(Engineer) made and entered into City Secretary Contract No. 24148, (the Contract) which was authorized by the City Council by M&C C-16901 on the 28th day of July, 1999; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Mains 207 and 207A Drainage Area Sanitary Sewer System Rehabilitation and Improvements (Group 3, Contract 4), Part 3. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated October 11, 1999, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $11,859.34. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $82,087.34. Per your recommendations, we have re-evaluated the initial amendment request and have modified it in order to address City concerns. We discussed the amendment, and more specifically we talked a6out the M-242R location wi[h Mr. Peter Fu who indicated he had �ome reservations about the work effort associated with this location. He noted to me that he had n discussed this amendment request with anyone at DOE which was my understanding based on � r last phone conversation. Since this project began, several tasks have been performed that exce ded our current scope of work. We are seeking compensation for numerous re-designs that were req ested by City Staff and property owners during easement acquisition that impacted M-242R, ��2260, L2852A, and L-5529. More specifically, we are seeking the acceptance and approval�°of the following items as described in greater detail below: ` Contract Reference: Attachme�zt A-1 to tlte Corttract, Design Services: Final Pipeline and Manhole Rehabilitatio�z (Group A) • Re-desi�ns Associated with M-242R: #M Under the above referenced contract element, WADE p�duced numerous re-designs of M-242R that were required after City Staff requested the examin• tion of several design alignments which included changes to the proposed construction methods,� especially along Roaring Springs Road. We produced [hree designs alonQ Roarin� Springs and [ required the addi[ional survey of over 1,450 LF along the eastside of Roaring Springs. The onstruction methods changed numerous times to reflect review comments and design invest �ations, including open cu[ and pipe enlargement. The iinal design reflects the �Vater Depa ,tment Staff's desire to relay most of M- 242R by open cu[ throu�h the abandonment of a larQe portion of the 12-inch water line located in Roaring Springs. Ultimately, we generated three additional versions of the M-242R alignments reflecting the design stipulations noted above. The additional work included the evaluation of the design changes received from Mr. Rademaker cot�erning property-owner stipulations for Ms. Corcoran and Ms. Graham which included the remo �al of bamboo and rock debris as well as replacing Ms. Graham's wooden fence during easeme� acquisition. Ultimately, we modified our plan sheet to reflect easement stipulations as note� above, as well as moving a proposed manhole. Additionally, we 'produced a couple more'"temporary construction easements that became necessary due to property-owner negotiations. This effort has been completed and the table below reflects the design-related costs incui•red for L-2852A. These impacts resulted in plan modifications of two (2) plans sheets and the devel�pment of a new plan sheet, including construction method changes. Additionally, we eval�Iated two sewer alignments in order to satisfy Mr. Patton's concerns and unwillingness to gr nt an easement as originally proposed. One of the new sewer alignments analyzed required t collection of approximately 120 LF of additional survey information. This effort has been co pleted and the table below reflects the design-related costs incurred on L-2260. Water Department Staff authorized pulling this lateral from the plans in order to build it u�ing the annual city contract so that we could satisfy the property owner's request. After fu'rther consideration of the contractor's performance in the annual contract by the City and th�t the window to build the project was rapidly closing, it was decided by City Staff to put this la eral back into the project plans. During this time, we met with the property-owner on several o casions to coordinate this sewer design and firmly establish a construction schedule. This effort as been completed and the table below reflects the design-related costs incurred for L-5529. PS46-070460410120,��OE NO. 2090 The proposed amendment will reimburse Wade & Associates, Inc., for the additional en- gineering services that will be provided on the project �Ss requested by the City. � Wade is seeking reimbursement for the numerous re esigns of Main M-242R that were conducted before staff finally selected an alignment. he revisions required engineering and surveying services for the following: It was nece�ary to redesign a portion of lateral L-2852A due to the demands of two property owne� from whom easements were re- quired. In addition to engineering services for this r�'ision, it was necessary to prepare additional temporary construction easements. It was aa� so necessary to redesign a portion of lateral L-7260 due to the stipulations of two prop y owners from whom easements were required. The design for the lateral was revisec��twice to satisfy a property owner from whom an easement was required. After initiall�'removing lateral L-5529 �from the project plans, at the request of Shady Oaks Country Club, it was necessary to re-insert the drawings due to construction time constraint. Wade & Associates, Inc., has requested reimburseme' t in the amount of $11,859.34 for the additional survey and design services thereby increasing the contract fee from $70,228.00 to $82,087.34.
