WHEREAS, the City of Fort Worth (City) and Ned K. Burleson
and Associates, Inc., (Engineer) made and entered into City
Secretary Contract No. 23140, (the Contract) which was authorized
by the City Council by M&C C-16211 on the 12th day of August, 1997
and subsequently revised by two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Main 004 Drainage Area
Sanitary Sewer Evaluation Study and Improvements Sanitary
Sewer System Rehabilitation and Improvements (Group 7,
Contract 2).

NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated September 27, 1999, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services
to be performed by Engineer total $8,818.40.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $248,370.76.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Rationale for Amendment No. 2
1. Additional Meetinas
This included two additional meetings requested by FWWb personnel during the design stage.
Also, at the request of the FVWVD, due to the complex nature of the project, the consultant
was asked to meet with Real Property Management to outline the project easement
requirements, and to assist the land agent(s) in meetings with affected property owners. This
has to date included meetings with five property owners and/or representatives, extensive
telephone conversations with two others, and a detailed letter of explanation to the attorney
representing one ownership company. Since the majority of easements have not yet been
acquired, it is anticipated that several more meetings will be necessary to complete this task.
2. Railroad and Hi4hwav Permits
The original scope of work anticip�ted three permits at $500 each. Initially, we obtained one
TxDOT permit and two BNSF Railroad permits for new crossings. We were advised by Real
Property that two additional BNSF Railroad permits would be required for abandoning existing
sewers and manholes within the railroad right-of-way. We prepared and submitted these two
additional permits.
3. Construction Services
In order to expedite construction of the sewer line to serve East Bluff Street development,
F1NWD personnel instructed us after preliminary submittal to split the project into Parts 2(with
fewer easements) and 3(with most easements), ta be advertised separately. The additional
costs are associated with additional bid services required due to separate projects.
4. Reproduction Costs
The creation of Part 3 required additional master sheets in each part, for a total of 29 sheets to
be reproduced, four more than originally budgeted. Furthermore, 40 additional sets of specifi-
cations books will also be required for Part 3.
5. Revisions Required to Separate Part 3
Revisions required to separate the project into two parts included:
a. Duplicating and revising cover, layout, abandonment, easements and control sheets;
b. Re-design of L-22R to construct the downstream half in Part 2(required for Part 2
realignments) and the upstream half (with several easements and a possible
condemnation) in Part 3;
c. Revising all title blocks to reflect the appropriate part and unit number.
In Summary, the requested amendment for additional engineering fees is due to modifications
to the scope of work requested by the F1NWD because of pending development in the project
area and because of the complexity of easement issues in the project area.

The proposed amendment will reimburse Ned K. Burleson & Associates, Inc., for the ad-
ditional design services that that the firm provided on the project as requested by the City.
The amendment will reimburse the consultant for the following: a) attending numerous
meetings with Real Property staff and property owners in order to facilitate easement ac-
quisition; b) the preparation of two additional railroad permits for submittal to Burlington
Northern; c) breaking out Part 3 from the project for separate advertisement in order to
expedite construction of a severely deteriorated sewer lateral and d) the additional repro-
duction cost associated with Part 3.
Ned K. Burleson & Associates, Inc. has requested reimbursement in the amount of
$8,818.40 for the additional design services they performed thereby increasing the con-
tract fee from $239,552.36 to $248,370.76. I believe this fee is fair and reasonable for the
additional services that were provided.
Please authorize this additional fee by your signatures on the attached contract amend-
ment form.
