Re: Pedestrian Walkway/Culvert Crossing to serve the new Elementary
School on North Riverside Drive
Gentleman:
This letter is to formally set out the terms of the agreement reached regarding the
construction of the Improvements described below. This agreement is made by
and between the City of Fort Worth (the "City"), Keller Independent School
District ("KISD"), and FJM Properties, L.L.C. ("FJM") acting by and through their
designated officers and/or authorized representatives:
STREET & STORM DRAIN FACILITIES
1) GENERAL PROVISIONS
a) The Improvements to be constructed shall consist of a culvert crossing
including 9'X5' box culvert, sidewalk, hand rails and parallel wings plus
certain sidewalks and chain link fencing, all of which are hereinafter
referred to collectively as "Improvements". The total cost of the
improvements is estimated to be $30,600.00.
2) CONSTRUCTION OF IMPROVEMENTS
a) FJM shall be responsible for construction of the Improvements and any
and all contracts related thereto.
b) FJM shall comply with all applicable construction codes and obtain the
approvals and inspections required by the City.
3) FINANCING
a) FJM will provide initial funding to construct the improvements. Upon the
City's acceptance of the Improvements as complete, FJM will be
reimbursed by City and KISD as provided in 3b) and 3c) below.

b) City agrees to reimburse FJM 22.87% of the actual cost to construct the
Improvements OR $7,000, whichever is less.�
c) KISD agrees to reimburse FJM 22.87% of the actual cost to construct the
Improvements OR $7,000, whichever is less.
4) NOTICES
Any notice, communication or advice required to be given herein or which
may be given must be in writing and either personally delivered or sent
certified mail, return receipt requested, addressed to:
