AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND
IN THE AMOUNT OF $1,300,000.00, TRANSFERRED FROM AVAILABLE
PAYGO FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF
FUNDING THE SEWER MAIN PIPE ENLARGEMENT CONTRACT 2026
PROJECT (CITY PROJECT NO. 106717); PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-
2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in
the Water and Sewer Capital Projects Fund in the amount of $1,300,000.00, transferred from available PayGo
funds in the Water and Sewer Fund, for the purpose of funding the Sewer Main Pipe Enlargement Contract
2026 project (City Project No. 106717).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative
or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no
way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

the Fiscal Years 2026-2030 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a contract with William J. Schultz, Inc. dba Circle C Construction Company, in the amount of $1,000,000.00, for 2026
Sewer Main Pipe Enlargement with two optional renewals; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund
in the amount of $1,300,000.00, transferred from available PayGo funds within the Water and Sewer Fund, for the purpose of funding the
Sewer Main Pipe Enlargement Contract 2026 project (City Project No. 106717) to effect a portion of Water's contribution to the Fiscal Years
2026-2030 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize execution of a contract with William J. Schultz, Inc. dba Circle C
Construction Company, in the amount of $1,000,000.00, for the 2026 Sanitary Sewer Pipe Enlargement Contract, with two optional renewals.
The work to be performed under this contract consists of replacing deteriorated sanitary sewer mains by trenchless pipe enlargement methods at
locations where open cut replacement via trenching is not feasible.
The bid documents included a stipulation that the total quantities listed may not reflect actual quantities and that the amount budgeted for the
projects is $1,000,000.00. Final payments will be made based on actual measured quantities. The bid documents also included a stipulation
giving the City the option to renew (subject to appropriated funding) this contract two times under the same terms, conditions and unit prices.
The project was advertised for bid on March 18, 2026, and March 25, 2026, in the Fort Worth Star -Telegram and on April 16, 2026, the following
bid was received:

Staff has reviewed the proposed unit prices and considers them to be fair and reasonable.
Small Business (SB) Goal — William J. Schultz, Inc. dba Circle C Construction Company is a certified small business and is in compliance with the
City's Small Business Ordinance.
In addition to the contract amount, $300,000.00 is required for project management, real property acquisition, material testing and inspection.
It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the Fiscal Year, instead of within
the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants.

The Director of Finance certifies that funds are currently available in the Water & Sewer Fund and upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the Sewer Pipe Enlg. Contract
2026 project to support the execution of the contract. Prior to any expenditures being incurred, the Water Department has the responsibility of
verifying the availability of funds.
