HomeMy WebLinkAbout025556 - Construction-Related - Contract - Wendy Lopez & Associates, Inc.� � AMENDMENT NO. 2 STATE OF TEXAS b CITY SECRETARY CONTRACT NO.� � J Ly��' (No M&C Needed) COUNTY OF TARRANT b WHEREAS, the City of Fort Worth (City) and Wendy Lopez & Associates, Inc., (Engineer) made and entered into City Secretary Contract No. 24775, (the Contract) which was authorized by the City Council by M&C C-17350 on the 30th day of March 1999 and previously revised by one amendment; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Main 21 Drainage Area Sanitary Sewer System Rehabilitation and Improvements (Group 7, Contract 3), Part 3. WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter � dated November 5, 1999, copy of which are both attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $6,441.41. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $100,174.18. 1 �Y Y � V �Y 4l7 �� V�WV �8� ���R ' °� �. No. 2488 WLA Project No. 99008.00 Subject: Railroad Right of Way Permit Fee Design Contract Amendment No. 2 Dear Mr. Sholola: -� This letter relates to the telephone conversation of September 24, 1999, between you and Mr. Yasin of our o�ce and your meeting on October 26, 1999, concerning a meeting Wendy Lopez & Associates, Inc. (WLA) had with Mr. Fred Scott of the Real Property Department of the City of Fort Worth (COFW). Per Mr. Scott, the City of Fort Worth does not have specific funds to pay for the Union Pacific Railroad (UPRR) permit application fee of $1,055 (refer to the attached letter dated August 18, 1999) which is required for installation of the proposed Line "B" on the north side of the Best Maid Products, Inc. property. Per your direction, WLA is to pay for the UPRR permit application fee and the subsequent permit fee (amount undetermined) and COFW will reimburse WLA as part of the Design Contract Amendment No. 2 to WLA's Engineering Consultant Design contract for the referenced project. As part of Amendment 2, WLA has included $1,055 which will be required for the UPRR Application Fee. Contract Amendment No. 2 is presented at your request for scope change and justification that WLA has eVice�ded the amount bedgeted in our original contract for railroad perm�it acquisition e�or�. Scone Change Per Mr. Peter Fu of the City of Fort Worth, WLA is to insert Lateral L-7222 and L-7225 of Drainage Basin M207R Group 5, Contract 3, Part 6 designed by WLA as part of Unit 1 of our M21 design contract. This addition to our contract documents requires that WLA revise all M21 sheet numbers, original plans and specifications, and cover sheet. Exceeded the Budgeted Fee of $3,000 for Railroad Permit WLA has accrued a substantial amount of project management, engineering, uid RPLS time to investigate the BMP and UPRR property ownership and ROW issue. WLA has acquired, prepared, and presented several documents to resolve this issue. The water department requested that WLA prepare plans and specifications for laterals L- 7222 and L-7225 in conjunction with this project. In addition, due to right-of-way coor- dination problems with Union Pacific Railroad and Best Maid Products, Inc. WLA util- ized additional time than originally budgeted on railroad and ROW issues and has re- quested reimbursement for this additional coordination effort. Wendy Lopez & Associates, Inc. has requested a fee of $6,441.41 for the additional services that were provided thereby increasing the contract fee from $93,632.77 to $100,174.18. I believe this fee is fair and reasonable for the additional services to be pro- vided.
