HomeMy WebLinkAbout063003-A2 - Construction-Related - Contract - Alliance Geotechnical GroupAMENDMENT No . 2 63003-A2 TO CITY SECRETARY CONTRACT No. WHEREAS, the City of Fort Worth (CITY) and Alliance Geotechnical Group, (CONSULTANT) made and entered into City Secretary Contract No. 63003, (the CONTRACT) which was authorized on the 21st day of March, 2025 WHEREAS, the CONTRACT involves material testing services for the following project: Fort Worth Northwest Patrol Division Facility, CPN 101919; and WHEREAS, it has become necessary to execute Amendment No. two (2) to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and CONSULTANT, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional Material Testing Services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Consultant totals $45,260.00 (See Attached Funding Breakdown Sheet, Page -3-, Attachment A, AGG Proposal) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Consultant for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $122,830.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. (City Secretary Contract No. 63003), for a revised contract value of $122,830.00, for the Police Department Northwest Patrol Division project (City Project No. 101919). DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of an amendment in the amount of $45,260.00, to amend Material Testing Contract with Alliance Geotechnical Group, Inc. (City Secretary Contract No. 63003), for a revised contract value of $122,830.00, for the Police Department (PD) Northwest Patrol Division project (City Project No. 101919). On March 21, 2025, Property Management administratively executed a contract with Alliance Geotechnical Group for $15,115.00 for Phase I civil scope for above referenced project. The contract was administratively amended on July 22, 2025, for an additional $62,455.00 for special inspections, increasing the value to $77,570.00. Amendment No. 2 increases the contract by $45,260.00 for the balance of the work (paving and sidewalk), which exceeds the administrative approval threshold of $100,000.00 and therefore requires Council approval, bringing the total contract value to $122,830.00. In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non -City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived." Infrastructure Plan Review Center (IPRC) Fees and other associated development fees will also be waived for this project. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding is budgeted in the 2022 Bond Program Fund for the Police Department for the purpose of funding the PD Northwest Patrol Division project (City Project No. 101919), as appropriated.
