The State and Local Government shall be collectively referred to as "the parties" hereinafter. WITNESSETH WHEREAS, the parties executed a contract on 07/12/2022 to effectuate their agreement for safety improvements at the crossing of Riverside Drive and the Trinity Railway Express (TRE)'s track; from 150 feet South of the Railroad (TRE) Crossing to 100 feet North of the Railroad (TRE) Crossing; and, WHEREAS, the parties executed Amendment #1 to the contract on 01/23/2023 to increase Federal funding to 100% from 63% due to project meeting fully funded eligibility federal requirements and decreasing indirect state cost by $177.00 due to fiscal year 2023 new rate of indirect state cost; and, WHEREAS, it has become necessary to amend that contract in order to increase Federal funding for construction due to low bid amount, increase construction direct state costs by $6,850, and decrease indirect state costs by $18,981 due to fiscal year 2026 new rate and calculation method of indirect state costs; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties, the parties do agree as follows: AGREEMENT 1. Attachment B-1, Project Budget, is deleted in its entirety and replaced with Attachment B-2, Project Budget, which is attached to and made a part of this Amendment. The total estimated cost of the Project increased by $231,844.00, from $489,498.00 to $721,342.00, due to the increase of Federal funding for construction because of the low bid amount and the increase of construction direct state costs because of the increased construction funding. Consequences of changing your mind If you elect to receive required notices and disclosures only in paper format, it will slow the speed at which we can complete certain steps in transactions with you and delivering services to you because we will need first to send the required notices or disclosures to you in paper format, and then wait until we receive back from you your acknowledgment of your receipt of such paper notices or disclosures. To indicate to us that you are changing your mind, you must withdraw your consent using the DocuSign 'Withdraw Consent' form on the signing page of your DocuSign account. This will indicate to us that you have withdrawn your consent to receive required notices and disclosures electronically from us and you will no longer be able to use your DocuSign Express user account to receive required notices and consents electronically from us or to sign electronically documents from us. All notices and disclosures will be sent to you electronically Unless you tell us otherwise in accordance with the procedures described herein, we will provide electronically to you through your DocuSign user account all required notices, disclosures, authorizations, acknowledgements, and other documents that are required to be provided or made available to you during the course of our relationship with you. To reduce the chance of you inadvertently not receiving any notice or disclosure, we prefer to provide all of the required notices and disclosures to you by the same method and to the same address that you have given us. Thus, you can receive all the disclosures and notices electronically or in paper format through the paper mail delivery system.
