AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE FIRE APPARATUS CAPITAL PROJECT FUND IN
THE AMOUNT OF $802,638.00, TRANSFERRED FROM THE RISK FINANCING
FUND, FOR THE PURPOSE OF FUNDING THE ANNUAL FIRE APPARATUS
REPLACEMENT PROGRAMMABLE PROJECT FOR REPLACING FIRE
ENGINE 8; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
SECTION 1.
In addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in
the Budget of the City Manager, there shall also be an increase in estimated receipts and appropriations in the
Fire Apparatus Capital Project Fund in the amount of $802,638.00, transferred from the Risk Financing Fund,
for the purpose of funding the Annual Fire Apparatus Replacement programmable project for replacing Fire
Engine 8.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
This ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Risk Financing Fund in the amount of
$600,711.00, due to subrogation recovery, for the purpose of transferring to the Fire Apparatus Capital Project Fund for funding the Annual
Fire Apparatus Replacement programmable project for the replacement of Fire Engine 8 (City Project No. P00036);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Fire Apparatus Capital Project Fund in
the amount of $802,638.00, transferred from the Risk Financing Fund, for the purpose of funding the Annual Fire Apparatus Replacement
programmable project for replacing Fire Engine a and
3. Amend the Fiscal Year 2026 Adopted Budget and the Fiscal Years 2026-2030 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to adopt appropriation ordinances for the purpose of transferring funds to the
Fire Apparatus Capital Project Fund for replacing Fire Engine a
On January 30, 2025, at approximately 10:51 a.m., City of Fort Worth Fire Engine 8 was traveling westbound with its lights and sirens activated
when it collided with a northbound vehicle. The collision rendered the apparatus inoperable, and it was deemed a total loss by the insurance
adjuster.
Siddons Martin Emergency Group, LLC is the authorized dealership in Texas, New Mexico, and Louisiana, supporting the Pierce fire apparatus
product line and the sole source for parts and warranty service in this area. Siddons Martin estimated replacement costs at $1,275,000.00.
The insurance company issued a claim payment totaling $600,711.00, which was received and deposited into the Risk Financing Fund on
February 4, 2026. Pursuant to policy, these funds are being transferred from the Risk Financing Fund, where they were originally recorded, to the
Fire Apparatus Capital Project Fund. The policy deductible for Fire Engine 8 of $201,927.00 can be covered in the Risk Financing Fund's
adopted budget, with an appropriation to the Fire Department. The City anticipates utilizing available tax note capacity to fund the remaining
balance of $472,362.00, subject to alignment with the approved issuance parameters and capital program. If necessary, this item will be brought
back to Council for further consideration.
Funding is available for appropriation in the existing budget of the Risk Financing Fund for the purpose of funding the Annual Fire Apparatus
Replacement project for the replacement of Fire Engine 8 (City Project No. P00036). Funding for this project was not included in the Fiscal Year
(FY) 2026-2030 Capital Improvement Program due to unforeseen damages resulting from an accident. The action in this M&C will amend the
FY2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025.
This will serve ALL COUNCIL DISTRICTS.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/ CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Risk Financing Fund, and upon approval of the above recommendations
and adoption of the attached appropriation ordinances, funds will be available in the Fire Apparatus Capital Project Fund for the Annual Fire
Apparatus Replacement programmable project. Prior to an expenditure being incurred, the Fire Department has the responsibility of verifying the
availability of funds.
