Ttiis agreement by and between the State of Texas, acting by and through the Texas Department of
Transportation, hereinafter call the State, and The City of Fort Worth, Texas, acting by and through its duly
authorized officials under Ordinance dated the day of 1999, hereinafter called the
City, shal( be effective on the date of npproval nnd execution b,y n�td on behalf of the State.
WHEREAS, the State and the City desire to enter into contractual agreements and acquire right of way on the
following projects:
Highway Account No. Limits
Rosedale Street (PASS) � From: Riverside Drive. To: U.S. Hi4hway 287 ; and
WHEI2EAS, the City Itas now requested that the State assume responsibility for acquisition of all necessary
right of way; and,
�VHi;REAS, the City desires to voluntarily contribute to the State funds equal to fifty (50) percent of the cost of
the right of way, eligible utility adjusmients and eligible relocation benefits for the proper development and
construction of the State Highway System;
NOW, THEREFORE, in consideration of the foregoing premises and the mutual benefits to be derived
tlierefrom, the City shall contribute to the State an amount equal to fifty (50) percent of the cost of the right of
way, eligible utility adjustments and eligible relocation benefits to be acquired, adjusted or administered by the
State and shall transmit to the State with the return of this agreement, executed by the City, a warrant or check
payable to the Texas Department of Transportation in the amount of Six Hundred Thirty Thousand and No/ 100
Dollars ($630,000.00); however, if it is found that this amount is insuf�'icient to pay the City's obligation, then
tlie City, upon request of tlle State, will forthwith supplement tl�is amount in such amount as requested by the
State. The City will be given full credit based upon the State's determined value, up to the amount of their right
of way obligation, for all right of way parcels acquired in the name of the State by donation or without cost after
the effective date of this contract. Upon completion of the project and in the event the amount paid and or
credited is more than the City's right of way obligation, then any excess amount previously paid by the City will
be returned to the City. Cost of the right of way acquired by the State shall mean the totat value of
compensation to owners Eor their property interests either by negotiation or eminent domain.

It is recommended that the City Council:
1. Authorize the City Manager to enter into the necessary agreements with the Texas Department of
Transportation (TxDOT) to begin right-of-way acquisition �'or the future reconstruction of East
Rosedale from IH-35W to US 287; and
2. Authorize the City Manager to utilize $1.5 million in funds from approved 1998 Capital
Improvements Program (CIP) projects scheduled for future years to fund the City's share of this
project.
DISCUSSION:
On November 27, 1990, the City Council approved M&C G-8922 accepting the provisions of the then
State Department of Highways and Public Transportation Commission (now TxDOT) Minute Order No.
9Q823 p.roviding for the constructian of East Rosedale Street from IH-35W to US 287. TxDOT has
notified staff that it is prepared to proceed with right-of-way acquisition on the project.
Staff proposes to utilize funds from 1998 CIP projects scheduled for future years to fund the City's,
share of this project. Therefore, at some point it may become necessary to replace these funds from
other sources should funds from the 1998 ClP be fully utilized.
The East Rosedale Street project includes the widening and reconstruction af the roadway from IH-35W
to US 287. The City will participate in 50% of the total costs of the project. The estimated total cost of
right-of-way acquisition is $3.0 million with the City's share of $1.5 million. The estimated cost of
construction is approximately $9 million with the City responsible for $4.5 million of these costs. A
timetable for construction will be finalized after completion of right-of-way acquisition (tentatively
scheduled for 2001).
Approval of the above recommendations will allow staff to enter into the necessary agreements and
fund the City's share of right-of-way acquisition costs.
