WHEREAS, the City of Fort Worth (City) and Carter & Burgess,
Inc., (Engineerj made and entered into City Secretary Contract No.
22566, (the Contract} which was authorized by the City Council by
M&C C-15928 on the 4th day of March 1997; and subsequently revised
by four previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Main 207R Drainage
Area Sanitary Sewer System Rehabilitation and Improvements
(Group 5, Contract 3), Part 2.
WHEREAS, it has become necessary to execute Amendment No. 5
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated September 10, 1999, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $9,500.00.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $508,195.00.

A11 other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Rakesh:
We are providing this letter to request additional compensation for work beyond the
engineering services outlined in the contract for Main 207R Drainage Area between
Carter and Burgess and the City of Fort Worth. .�
The additional services are due to revisions on the approved construction documents
during the construction phase of the project. These revisions are described under
Amendment No. 5 below.
Amendment No. 5
Amendment No. 5 inc(udes an increase in total contract amount of $9,500 in order that
the plans could be modified to include the following design changes:
1. Revise two plan and profile sheets to make grade adjustments in the
sewer iine caused by consiruciion staking which was not in confiormance
with the construction documents. Revised Plan and Profile Sheets 6A &
7A. �
2. � Prepare alternatives for sewer line realignment. Revise plan and profile
sheet to delete sewer manhole and revise sewer line alignment in the
. area of contaminated soils. Revise Plan and Profile sheet 7A.
3. Prepare easement documents through the Leonard Property and the
. TXU easement for the revised sanitary sewer line. ,
4. Attend meetings with the City of Fort Worth and property owner to
discuss revisions in the alignment of the sewer line.

5. Revise easement documents to incorporate wording requested by
Penney's Attorney. .
The engineering fee required to make these revisions on the construction documents is
$9,500.00. Attached is a summary of the engineering fees for the project including
amendments 1 through 5. �

RE: DESIGN FEE AMENDMENT NO. 5 TO MAIN 207R DRAINAGE
AREA SANITARY SEWER REHABILITATION AND IMPROVE-
MENTS (GROUP 5, CONTRACT 3), PART 2, DOE N0.1360
The proposed amendment will reimburse Carter and Burgess, Inc:, for the additional en-
gineering services that were provided on the project as requested by the City.
Due to survey error by City survey forces, it was necessary to revise two plan/profile
sheets to reflect a new horizontal alignment for the sewer main. It was also .necessary to
redesign a portion of the sewer main in order to further locate the line away from con-
taminated soils. In addition, it was necessary to prepare easements for the new alignment.
Carter and Burgess, Inc., has requested a fee of $9,500.00 for the additional services to be
provided thereby increasing the contract fee from $498,695.00 to $508,195.00. I believe
this fee is fair and reasonable for the additional services to be provided.
Please authorize the additional design fee by your signature on the attached contract
amendment form.
