Burleson and Associates, Inc., (Engineer) made and entered into City Secretary Contract No. 23140, (the Contract) which was authorized by the City Council by M&C C-16211 on the 12th day of August, 1997 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering �ervices for the following project: Engineering contract for the design of Main 004 Drainage Area Sanitary Sewer Evaluation Study and Improvements Sanitary Sewer System Rehabilitation and Improvements (Group 7, Contract 2). WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: E� Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated September 27, 1999, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $12,360.00. 2. Article II of the Contract is amended to provide for an increase in the maxi.mum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $239,552.36. Reconstruction of L-23 and L-24 (a.k.a. Daiches Pr'oject) � This project was given to the consuitant as a stand-alo e project near but outside of the drainage area. While FVW1/D personnel originally saic� that the L-231L-24 would be part of the M004 improvements, they soon regarded this as an urgent project which was to be designed on its own with due haste. Although the roject was originally billed under M004 Improvements, it came f�om funds which we subsequently required for the design of the Parts 2 and 3 improvements. :� The 309 �F of sewer were in a very congested area of�downtown requiring attention to special project conditions such as numerous under i round utilities, landscaping and brick pavement considerations in Main Street, and se er lines immediately adjacent to 100-year-old buildings on private property with no eas ments. 2. M-4R. Sta. 21 +46 to Sta. 27+64 In June 1999, when preliminary engineering and lan and profile drawings were substantially complete, F1NWD altered the alignment f the proposed design in order to serve recently announced new development further'�vest on East Bluff Street. The change led to the abandonment of approximately,� 900 LF of lines proposed for rehabilitation and replacement and the addition of �18 LF of sanitary sewer on new alignment. �� � j� In Summary, the requested amendment for additional engineering fees is due to late modifications to the scope of work requested by the FVWVD and due to an additional project performed by the consultant at the request of t e F1NWD. Burle�n & Associates, Inc., for the ad- ditional design services that the firm provided on the pr �ect as requested by the City. � Due to sewer back-up problems on laterals L-23 and L-24 which are located within the Main 4 project areas, the Water Department requested that both laterals be designed and constructed with this project. In addition, due to new development on east Bluff Street, it was necessary to change the alignment of M-4R (whi�h was substantially complete) in order to avoid potential conflict with new facilities insi�e the new development. Ned K. Burleson & Associates, Inc. has submitte a proposal in the amount of $12,360.00 for the additional design services they perf �rmed thereby increasing the con- tract fee from $227,192.36 to $239,552.36.
