'WHE�2EAS, the State and the. City executed an agreement on the 19`� day of IrTovember. 1996, and entered into an a�reement concerning the improvements under the Con�estion Mitigation and Air Quality Improvement Program; and, '4��EREAS, the maximum �amount of CMAQ funds payable under this agreement without modification is $240,000; and, WHER�AS, TIP Nlodification 99-64 increased the amount of fundino for the project from the original amount o£ $240,000 to $492,000 which was recognized by the execution of Supplemental Aoreement No. 1; and, 'W]�EREA.S, the original percentage fundino for the project was 79%-federal and 21%-local; and, NOW THEREFORE, premises considered, the State and the City agree that said agreement is amended as £ollows: Tn accordance with TIP Modification 99-64, the funding percentages have changed from being 79°/a-federal, 21%-local to the following: 64%-Federal (�31.4,880) 3.9%-State (519,000) 32.1%-Local (S158,120) All other terms and conditions ofthe contract are unchanged and remain in full force and effect. DISCUSSION: On September 17, 1996 (M&C C-15647), the City Council authorized the City Manager to execute a CMAQ Improvement Agreement with TxDOT for intersection improvements on Hulen Street from IH-20 to Barwick Drive. The intersection improvements consist of adding dual left turn lanes on Hulen Street at the intersection of Barwick and Overton Ridge Boulevard to enhance the movement and safety of left turning traffic. As part of the development of the 1999 Transportation Improvement Program, TxDOT approved additional funding necessary for the construction of the CMAQ Improvement Project. This project is located in COUNCIL DISTRICT 3. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Street Improvements Fund.
