WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a M&C C-17648 adopted by the City Council on 21St day of September 1999, and further amplified in a proposal letter dated August 2, 1999, copies of which are both attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $24,000.00. 2. The recommended amendment will allow Wendy Lopez & Associates, Inc. to perform the necessary survey and design work for the additional sewer lines. Staff considers th� proposed fee of $24,000.00 to be fair and reasonable for the additional work to be performed. Wendy Lopez & Associates, Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 7% M/WBE participation on this amendment. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Commercial Paper-Sewer Fund. We intend to utilize ANA Consultants, L.L.C. in an expanded role to provide assistance in preparing the drawings.
