UN9911, UN9912, UN9913, UN9914, UN9915, UN9916, UN9917, UN9919, UN9920, UN9921, UN9922, UN9923, UN9924, UN9926, UN9927, UN9928, UN9929, UN9937), FOR THE PURPOSE OF FUNDING THE 2027 TRANSPORTATION IMPACT FEE STUDY PROJECT (CITY PROJECT NO. 106900); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the transportation impact fee capital fund in the cumulative amount of $630,000.00 from available transportation impact fee service area collected within the revenue - multiple service areas - transportation impact fees projects (City Project Nos. UN9911, UN9912, UN9913, UN9914, UN9915, UN9916, UN9917, UN9919, UN9920, UN9921, UN9922, UN9923, UN9924, UN9926, UN9927, UN9928, UN9929, UN9937), for the purpose of funding the 2027 transportation impact fee study project (city project No. 106900). SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. This ordinance shall be cumulative of Ordinance No. 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a Professional Services Agreement with Kimley-Horn and Associates, Inc. for the development of the 2027 Transportation Impact Fee Study in an amount up to $800,000.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the cumulative amount of $630,000.00 from available Transportation Impact Fee Service Area collected within the Revenue - Multiple Service areas - Transportation Impact Fees projects (City Project Nos. UN9911, UN9912, UN9913, UN9914, UN9915, UN9916, UN9917, UN9919, UN9920, UN9921, UN9922, UN9923, UN9924, UN9926, UN9927, UN9928, UN9929, UN9937), for the purpose of funding the 2027 Transportation Impact Fee Study project (City Project No. 106900); 3. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the amount of $170,000.00, by increasing the estimated receipts and appropriations in the 2027 Transportation Impact Fee Study project (City Project No. 106900) and decreasing estimated receipts and appropriations in the 2022 Transportation Impact Fee Study project (City Project No. 103427) by the same amount; and 4. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION The purpose of this Mayor and Council Communication is to authorize execution of a Professional Services Agreement with Kimley-Horn and Associates, Inc. for the development of the 2027 Transportation Impact Fee Study in an amount up to $800,000.00. 1of3 FORT WORTH Section 395.052 of the Texas Local Government Code requires the City of Fort Worth (City) to update the Capital Improvement Plan related to Transportation Impact Fees at least every five years to evaluate its current land use assumptions and capital improvement plan in order to reauthorize imposition of the transportation impact fee. Accordingly, On April 1, 2026, a Request for Qualifications (RFQ) for professional engineering services for the 2027 Transportation Impact Fee Study Update was issued by Development Services Department. The project was advertised in the Fort Worth Star -Telegram on April 1, 2026 and April 8, 2026. On April 30, 2026, responses were received, reviewed, and scored by a committee consisting of members from the Development Services and Transportation and Public Works Departments. The 2027 study is the fifth iteration of the Transportation Impact Fee Study since the program was adopted May 13, 2008. The last update was adopted by City Council October 25, 2022. The projected cost for the 2027 study is $800,000.00. The study will be funded equally from 18 of the 19 active transportation impact fee service areas (no transportation impact fee revenue has been generated from the Panther Island Service Area at this time) in an amount of $35,000.00 per service area. In addition to the funding from the service areas, residual funds from the 2022 Transportation Impact Fee Study in the amount of $170,000.00 will be added to the project. The total project cost of $800,000.00 is less than one percent of the total impact fee revenues which, as of March 31, 2026, total $285,499,713.46. The action in this M&C will amend the FY2026-2030 CIP as approved in connection with Ordinance 27979-09-2025. This project is located in ALL COUNCIL DISTRICTS. This contract requires a Form 1295. FISCAL IN FOR MATION/CERTIFICATION The Director of Finance certifies that funds are currently available in the 2022 Trans Impact Fee Study project and various Service Area projects within the Transportation Impact Fee Cap Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the Transportation Impact Fee Cap Fund for the 2027 Trans Impact Fee Study project to support the execution of the agreement.
