WHEREAS, the State and the City executed an agreement on the 8"` day of Auaust. 1995, and entered into an agreement concerning the improvements under the Congestion Mitigation and Air Quality Improvement Program; and, WHEREAS, the maximum amount of funding available under this agreement without modification is $3,200,000; and, WHEREAS, TIP Modification 99-65 increased the amount of funding for the project from the original amount of $3,200,000 to $3,995,000 which was recognized by the execution of Supplemental Agreement No. 1; and, WHEREAS, the original percentage funding for the project was 53%-federal and 47%-local; and, NOW THEREFORE, premises considered, the State and the City agree that said agreement is amended as follows: In accordance with TIP Modification 99-65, the funding percentages have changed from being 53%-federal, 47%-local to the following: 53.4%-Federal ($2,135,000) 8.5%-State ($340,000) 38.1%-Local ($1,520,000) All other terms and conditions of the contract are unchanged and remain in full force and effect. DISCUSSION: On May 9, 1995 (M&C C-14800), the City Council approved a Congestion Mitigation and Air Quality (CMAQ) agreement between the state and the City to improve the intersection of North Beach Street at IH-820. This project will widen Beach Street at IH-820 to a full 6-lane divided section with turn lanes and a traffic signal. During preparation of the engineering design, it was determined that the project should be expanded to provide better traffic flow in the intersection. The state has requested and received an additional $775,000 in federal funds to expand the scope of the project. The City's share for the expanded scope of this project is $20,000. TxDOT estimates that construction of this project will begin in June 2000. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Street Improvements Fund.
