A Resolution NO.26-6333 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCED FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $1,437,777.00 WITH CITY PARTICIPATION IN THE AMOUNT OF $154,468.00 FOR CONSTRUCTION OF THE FTW_BU0287_MANSFIELD HWY_FORT WORTH PROJECT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes; and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision; and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds; and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50- 15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects; and WHEREAS, the Intersection Improvements at BUSINESS 287 (Mansfield Highway) and Wichita Street Project will improve safety for pedestrians and motorists, provide Americans with Disabilities Act (ADA) compliant pedestrian crosswalks as well as enhance the efficiency of traffic flow within the project area of the intersection by installing positive offset left turn lanes, ADA compliant pedestrian infrastructure, and making traffic signal improvements; and WHEREAS, the City desires to enter into an Advance Funding Agreement with the Texas Department of Transportation for the FTW_BU0287_Mansfield Hwy_Fort Worth Project in the amount of $1,437,777.00 with Federal Participation in the amount of $1,060,862.00, State Costs in the amount of $222,447.00 plus any construction cost overruns, and City Participation in the amount of $154,468.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: 1. The City Council authorizes the City Manager or Assistant City Manager to execute an Advance Funding Agreement with the Texas Department of Transportation for the FTW_BU0287_Mansfield Hwy_Fort Worth Project (CSJ: 0172-01-059) in the amount of $1,437,777.00 with City Participation in the amount of $154,468.00; and 2. Rescind Resolution Number 6229-01-2026; 2. Adopt the attached Resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0172-01-059) for the intersection improvements at Business 287 (Mansfield Highway) and Wichita Street project (City Project No. 106611) in the amount of $1,437,777.00 with Local participation in the amount of $154,468.00; 3. Repeal Appropriation Ordinance Number 28214-01-2026; 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project State Fund, in the amount up to $216,986.00, subject to receipt of the grant, for the purpose of funding the Business 287 (Mansfield Highway) at Wichita Street project (City Project No. 106611); and 5. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to rescind Resolution Number 6229-01-2026 adopted by M&C 26-0046 dated January 13, 2026, repeal Appropriation Ordinance Number 28214-01-2026, and adopt a new resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0172-01-059) for the intersection improvements at Business 287 (Mansfield Highway) and Wichita Street project (City Project No. 106611) in the amount of $1,437,777.00 with Federal 1of4 FORT WORTH,, participation in the amount of $1,060,862.00, State participation in the amount of $222,447.00 and Local participation in the amount of $154,468.00. Resolution Number 6229-01-2026 was based on a draft Advance Funding Agreement (AFA). This new resolution is needed because TxDOT revised the AFA to revise the Indirect State Costs and Direct State Costs. All other elements of the original MSC remain unchanged. The scope of work for the project remains as described in M&C 26-0046. TxDOT will be responsible for the construction of the project and for the construction cost overruns. This updated AFA modifies the agreement to include funding as shown in the table below. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for the grant portion of the project was not included in the Fiscal Years 2026-2030 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. This project is located in COUNCIL DISTRICT 8 and COUNCIL DISTRICT 11. Indirect cost recovery does not apply. This contract will be with a governmental entity, state agency or public institution of higher education. FISCAL INFORMATION/CERTIFICATION The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Grants Capital Project State Fund. The Transportation & Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to any expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Fund Agreement.
