A Resolution NO.26-6331 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCED FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $1,014,970.00 WITH CITY PARTICIPATION IN THE AMOUNT OF $124,500.00 FOR CONSTRUCTION OF THE FTW_BY0287_MAIN ST_FORT WORTH PROJECT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes; and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision; and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds; and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50- 15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects; and WHEREAS, the Intersection Improvements at BUSINESS 287 (N. Main Street) and 29th Street Project will improve safety for pedestrians and motorists, provide Americans with Disabilities Act (ADA) compliant pedestrian crosswalks as well as enhance the efficiency of traffic flow within the project area of the intersection by making traffic signal improvements; and WHEREAS, the City desires to enter into an Advance Funding Agreement with the Texas Department of Transportation for the FTW_BY0287_Main St —Fort Worth Project in the amount of $1,014,970.00 with Federal Participation in the amount of $734,897.00, State Costs in the amount of $155,573.00 plus any construction cost overruns, and City Participation in the amount of $124,500.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: 1. The City Council authorizes the City Manager or Assistant City Manager to execute an Advance Funding Agreement with the Texas Department of Transportation for the FTW_BY0287_Main St_Fort Worth Project (CSJ: 0014-01- 032) in the amount of $1,014,970.00 with City Participation in the amount of $124,500.00; and 2. Rescind Resolution Number 6230-01-2026 adopted January 13, 2026; and 2. Adopt the attached Resolution authorizing the execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0014-01-032) for the intersection improvements at Business 287 (North Main Street) and 29th Street project (City Project No. 106608) in the amount of $1,014,970.00 with Local participation in the amount of $124,500.00. DISCUSSION The purpose of this Mayor and Council Communication (MSC) is to rescind Resolution No. 6230-01-2026 adopted by M&C 26-0049 (January 13, 2026), and adopt a revised resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) for the intersection improvements at Business 287 (North Main Street) and 29th Street project (City Project No. 106608) (CSJ# 0014-01-032) in the amount of $1,014,970.00 with Federal participation in the amount of $734,897.00, State participation in the amount of $155,573.00 and Local participation in the amount of $124,500.00. Resolution No. 6230-01-2026 was based on a draft AFA. This new resolution is needed to reflect updated cost allocations. The AFA authorized by this resolution was not yet executed. All other elements of the original M&C remain unchanged. The scope of work for the project remains as described in M&C 26-0049. TxDOT will be responsible for the construction of the project and cost overruns. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for the grant portion of the project was not included in the Fiscal Years 2026-2030 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. This project is located in COUNCIL DISTRICT 2. Indirect cost recovery does not apply. FISCAL INFORMATION/CERTIFICATION The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
