A RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT NO.
2 TO AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION TO REVISE THE PROJECT
AMOUNT TO $3,007,579.00 WITH CITY PARTICIPATION IN THE
AMOUNT OF $999,709.00 PLUS ANY COST OVERRUNS FOR THE
CONSTRUCTION OF THE OAKLAND-MILLER SAFE STREET
PROJECT.
WHEREAS, on March 26, 2024, the City of Fort Worth and the Texas Department of
Transportation ("TxDOT") entered into a Local Project Advance Funding Agreement
("AFA") for the construction of the Oakland -Miller Safe Street Project (M&C 24-0241,
Resolution No. 5919-03-2024; City Secretary Contract No. 61463; CSJ#0902-90-296); and
WHEREAS, on October 28, 2025, the City adopted Resolution No. 6178-10-2025
authorizing Amendment No. 1 to the Advance Funding Agreement to add scope and a second
CSJ 0902-90-350, revise state funding to $151,128.00 and decrease city cost to $999,709.00
(City Secretary Contract No. 61463-A1, Resolution No. 6178-10-2025, M&C 25-1016); and
WHEREAS, TxDOT revised its calculations for state costs after Resolution No. 6178-
10-2025 had been adopted and sent for execution an AFA Amendment No. 1 with cost
participation which differed from the Amendment No. 1, on which the resolution was based;
and
WHEREAS, on December 22, 2025, the subsequently revised Amendment No. 1 was
executed by the City without awareness of the changed cost participation; and
WHEREAS, it has become necessary to amend the AFA with Amendment No. 2 to
harmonize the cost participation amounts and revise State Costs to $7,870.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
1. The City Council authorizes the City Manager or Assistant City Manager to
execute Amendment No. 2 to the Advance Funding Agreement with the Texas Department
of Transportation for the Oakland -Miller Safe Street project (City Secretary No. 61463;
CSJ#0902-90-296 and 0902-90-350) in the amount of $3,007,579.00 with city
participation in the amount of $999,709.00, plus any cost overruns; and
2. This resolution shall be effective from and after its passage by the City Council.

(CD 5, CD 8, and CD 11) Adopt Resolution Authorizing Execution of Amendment No. 2 to an
Advance Funding Agreement with the Texas Department of Transportation to Reduce the
Advance Funding Agreement Amount to $3,007,579.00 With City Participation in the Amount
of $999,709.00 for the Oakland Boulevard and Miller Avenue Safe Streets Project (2022 Bond
Program)
RECOMMENDATION
It is recommended that the City Council adopt the attached resolution authorizing execution
of Amendment No. 2 to the Advance Funding Agreement with the Texas Department of
Transportation (City Secretary Contract No. 61463, CSJ 0902-90-296) for the Oakland
Boulevard and Miller Avenue Safe Streets project (City Project No. 104803) to decrease the
Advance Funding Agreement amount to $3,007,579.00 with City participation in the amount
of $999,709.00, plus any cost overruns.
DISCUSSION
The purpose of this Mayor and Council Communication (M&C) is to adopt the attached
resolution authorizing execution of Amendment No. 2 to the Advance Funding Agreement
(AFA) with the Texas Department of Transportation (TxDOT) for the Oakland Boulevard and
Miller Avenue Safe Streets project (City Project No. 104803) to reduce the total AFA amount
from $3,150,837.00 to $3,007,579.00 with City participation in the amount of $999,709.00 plus
cost overruns. The decrease is within the state indirect cost and will not be appropriated in
the City's finance system.
On March 26, 2024, the City Council adopted Resolution No. 5919-03-2024 to authorize
execution of the AFA with TxDOT (City Secretary Contract No. 61463, M&C 24-0241). On
October 28, 2025, the City Council adopted Resolution No. 6178-10-2025 to authorize
execution of the AFA Amendment No. 1, add scope and a second CSJ 0902-90-350, revise
state funding to $151,128.00, and decrease city cost to $999,709.00. In the interim period
between the resolution's adoption and TxDOT's routing the AFA for execution, TxDOT revised
its calculations and provided for City Manager signature a second version of Amendment No.
1 that had not been reviewed by staff. This version was executed, and only later was the

change noticed by staff. This Amendment No. 2 is needed to harmonize the AFA, as amended
as well as to reflect the reduced State Indirect costs.
The project's scope includes providing additional protection to existing on -street bike lanes.
These features include enhancing pavement markings, installing Pedestrian Hybrid Beacon
(PHB) signals, modifying traffic signals, adding bike signals, replacing curb ramps, and
improving streetlights. The project is to improve safety by increasing visibility and separation
for bicyclists and pedestrians and encouraging equitable mobility facilities. This project will
not eliminate the roadway lanes or impact capacity.
This AFA Amendment No. 2 modifies the agreement to include funding as shown in the table
below. The City of Fort Worth will be responsible for cost overruns.

This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper
(ECP) (M&C 22-0607; Ordinance 25765-08-2022) provides liquidity to support the
appropriation. Available resources will be used to make interim progress payments until the
debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the
interim financing source by the statement expressing official Intent to Reimburse that was
adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022).
This contract will be with a governmental entity, state agency or public institution of higher
education.
FISCAL INFORMATION/CERTIFICATION
The Director of Finance certifies that approval of these recommendations will have no
material effect on City funds. This is a State Advance Fund Agreement.
