fine grading for BMP drainage areas, drainage piping and inlet design, and connection to the proposed site drainage improvements. This task includes three (3) Additional Water Quality Plan Sheets and associated calculations. 3. Grading and Site Drainage Plans: The ENGINEER will provide design for the required site grading, drainage and hydraulic analysis associated with the expanded parking and soccer field areas. Design includes the grading, storm drainage, drainage area maps, and hydraulic modeling for the expanded parking and soccer field areas. This task includes two (2) Additional Grading Plan Sheets and associated drainage calculations. 4. Landscape and Irrigation Plans: The ENGINEER will provide design for the landscape and irrigation associated with the expanded parking and soccer field areas. Design includes the landscape planting plans and irrigation plans for the expanded parking and soccer field areas. This task includes six (6) Additional Landscape Plan Sheets and six (6) Additional Irrigation Plan Sheets. Task 7 — Removal of Additional Services Scope A. Removal of Additional Services Scope: This task will remove Task 14 (Additional Services) in it's entirety from the approved scope of services included in Amendment #1.
