HomeMy WebLinkAbout28428-04-2026 - City Council - OrdinanceORDINANCE NO. 28428-04-2026 AN ORDINANCE AMENDING CHAPTER 22 • MOTOR VEHICLES AND TRAFFIC,-ARTICLE III • OPERATION OF VEHICLES,■ SECTION 22-86 • SPEEDING,- SUBSECTION (i) OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (2015), AS AMENDED, TO CHANGE THE BLOCK RANGES AND EXTENT OF CERTAIN SPEED ZONES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL TY CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth's Transportation and Public Works (TPW) Department routinely reviews the speed limits in the Code of the City of Fort Worth, Texas (2015), as amended, ("City Code") in order to make corrections, additions or amendments, where appropriate; WHEREAS, the TPW Department desires to amend the speed zone tables included in the City Code to provide for text and block range changes; WHEREAS, on August 17, 2016, the North Texas Tollway Authority (NTTA) Board of Directors adopted Resolution No. 16-92, which established speed zones for Chisholm Trail Parkway within Fort Worth City Limits; WHEREAS, NTTA followed the Texas Department of Transportation's "Procedures for Establishing Speed Zones" dated August 2015, to create the Chisholm Trail Parkway speed zones; WHEREAS, the Texas Transportation Code Section 545.356 specifies the procedures for a municipality to set speed zones and to post speed limits; and WHEREAS, this ordinance incorporates the above recommendations and amends the Speed Zone Tables of Chapter 22 "Motor Vehicles and Traffic," Article III "Operation of Vehicles," Section 22-86 "Speeding," Subsection (i) of the City Code as recommended by the TPW Department; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: Ordinance No.28428-04-2026Page 1 Section 22-86, Speeding, Subsection (i) SECTION 1. Chapter 22 "Motor Vehicles and Traffic," Article III "Operation of Vehicles," Section 22-86 "Speeding," Subsection (i) of the Code of the City of Fort Worth, Texas (2015), as amended, is hereby amended by making additions, deletions and modifications as specifically indicated: Freeways Street Block Extent Speed (mph) Chisholm Trail 2000-2249 Forest Park Boulevard to University 50 Parkway (CTP) Drive Chisholm Trail 2250-3499 University Drive to Arborlawn Drive 60 Parkway (CTP) Chisholm Trail 3500-7099 Arborlawn Drive to Altamesa Boulevard 65 Parkway (CTP) Chisholm Trail 7100-11999 Altamesa Boulevard to south City Limits 70 Parkway (CTP) (.5 Mile north of FM 1187) SECTION 3. This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of Fort Worth, Texas, (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the Code of the City of Fort Worth, or any other ordinances of the City, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition by the courts. Any person who violates, disobeys, omits, neglects, or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined an amount not exceeding two hundred dollars ($200.00) for each offense. SECTION 7. The City Secretary of the City of Fort Worth, Texas is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Texas Local Government Code, Section 52.013. SECTION 8. All other provisions of Chapter 22 of the Code of the City of Fort Worth, Texas, (2015), as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 9. This ordinance shall take effect upon adoption and publication as required by law, and it is so ordained. City of Fort Worth, Texas Mayor and Council Communication DATE: 04/28/26 M&C FILE NUMBER: M&C 26-0327 LOG NAME: 20CHAPTER 22 AMENDMENT FY 26 SUBJECT (CD 3, CD 6 and CD 9) Adopt an Ordinance Amending Chapter 22 "Motor Vehicles and Traffic," Article Ill "Operation of Vehicles," Section 22-86 "Speeding," Subsection (i) of the Code of the City of Fort Worth, Texas (2015), as Amended, to Adjust the Block Numbers and Extents of Speed Limits on the Chisholm Trail Parkway RECOMMENDATION: It is recommended that the City Council adopt the attached Ordinance amending Chapter 22 "Motor Vehicles and Traffic," Article Ill "Operation of Vehicles," Section 22-86 "Speeding," Subsection (i) of the code of the City of Fort Worth, Texas (2015), as amended, to adjust the block numbers and extents of speed limits on the Chisholm Trail Parkway. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to amend the City Code of Ordinances to modify existing block numbers and extents of the speed limits on the Chisholm Trail Parkway within city limits. Modifications include text and block range changes. Amendments to Section 22-86, Subsection (i) of the City Code are needed to modify overlapping block ranges and incorrect extents. Transportation and Public Works routinely reviews the speed limits in the City Code to make corrections, additions, or amendments where appropriate. Municipal Court requested this review to ensure that citations issued could be prosecuted. Proposed ordinance changes are based upon North Texas Tollway Authority (NTTA) Resolution No. 16-92, adopted by the NTTA Board on August 17, 2016, which established the speed limits for Chisholm Trail Parkway within Fort Worth City Limits. NTTA followed TxDOT's "Procedures for Establishing Speed Zones" dated August 2015, to create the zones.
