A RESOLUTION DETERMINING THE NECESSITY FOR ACQUIRING REAL
PROPERTY AND AUTHORIZING ITS APPROPRIATION OR
CONDEMNATION FOR PUBLIC USE
WHEREAS, the Fort Worth City Council on June 9, 2026, in M&C 26-0477 ordered and decreed
that a public necessity existed to acquire 178,456 square feet of permanent water main easement rights
and 299,548 square feet of temporary construction easement rights from real properties as listed below.

The Necessary property interests are described in the exhibits attached to the above -referenced M&C; those
exhibits are incorporated herein for all purposes (the "Property");
WHEREAS, the Fort Worth City Council has determined that:
- the Properties are needed for the Northside III 54-inch Water Transmission Main. Phase 1
Project (the "Project");
- the land rights in these Properties are needed to move potable water from the Eagle Mountain
water treatment plant to the City's retail customers in north Fort Worth as well as wholesale
water customers that border the northern city limits. Timely Completion of this project is
necessary to improve the City's water system reliability and support continued growth. in
North Fort Worth;
- public necessity required the acquisition by condemnation of the Properties, located within the
alignment of the Project;
- the use of the Properties will be a public use; and
- the Real Estate Division of the Property Management Department is authorized to acquire by
negotiation the Properties needed for the Project.
WHEREAS, negotiations between the City of Fort Worth and the property owners, listed above,
have been unsuccessful due to the inability to negotiate agreeable terms for the property interests being
acquired by the City of Fort Worth; and
WHEREAS, on this 9t' day of June 2026, at a regular meeting of the Fort Worth City Council,
upon Motion of Councilmember Jamieson, to wit:

The Northside III 54-inch Water Transmission Main, Phase 4 project will move potable water from the

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
The City of Fort Worth, Texas, is authorized to use the power of eminent domain to acquire the
Properties for the public use and inclusion in the Project; and
The City Attorney be and is hereby authorized and directed to file or cause to be filed, to spend all
reasonable and necessary legal expenses, and to carry through to final judgment proceedings in eminent
domain for the acquisition of the property interests listed above and attached to the M&C.

It is recommended that the City Council:

3. Authorize the City Attorney to institute condemnation by eminent domain proceedings to acquire the described property interests from the
property owners;
4. Authorize payments pursuant to an award of commissioners or negotiated settlements; and
5. Authorize the City Manager or his Designee to accept and record the appropriate documents.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to request approval to adopt a resolution authorizing the use of eminent domain
to acquire 178,456 square feet of permanent water -main easement rights and 299,548 square feet of temporary construction easement rights
from multiple Real Properties needed for the Northside III 54-Inch Water Transmission Main, Phase 4 project.
The Northside III 54-inch Water Transmission Main project (City Project No. 104940) includes a 54-inch water line that will be installed from Peden
Road/Business 287 to Blue Mound Road/Wagley Robertson Road. This project aims to enhance the system's capacity, improve its reliability, and
support ongoing growth and water demand in north Fort Worth. Once completed, along with the other four phases, the project will be capable of
delivering an additional 82 million gallons per day (MGD) of water for both existing and future developments.
The land rights for the subject properties are required for the Northside III 54-inch Water Transmission Main project, which will enhance system
capacity, improve reliability, and support continued growth and water demand in north Fort Worth.
An independent appraisal established the Fair Market Value of the property interests, including permanent water main easement rights and
temporary construction easement rights, at a total of $630,024.00. Despite good -faith efforts, negotiations were unsuccessful due to the parties'
inability to reach agreement on acceptable terms for the acquisition by the City of Fort Worth (City).
Upon approval, a condemnation action will be brought forward and a Special Commissioners' hearing held to acquire the necessary property
interests (shown below).

The Northside III 54-inch Water Transmission Main, Phase 4 project will move potable water from the Eagle Mountain Water Treatment Plant to our
retail customers in north Fort Worth as well as wholesale water customers that border our northern City limits. Timely completion of this project is
necessary to improve our water system reliability and support continued growth. The Property interests to be acquired is described by metes and
bounds and depicted by survey exhibits attached to this Mayor and Council Communication."
Funding is budgeted in the W&S Rev Bonds Series 2024 Fund for the Property Management and Water Departments for the purpose of funding
the Northside III 54-inch Water Transmission Main, Phase 4 project.
The properties are located in COUNCIL DISTRICT 10.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the W&S Rev Bonds Series
2024 Fund for the NS11154-inch WTM project to support the approval of the above recommendations and acquisition of easements. Prior to any
expenditure being incurred, the Property Management and Water Departments have the responsibility to validate the availability of funds
