UN9913, UN9915, UN9916, UN9917, UN9926, UN9928), FOR THE PURPOSE OF FUNDING THE CERTAIN IDENTIFIED PROJECTS (CITY PROJECT NOS. 103272, 103299, 103271, 104154, 104152); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the cumulative amount of $10,500,000.00, from available transportation impact fees and interest earnings collected within the Revenue — Multiple Service Areas — Transportation Impact Fees projects (City Project Nos. UN9913, UN9915, UN9916, UN9917, UN9926, UN9928), for the purpose of funding the certain identified projects (City Project Nos. 103272, 103299, 103271, 104154, 104152). That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the cumulative amount of $10,500,000.00, from available transportation impact fees and interest earnings collected within Revenue - Mulitple Service Areas - Transportation Impact Fees projects (City Project Nos. UN9913, UN9915, UN9916, UN9917, UN9926, UN9928), for the purpose of funding certain identified projects (City Project Nos. 103272, 103299, 103271, 104154, 104152); and 2. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate eligible Transportation Impact Fee funding to supplement existing funding for transportation infrastructure projects. Due to current market conditions, supply chain issues, and higher inflation rates, additional funds are needed to cover estimated budget shortfalls for arterial projects. Staff proposes using $10,500,000.00 of Transportation Impact Fee funding to complete project activities for the five arterial projects listed in the table below. The Transportation Impact Fee funding will be used for any Transportation Impact Fee eligible expenses incurred by the projects. Due to the continued population growth and increased transportation needs, these projects are considered high -priority improvement projects for the City of Fort Worth's infrastructure. This additional funding will enable the projects to proceed as planned. The action in this M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. Funding is budgeted in the Transportation Impact Fee Cap Fund and the Interest Earnings Fund for the purpose of funding Transportation Impact Fee eligible transportation infrastructure projects. These projects are located in COUNCIL DISTRICTS 2, 7, 8, and 10. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in Revenue- Multiple SA Transportation Impact Fees projects within the Transportation Impact Fee Cap Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Transportation Impact Fee Cap Fund for various transportation infrastructure projects. Prior to an expenditure being incurred, the Development Services Department and the Transportation and Public Works Department have the responsibility of verifying the availability of funds.
