("Engineer") made and entered into City of Fort Worth City Secretary Contract No. 24784, ("Contract") which was authorized by the City Council by M&C C-17306 on the ll`'' day of March, 1999; and WHEREAS, the Contract involves engineering services for the following project: The City of Fort Worth 36-Inch Waterline from Fossil Hill Estate to Harmon Road (Northside III). WHEREAS, it has become necessary to amend the Contract to include an increased scope of work and revised maximum fee; NOW, THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the contract: 1. Article I of the Contract is amended to include the additional engineering services as specified in a proposal letter from the Engineer dated August 5, 1999, a copy of which is attached hereto and incorporated herein. Fort Worth Water Department 1000 Throckmorton Fort Worth, TX 76102 , � �" RE: Northside III Water Transmission Lines Phase II 24-Inch Line to North Beach Street Pump Station and Pump Station Improvements Contract and Schedule Dear Mr. Crumb: In accordance with the results of our recent meeting, we are pleased to present our proposal for the design of the water system improvements for the 24-inch waterline starting a't I-35 and connecting to North Beach Street Puxnp Station from the Harmon Road elevated tank fee connection along with the North Beach Pump Station improvements necessary to serve the area. We have assumed that the current contract for the 36-inch water line for the Hicks Road water line (City Secretary Contract No. 24784, D.O.E. No. 2731) would be amended to include this work since the original request for proposals included this as an item to be designed. Accordingly, we have provided the various contract forms "exhibit A-6 (additional scope), revised attachment B(compensation and schedule), revised exhibit B-3 (cost summary), revised Exhibit B-5 (Construction Cost Estimate) and a revised attachment D(schedule) for the additional improvements to detail the additional items needed for proceeding on the additional work. . After reviewing the schedule items that are beyond our control, the end of July completion date for the line and pump station work will require major cooperation between our firm, our subconsultants, and the various City departments in order to have the improvements on-line in July 2000. Our schedule is predicated on: 1) Key dates require the design surveying to be started by September 13t'' with a four week duration in order to start the ROW acquisition process as soon as possible. All alignment decisions need to be made by August 26"' so that the appropriate decisions and information is relayed to the surveyors in appropriate format and in time to maintain the schedule. We have requested our surveyors to schedule survey crews for the week beginning September 13�' in order to minimize the ROW acquisition time on the schedule. August 5, 1999 Page 2 2) All City review of concepts and plans within one week of submission. Key rneetirig dates in the schedule will require decisions being made at the meeting. There will not be time in the schedule for F&N to go back and gather data or research issues. The decisions will have to be made at the meeting. 3) The ROW acquisition is presently scheduled for four months beginning in November of this year and continuing on assumption that the acquisition can be accomplished in that amount of time. The Water Department will have to set priorities within the D.O.E. ROW land acquisition group for this, since it could impact the 36-inch line RO W schedule and/or the EPA administrative order wastewater program acquisition schedules. We are prepared to accelerate our items, but we have no control over the acquisition process. The four months is appropriate if there are no condemnation issues that arise. If condemnation is required and is not initiated eaxly on in the acquisition process, the overall schedule will be compromised. 4) The bid process is initiated without the required ROW being obtained. The schedule sets the acquisition so that the ROW acquisition coincides with the City Council action on the construction contract. In reality, the acquisition could continue until the pipe material is first delivered to the project site or even to when the pipe is delivered to the subject tract of land. This option could add 2 to 2.5 months to the ROW acquisition schedule completion deadline. In any event, the special conditions in the construction contract will have to provide for the ROW acquisition extended deadline past the bid advertisement date scheduled. We have provided for a separate process for the pump station improvements and the pipeline construction. Both projects are separated in the various exhibits and attachments since we have assumed that they will be separate construction contracts. So initially, they deviate on a schedule standpoint but come back together on the construction schedule. The pump station improvements could move forward in the schedule since this is not on the critical path for completion prior to the pipeline construction. In summary: 24-Inch Pipeline • Concept Phase - 8/6/99-9/9/99: Delineate route, gather plans, meet with the City and the City and Hillwood once. Authorize the surveyors to proceed with design survey. • Preliminary Design - 9/10/99-11 /9/99: Design survey, horizontal alignment, one meeting to finalize horizontal alignment 10/15/99 to finalize, legal descriptions 10/29/99 based on decision in meeting, vertical alignment set with plan submission on 11/1/99. . • Final Design - 11/10/99-12/7/99 with a one week review process and one Frank Crumb, P.E. August 5, 1999 Page 3 ' week to make revisions and have printing process complete. • Bid Process - 12/22/99-2/21/00 with bid opening set for 2/1/99 and Council Action on 2/21/99. � Construction - 2/22/00-7/21 /00: This provides for a 2 week mobilization and week shop drawing submittal time frame, an 8 week material delivery schedule, and assumes that actual installation starts 4 weeks after the material is ordered with a 12 week construction schedule. The City may want to ' consider paying an early completion bonus to the contractor as an incentive to meet or exceed schedule. Meet with City on 9/9 to review requirements. • Preliminary Design - 9/10/99-10/7/99: Meet with City on 10/ 15/99 to review design elements and parameters. • Final Design -11/10/99-11/23/99: The pump station improvements could be moved up in the schedule approximately three weeks ahead of the pipeline schedule but there does not appear to be a need without the pipeline improvements. • Bid Process - 12/22/99-2/21/00 with bid opening set for 2/1/99 and Council Action on 2/21/99. • Construction - 2/22/00-7/21/00: This provides for a 2 week mobilization and week shop drawing submittal time frame, an 8 week material delivery schedule, and assumes that actual installation starts 4 weeks after the material is ordered with a 12 week construction schedule. We will make every effort to expedite the design process. However, there are significant items which are not within our control on the schedule. Our schedule has been predicated on all entities working to expedite the processes and our budgets have not provided for extensive reviews of options, or managing the ROW acquisition process. Should you need any additional information or clarification, please let us know. We are ready to initiate the proj ect assignment, if the above information and attachments are satisfactory to meet your needs for next suminer. Senior Vice President [OFF99041 ] T:\crumb. wpd EXHIBiT "A-6" SUPPLEMENTAL SCOPE OF SERVICES (SUPPLEMENT TO ATTACHMENT "A") PHASE 2- DESIGN SERVICES: WATER IMPROVEMENTS The following is a clarification of the tasks that the ENGINEER will perform under ATTACHMENT "A". Work under this attachment includes engineering services for water and/or sanitary sewer improvements for the following additions to the current City Secretary contract 24784 36-inch Northside III Water Transmission Main from Harmon Road to the east property line of Fossil Hill Estates (DOE No. 2731): 24inch Northside III Water Transmission Main from the North Beach Pump Station to the proposed Harman Road Elevated Tank feed line at I-35, approximately 12,000 feet. Improvements to the North Beach Pump Station Upon receipt of notice to proceed, the ENGINEER will perform the following tasks as appropriate for each item (three constru�ction contracts are anticipatec� : PART A — CONCEPTUAL-ENGINEERING A. Initial Data Coltection 1. Pre-Design Coordination Meetings ENGINEER will attend and document meetings, as required, to disa.ss and coordinate various aspects of the project and to ensure that the project stays on schedule. For purposes of establishing a level of comfort, two (2) meetings are anticipated. These include th�ollowing: One (1) pre-design kick-off meeting, (induding the CITY's Department of Engineering and other departments that are impacted by the project). One (1) review meeting at completion of the City's review of the conceptual engineering plans. � EA6-1 2. Data Coilection In addition to data obtained fmm the City, ENGINEER will research and make efforts to obtain pertinent information to aid in coordination of the proposed improvements with any planned future improvements that may influence the project. ENGINEER will also identify and seek to obtain data for existing conditions that may impact the project including; utilities, City Master plans, property ownership as available from the Tax Assessor's office. 3. Coordination with Other Agencies During the concept phase the ENGINEER shall coordinate with all utilities, including utilities owned by the City, TxDOT and railroads. These entities shall also be contacted if applicable, to determine plans for any proposed facilities or adjustment to existing facilities within the project limits. The information obtained shall be shown on the concept plans. The ENGINEER shall show the location of the proposed utility lines, existing utility lines and any adjustments and/or relocation of the existing lines within the project limits. ENGINEER shall complete all forms necessary for City to obtain permit letters from TxDOT and submit such forms to the City. City shall be responsible for forwarding the forms to the affected agencies for execution. B. Monthly Progress Report The ENGINEER shall submit a progress schedule after the design .contract is fully executed. The schedule shall be updated and submitted to the CITY along with monthly progress report as required under Attachment B of the contract. C. Route Analysis The Engineer will prepare a route analysis for the new waterline. A maximum of three alternate routes will be considered for the waterline. Existing ROW will be used wherever possible to minimize the ROW acquisition requirements. Two meetings will be held: one with the city to discuss options, and one with the City and the major landowner east of I-35. 1. A brief report with the alternates delineated will be presented to the CITY within 3 weeks of notice to proceed. Tarrant Appraisal District maps will be used to indicate property ownership. The report will contain line lengths, obstacles, and proposed street alignments. The CITY will furnish to the ENGINEER the connection point details in a EA6-2 timely manner. 2. Part B shall not begin until the CITY has selected and approved the alignment. D. �Pump Station Improvements The Engineer will perform hydraulic analyses to develop the system curve for the North Beach North Side III booster pump station. Determine the recommended pumping capacity, motor horsepower, SCADA, and electrical requirements. A report will submitted to the City with the results and recommendations within 6 weeks of notice to proceed. PART B- CONSTRUCTION PLANS AND SPECIFICATIONS A, Conceptual Engineering 1. Surveys For Design a. ENGINEER will perForm field surveys to collect horizontal and vertical elevations and other information which will be needed for use by the ENGINEER in design and preparation of plans for the project. Information gathered during the survey shall include topographic data, elevations of all sanitary and adjacent storm sewers, rimrnvert elevations, location of buried utilities, structures, and other features relevant to the final plan sheets. For sewer lines located in alleys or backyards, ENGINEER will obtain the following: Obtain permission for surveying through private property. Locate horizontal and vertical alignment of utility lines. Tie improvements, trees, fences, walls, etc., horizontally along rear lines in an approximately 20' wide strip. In addition, locate all rear house corners and building comers in backyards. Profile existing water and/or sewer line centerline. Compife base plan from field survey data at 1"-40' scale. EA6-3 Obtain permission for surveying through private property. Locate horizontal and vertical alignment of utility lines. The improvements, trees, fences, walls, etc., horizontally along rear lot lines in an approximately 20' wide strip. In addition, locate all rear house corners and building comers in backyards. Compile base plan from field survey data at 1" = 40' horizontal and 1" = 4' vertical scale. b. Engineer Will Provide The Following Information: All plans, field notes, plats, maps, legal descriptions, or other specified documents prepared in conjunction with the requested services shall be provided in a digital format compatible with the electronic data collection and computer aided design and drafting software currently in use by the CITY Department of Engineering. All text data such as plan and profile, legal de.scriptions, coordinate files, cut sheets, etc., shall be provided in the American Standard Code for Information Interchange (ASCII) format, all drawing files shall be provided in Autocad (DWG or DXF) format (currently Release 12), or as otherwise approved in writing by the CITY, and all data collected and generated during the course of the project shall become the property of the CITY. The minimum information to be provided in the plans shall include the following: 1. A Project �Control Sheet, showing ALL Control Points, used or set while gathering data. Generally on a scale� of not less than 1:400: 2. The following information about each Control Point; a. Identified (Existing City Monument #8901, PK Nail, 5/8" Iron Rod) b. X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on City Datum only. c. Descriptive Location (Ex. Set in the centerline of the inlet in the South curb line of North Side Drive at the EA6-4 East end of radius at the Southeast corner of North Side Drive and North Main Street). 3. Coo�dinates on all P.C.'s, P.T.'s, P.I.'s, Manholes, Valves, etc., in the same coordinate system, as the Control. 4. No less than finro horizontal control points, per line or location. 5. Bearings given on all proposed centerlines, or baselines. 6. Station equations relating utilities to paving, when appropriate. C. Public Notification Prior to conducting design survey, ENGINEER will notify affected landowners of the project in writing. The notification letter shall be on company letterhead and shall include the following: project name, limits, DOE project no. and schedule. D. Conceptual Engineering Plan Submittal 1. Conceptual plans shall be submitted to City 30 days after the submission and approval of items in Part A above. 2. The ENGINEER shall perform conceptual design of the proposed improvements and furnish four (4) copies of the concept engineering plans which includes layouts, preliminary right-of-way needs and cost estimates for the ENGINEER's recommended plan. ENGINEER shall perForm remaining field surveys required for final design of selected route(s). All design shall be in conformance with Fort Worth Water Department policy and procedure for processing water and sewer design. ENGINEER shall review the City's water master plan and provide a summary of findings pertaining to the proposed project. 2. Preliminary Engineering EA6-5 Upon approval of Part B, Section 2, ENGINEER will prepare preliminary construction plans as follows: a. Overall water and/or sanitary sewer layout sheets and an overall easement layout sheet(s). b. Preliminary project plans and profile sheets which show the following: Proposed water plan/profile and recommended pipe size, suggested valve locations and all pertinent information needed to construct the project. Legal description (Lot Nos., Block Nos., and Addition Names) along with property ownership shall be provided on the plan view. c. Existing utilities and utility easements will be shown on the plan and profile sheets. ENGINEER will coordinate with utility companies and the City of Fort Worth to determine if any future improvements are planned that may impact the project. d. The ENGINEER shall make provisions for reconnecting all water and/or wastewater service lines which connect directly to any main being replaced, including replacement �of existing 'service lines within City right-of-way or utility easement. When the existing alignment of a water and sanitary sewer main or lateral is changed, provisions will be made in the final plans and/or specifications by the ENGINEER to relocate all service lines which are connected to the existing main and connect said service lines to the relocated main. e. The ENGINEER will prepare standard and special detail sheets for water line installation and sewer rehabilitation or replacement that are not already included in the D-Section of the City's specifications. These may include connection details between various parts of the project, tunneling details, boring and jacking details, waterline relocations, details unique to the construction of the project, trenchless details, and special service lateral reconnections. EA6-6 f. Right-of-Way Research The ENGINEER will conduct preliminary research for availability of existing easements where open-cut construction or relocation of existing alignments is probable. Temporary and permanent easements will be appropriated based on available information and recommendations will be made for approval by the City. g. Right-of-way/Easement Preparation and Submittal Preparation and submittal of right-of-way, easements and rights-of-entry will be in conformance with "Submittal of Information to Real Property for Acquisition of Property". Eight legal descriptions are anticipated for the 24-inch waterline. Easements are anticipated and no provision has been made in the budget for setting of property corners for right of way acquisition. h. Utility Clearance Phase The ENGINEER will consult with the City's V1/ater Department, Department of Engineering, and other CITY departments, public utilities, private utilities, private utilities and government agencies to determine the approximate location of above and underground utilities, and other facilities that have an impact or influence on the project. ENGINEER will design City facilities to avoid or minimize conflicts with existing utilities. The ENGINEER shall deliver a minimum of 13 sets of � approved preliminary construction plans to the City's Utility Coordinator for forwarding to all utility companies, which have facilities within the limits of the project. _, Preliminary construction plan submittal 1. Preliminary plans and specifications shall be submitted to City 90 days after approval of Part B, Section 1. EA6-7 � 2. The ENGINEER shall deliver two (2) sets of preliminary construction plans and two (2) sets of specifications and contract documents to CITY for review. Generally, plan sheets shall be organized as follows: Cover Sheet Easement layout (if applicable) Plan & Profile Sheets Standard Construction Details Special Details (If applicable) 3. The ENGINEER shall submit a preliminary estimate of probable construction cost with the preliminary plans submitted. ENGINEER shall assist City in selecting the feasible and/or economical solutions to be pursued. J. Review Meetings with City The ENGINEER shall meet with CITY to discuss review comments for preliminary submittal. The CITY shall direct the ENGINEER in writing to proceed with Final Design for Final Review. x. Public Meeting After the preliminary plans have been reviewed and approved by the City, ENGINEER shall prepare exhibits along with an invitation letter and attend public meeting to help explain the proposed project to residents. The CITY shall mail the invitation letters. 3. Final Engineering Plan Submittal a. Final Construction Documents shall be submitted to CITY 60 days after approval of Part B, Section 2. Following CITY approval of the recommended improvements, the ENGINEER shall prepare final plans and specifications and contract documents to CITY (each sheet shall be stamped, dated, and signed by EA6-8 the ENGINEER) and submit two (2) sets of plans and construction contract documents within 15 days of CITY's final approval. Plan sets shall be used for Part C activities. 4. ENGINEER's Estimate of Probable Constructi'on Cost The ENGINEER shall submit a final estimate of probable construction cost with the final plans submitted. PART C - PRE-CONSTRUCTION ASSISTANCE Administration 1. Deliver Bid Documents The ENGINEER will make available for bidding, upon request by the CITY, up to forty (40) sets of the final approved and dated plans and specifications and contract documents for the projects to the CITY for distribution to potential bidders. Proposal will be delivered in electronic format (Microsoft Word). 2. Bidding Assistance The ENGINEER shall assist the CITY during phase including preparation and delivery of addenda to plan holders and responses to questions submitted to the DOE by prospective bidders.. Engineer shall attend the scheduled pre-bid conference. The ENGINEER shall assist in reviewing the bids for completeness and accuracy. The ENGINEER shall attend the project bid opening develop bid tabulations in hard copy and electronic format and submit four (4) copies of the bid tabulation. 3. Assistance During Construction The ENGINEER shall attend the pre-construction conference for the project. The ENGINEER shall also consult with and advise the CITY on design andlor construction changes, if necessary. EA6-9 ATTACHMENT "B" COMPENSATION AND SCHEDULE CAPITAL IMPROVEMENTS PROJECTS DOE #2731 I. Compensation A. The Engineer shall be compensated a revised total lump sum fee of $324.900 as summarized in Exhibit "B-3". , Payment of the total lump sum fee shall be considered full compensation for the services described in Exhibit "A-6" for all labor materials, supplies and equipment necessary to complete the project. B. The Engineer shall be monthly on the basis of statements prepared from the books and records of account of the Engineer. In this regard, the Engineer shall submit invoices for partial payments as described in Exhibit "B-1 ", Section 1— Method of Payment. II. Schedule 36-inch Line A. Conceptual plans will be submitted 90 days after the City to proceed. B. Preliminary construction plans will be submitted 90 days after City approval of the conceptual plans. C. Final construction plans will be submitted 60 days after City approval of the preliminary construction.plans 24-Inch Line A. The Route Analysis will be presented to the City within 3 weeks of notice to proceed. B. Conceptual plans will be submitted within 30 days after approval of item A. C. Preliminary Construction Plans will be submitted within 90 days after approval of item B. D. Final Construction plans will be submitted within 60 days after City approval of the preliminary construction plans. Pump Station A. FOR DESIGN OF THE CITY OF FORT WORTH 36-INCH WATERLINE FROM FOSSIL HILL ESTATES TO HARMON ROAD RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute an amendment to City Secretary Contract No. 24784 with Freese & Nichols, Inc. in the amount of $167,300, revising the contract amount to $324,900. DISCUSSION: On March 11, 1999 (M&C C-17306), the City Council authorized the City Manager to execute an engineering services agreement with Freese & Nichols, Inc for the design of the City of Fort Worth 36- inch waterline from Fossil Hill Estates to Harmon Road. The scope of work covered by this amendment was considered in the original contract; however, water demands from the east side of IH-35W at that time did not warrant it. Presently, demands as well as the ability to provide a second feed from the North Beach Street Pump Station make this work necessary. The proposed amendment will provide for the design of a 24-inch waterline from the Harmon Road Elevated Tank feed line east of Interstate Highway 35W to the Beach Street Pump Station, a distance of approximately 12,000 feet. Pump station improvements at the North Beach Pump Station are included in this project. This line is part of the Northside III Water Transmission Line ultimately planned to serve the far north Fort Worth area to meet increasing water demands. Freese & Nichols, Inc. proposes to provide engineering services for this project for a total lump sum fee not to exceed $167,300. Freese & Nichols, Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 26% participation. The City's goal on this amendment is 25%.
