HomeMy WebLinkAbout28530-06-2026 - City Council - OrdinanceORDINANCE NO. 28530-06-2026 AN ORDINANCE AMENDING CHAPTER 19, "LIBRARIES," OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (2015), AS AMENDED, TO REVISE ARTICLE II, SECTION 19-22, "ADVISORY BOARD," TO UPDATE THE RESPONSIBILITIES AND DUTIES OF THE LIBRARY ADVISORY BOARD; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council is authorized to amend the Code of the City of Fort Worth to ensure that library policies reflect current practices and promote access to library resources; WHEREAS, the Fort Worth Public Library seeks to modernize and clarify the duties of the library advisory board to better align with its advisory and advocacy roles; WHEREAS, updating the responsibilities of the advisory board to focus on providing information to the Mayor and City Council about the Library Department will enhance communication and decision -making; WHEREAS, revising the duties of the advisory board to emphasize advocacy for development and publicizing the library's impact will strengthen community support and awareness; and WHEREAS, these changes will promote transparency, accountability, and broader stakeholder involvement in library operations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. Article II, Section 19-22, "Advisory Board," of Chapter 19, "Libraries," of the Code of the City of Fort Worth (2015), as amended, is hereby amended in part by revising subsections (b) and (c) to read as follows: (b) Responsibilities. The advisory board will be responsible for providing �, recommendations and information to the city manager and the city council about citizen needs and requests that will improve the services of the department. (c) Duties. The advisory board shall advocate for the development of facilities, services and Droszrams in accordance with adopted library Plans. The advisory board will help publicize the work. programs and impact of the librarv. The board w44 may review and comment on the annual operating budget and capital improvement requests. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. DISCUSSION: The purpose of this Mayor and Council Communication is for the City Council to consider adopting the attached ordinance amending Article II, Chapter 19-22 "Advisory Board," updating the responsibilities and duties of the Library Advisory Board. Chapter VIII, Section 1 of the City Charter authorizes the City Council to establish by ordinance such departments, divisions, and offices as it deems necessary for the operation of the City's business (in addition to those departments required by the City Charter) and also authorizes the City Council to discontinue any department or office established by ordinance and to prescribe, combine, consolidate, distribute, or abolish the functions and duties of departments, divisions, or offices. Article II, Chapter 19 of the City Code governs the Department of Public Libraries. The ordinance shall be in full force and effect following its adoption. It is the recommendation of the City Manager and the Director of the Library Department that the City Council adopt the attached ordinance to clarify and modernize the responsibilities and duties of the Library Advisory Board to better align with its advisory and advocacy roles. Revising the responsibilities and duties to emphasize advocacy for development and publicizing the library's impact will strengthen community support and awareness, and will promote transparency, accountability and broader stakeholder involvement in library operations. The current version of Section 19-22 provides the responsibilities and duties of the Library Advisory Board to be as follows (b) Responsibilities. The advisory board will be responsible for providing policy recommendations and information to the city manager and the city council about citizen needs and requests that will improve the services of the department. (c) Duties. The advisory board will recommend to the city manager and the city council, plans for development of facilities and services to meet the needs of the city. The board will review and comment on the annual operating budget and capital improvement requests. Recommendations made by the board will be presented to the city manager and the city council for consideration. The attached ordinance will modify this provision to read as follows: (b) Responsibilities. The advisory board will be responsible for providing recommendations and information to the city manager and the city council about citizen needs and requests that will improve the services of the department. (c) Duties. The advisory board shall advocate for the development of facilities, services and programs in accordance with adopted library plans. The advisory board will help publicize the work, programs and impact of the library. The board may review and comment on the annual operating budget and capital improvement requests. This will serve ALL COUNCIL DISTRICTS. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
