C" .;2L}$35 WHEREAS, the City of Fort Worth (City) and Carlyle Cypress West 7`h, L.P. (Developer) entered into a Community Facilities Agreement, City Secretary Contract No.40759 ("CFA"); and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to allow City participation in an amount not to exceed $27,846.00 for the City's portion of costs associated with repair, inspection, and material testing of the 8-inch sewer line contemplated by the CFA; and WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the sue' day of , 2011 via M&C NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. The City's portion of inspection and material testing fees are directly allocated to the City's accounts for charges and does not reimburse the Water Inspection and Material Testing Fees to the developer. The City's participation estimate shall be based upon unit prices contained in City of Fort Worth Ordinance No. 19192 (or by public bid). DISCUSSION: The developer Carlyle/Cypress Retail I, L.P., has executed a proposed contract for community facilities to serve a development located in Fort Worth (see attached map). The total construction cost for water and sewer improvements for this development is $75,386.48. There will be City participation for the repair of an eight-inch sewer main in West 7th Street that will improve the service to the surrounding area.
