HomeMy WebLinkAbout26-6330 - City Council - Resolution (2)A Resolution NO. 26-6330 A RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT NO. 2 TO AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION TO INCREASE THE PROJECT AMOUNT TO $15,867,577.00 WITH CITY PARTICIPATION IN THE AMOUNT OF $1,288,125.00 AND TRANSPORTATION DEVELOPMENT CREDITS IN THE AMOUNT OF 1,877,798, PLUS ANY COST OVERRUNS, FOR THE HORNE STREET RECONSTRUCTION PROJECT. WHEREAS, on January 28, 2021, the City of Fort Worth and the Texas Department of Transportation ("TxDOT") entered into a Local Project Advance Funding Agreement ("AFA") for the design and construction of the Horne Street Reconstruction Project with City Participation in the Form of Transportation Development Credits in the amount of 1,460,283 (M&C 20-0829, Resolution No. 5299-11-2020; City Secretary Contract No. 55194; CSJ#0902-90-148); WHEREAS, on August 20, 2024, the City and TxDOT executed Amendment No. 1 to the Advance Funding Agreement to increase federal funding from $8,146,318.00 to $9,364,758.00 with City Participation in the Form of Transportation Development Credits Increasing to 1,795,305 (City Secretary Contract No. 55194 - Al, Resolution No. 5972-06-2024, M&C 24-0566); WHEREAS, it has become necessary to amend the AFA to increase the federal funding up to $15,867,577.00, revise State Costs to $37,963.00, add City funding in the amount of $1,288,125.00 and increase Transportation Development Credits to the amount of 1,877,798. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: 1. The City Council authorizes the City Manager or Assistant City Manager to execute Amendment No. 2 to the Advance Funding Agreement with the Texas Department of Transportation for the Horne Street Reconstruction project (City Secretary No. 55194; CSJ#0902-90-148, CSJ# 0902-90-343) to increase the project amount to $15,867,577.00 with city participation in the amount of $1,288,125.00 and Transportation Development Credits in the amount of 1,877,798, plus any cost overruns.; and 2. FORT WORTHfU MAYOR AND COUNCIL COMMUNICATION 7.1.3 20HORNE ST RECONSTRUCTION PROJECT UPDATED AFA DATE: 06/23/26 M&C FILE NUMBER: M&C 26-0512 DEPARTMENT: TRANSPORTATION PUBLIC WORKS SUBJECT (CD 3 and CD 6) Rescind Resolution No. 6196-11-2025; Adopt a Resolution Authorizing Execution of Amendment No. 2 to an Advance Funding Agreement with the Texas Department of Transportation Increasing the Amount Up to $15,867,577.00 with Local Participation in the Amount of $1,288,125.00 and in the Form of Transportation Development Credits in the Amount of 1,877,798.00, Plus Any Cost Overruns, for the Horne Street Reconstruction Project RECOMMENDATION It is recommended that the City Council: 1. Rescind Resolution No. 6196-11-2025; and 2. Adopt the attached resolution authorizing execution of Amendment No. 2 to an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-148, CSJ# 0902-90-343) for the Horne Street Reconstruction project (City Project No. 102764) in the amount up to $15,867,577.00 with local participation in the amount of $1,288,125.00 and by Transportation Development Credits in the amount of 1,877,798.00, plus any cost overruns. DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to rescind Resolution No. 6196-11-2025 (M&C 25-1071, November 18, 20250), due to project funding revisions and adopt a resolution authorizing execution of Amendment No. 2 to the Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the revised amount of $15,867,577.00 with local participation by City funds in the amount of $1,288,125.00 and Transportation Development Credits (TDCs) increasing to the amount of 1,877,798.00, plus any cost overruns, for the Horne Street Reconstruction project (City Project No. 102764). The Federal participation portion will be in the amount of $14,541,489.00 and corrected State participation in the amount of $37,963.00. A payment to TxDOT is required in the amount of $64,406.00 for this project before construction. The TDCs will be appropriated and tracked as a non -spendable item in the Grants Capital Project Other Fund. The scope of work for the project remains as described in M&C 25-1071. All other actions in M&C 25-1071 remain valid. 1 of 2 FORT WORTH.
