A Resolution NO. 26-6336 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $6,217,108.00 FOR THE FORT WORTH SIGNAL EQUIPMENT STANDARDIZATION PROJECT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes; and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision; and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds; and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50- 15.5E that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects; and WHEREAS, the Fort Worth Traffic Signal Equipment Standardization Project will improve the efficiency of traffic flow at approximately 300 intersections citywide by upgrading the traffic signal equipment at the identified intersections; and WHEREAS, the City desires to enter into an Advance Funding Agreement with the Texas Department of Transportation for the Ft Worth Signal Equip Standardization Project in the amount of $6,217,108.00 with Federal Participation in the amount of $6,200,027.00, State Costs in the amount of $17,081.00, and no formal City matching funds but city participation shall be in the form of installation by city forces or contractors and city is responsible for any cost overruns. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: 1. The City Council authorizes the City Manager or Assistant City Manager to execute an Advance Funding Agreement with the Texas Department of Transportation for the Ft Worth Signal Equip Standardization Project (CSJ: 0902- 90-361) in the amount of $6,217,108.00.; and 2. FORT WORM, MAYOR AND COUNCIL COMMUNICATION 7.1.15 FORT WORTH TRAFFIC SIGNAL EQUIPMENT STANDARDIZATION DATE: 06/23/26 M&C FILE NUMBER: M&C 26-0524 DEPARTMENT: TRANSPORTATION PUBLIC WORKS SUBJECT (ALL) Adopt Resolution Authorizing Execution of an Advance Funding Agreement with the Texas Department of Transportation in the Amount of $6,217,108.00 with Federal Participation in the Amount of $6,200,027.00 for the Fort Worth Traffic Signal Equipment Standardization Project and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council: Adopt the attached resolution authorizing the execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ 0902-90-361) for the Fort Worth Traffic Signal Equipment Standardization project (City Project No. 106683) in the amount of $6,217,108.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount of $6,200,027.00, subject to receipt of the grant, for the purpose of funding the Fort Worth Traffic Signal Equipment Standardization project (City Project No. 106683); and 3. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $6,217,108.00 for the Fort Worth Traffic Signal Equipment Standardization project (City Project No. 106683). The project intends to create a cost-effective solution to standardize and upgrade the traffic signal equipment to improve the efficiency of the traffic flow at approximately 300 signalized intersections, enhancing various travel corridors. The scope of work for this project includes the upgrade of traffic signal detection equipment and traffic signal communication equipment at various intersections. The City of Fort Worth (City) will be responsible for the installation of the equipment purchased with the federal funds and for any cost overruns. 1of3 FORT WORM, Staff intends to use existing or subsequently procured purchase agreements to obtain the equipment with installation thereof by City forces or contractors beginning in Fall 2026. The City is responsible for all installation and associated construction activities within the scope of this project. TxDOT will reimburse the City's expenditures pursuant to the AFA. There is no local match for the City. City funds for this project include the construction of the project, and any cost overruns for construction. The City Staff will manage both the design and implementation of the project. No advance payment to TxDOT is required for this project. At the end of the project, the asset will remain with the City. Funding for the grant portion of the project was not included in the Fiscal Years 2026 - 2030 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2026 - 2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. 2 of 3 FORT WORM, The project is located CITYWIDE. This contract will be with a governmental entity, state agency or public institution of higher education. FISCAL INFORMATION/CERTIFICATION The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund. The Transportation & Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Fund Agreement.
