AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR
THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF
FORT WORTH; PROVIDING FOR FULL-PURPOSE ANNEXATION OF
A CERTAIN 184.378 ACRES, MORE OR LESS, OUT OF LAND SITUATED
IN THE J.D. MORRIS SURVEY, ABSTRACT NUMBER 926, AND
APPROXIMAT�LY 41.696 ACREAS OF ROAD AND RAILWAY RIGHTS-
OF-WAY IN THE J.D. MORRIS SURVEY, ABSTRACT NUMBER 926 AND
THE HEIRS OF FRANCISCO SANCHEZ SURVEY, ABSTRACT NUMBER
2346, CITY OF FORT WORTH E.T.J., PARI�ER COUNTY, TEXAS, BEING
GENERALLY LOCATED AT THE NORTHWEST INTERSECTION OF
INTERSTATE 20 AND FARMER ROAD (FM 2235), (CASE NO. AX-25-006)
WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE
PRESENT CORPORATE BOUNDARY LIMITS OF FORT WORTH,
TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY
PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR
ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR
SEVERABILITY; AND NAMING AN EFFECTIVEVE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Fort Worth ("City") has received a petition in wi•iting fi•om John
Heruy Dean III and Shirley Lawson Dean Foundation (collectively, "Owners"), requesting the full-
purpose annexation of 184.378 acres of land as desci•ibed in Section 1, below (the "Property");
and
WHEREAS, the hereinafter described Propei-ty is in the City's exclusive extraterritorial
jui•isdiction and is adjacent to and adjoins the City; and
WHEREAS, Subchapter C-3 of the Texas Local Government Code permits the City to
annex an area if each owner of land in an area requests the annexation; and
WHEREAS, in accordance with Subchapter C-3 of Chapter 43 of the Texas Local
Government Code, the City section 43.0672 of the Texas Local Government Code, the Owneis
and the City negotiated and entered into a written agreement, City Secretary Contract No.
�'j , foi• the provisions of municipal seivices in the area; and
WHEREAS, the Property abuts 41.696 acres of county roads and railway rights-of-way;
and
WHEREAS, in accordance with Section 43.106 of the Texas Local Government Code, the
City must annex the entire width of the county i�oads and adjacent right-of-way on both sides of
the county road when annexing any portion of territoiy that abuts the county road and adjacent
right-of-way; and

WHEREAS, in accordance with Section 43.1056 of the Texas Local Government Code,
the City may also annex with the Propei•ty the z•ight-of-way of a street, highway alley or other
public way or of a railway line, spur or roadbed that is contiguous to the area being annexed if
written notice is provided to the owner of the right-of-way and no written objection to the
annexation is submitted to the City before the date of the annexation; and
WHEREAS, the City conducted one public hearing at which members of the public who
wished to present testimony or evidence regarding the Municipal Seivice Agreement and Fuii-
Purpose Annexation were given the opportunity to do so, in accordance with the procedural
requirements of Section 43.0673 of the Local Govei•nment Code on. June 23, 2026, at 6:00 p.in.,
at the City Council Chamber;
WHEREAS, the City Council finds and determines that annexation of the Propei-ty
hereinafter described is in the best interest of the citizens of the City of Fort Worth and the owners
and residents of the area.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That all portions of the Property, compi•ising approximately 184.378 acres of land, are
hereby annexed to the City of Fort Worth as a part of the city for all municipal purposes, and the
city limits are extended to include such Property being all that certain land particularly described
below and depicted as on E�ibit "A" attached to and incorporated in this ordinance for all
purposes:
BEING a tract of land situated in the J.D. Morris Survey, Abstract Number 926, City of Fort
Worth E.T.J., Parlcer County, Texas, being ail of that tract of land described by deed to John
Henry Dean III and Shirley Lawson Dean Foundation, recorded in Instrument Number
202507813, County Records, Parker County, Texas, and being more particularly described as
follows:
BEGINNING at the most easterly southeast corner of said Dean Foundation tract and being the
north end of corner clip at the intersection of the west right-of-way line of F.M. 3325 (a var•iable
width right-of-way, also known as Farmer Road) and the north right-of-way line of Interstate
Highway 20 (a variable width right-of-way);
THENCE S 44°13'38"W, 104.98 feet, to the most southerly southeast corner of said Dean
Foundation tract and the south end of said coY•ner clip;
THENCE with said north right-of-way line, the following bearings and distances:
S 89°26'48"W, 143.13 feet;
S 87° 17' 16"W, 195.04 feet;
S 88°47'38"W, 303.51 feet;

THENCE N 00°41'24"W, 2865.24 feet, with the east line of said Boswell tract, to the northwest
corner of said Dean Foundation tract and the southwest corner of that ti•act of land described by
deed to Geo Beggs Aledo Ranch, LP, recorded in Instrument Number 202043651, said County
Recoz•ds;
THENCE N 89°25'09"E, 2680.56 feet, to the northeast corner of said Dean Foundation tract and
the southeast corner of said Beggs tract, and being in the aforementioned west right-of-way line
of F.M. 3325 (Farmer Road);
THENCE with said west right-of-way line, the following courses and distances:
S Ol°03'30"E, 1028.07 feet, to the beginning of a curve to the left;
With said curve to the left, an arc distance of 275.45 feet, through a central angle of
O 1°22' 12", having a radius of 11519.16 feet, the long chord which bears S O 1°44'04"E,
275.44 feet;
S 02°25'21'B, 901.27 feet, to the beginning of a curve to the right;
With said cuz•ve to the right, an arc distance of 344.93 feet, through a central angle of
O 1°44'O 1", having a radius of 11399.16 feet, the long chord which bears S O 1°33' 14'B,
344.92 feet;
THENCE S 00°41'11"E, 370.73 feet, to the Point of Beginning and containing 8,031,527
square feet or 184.378 acres of land more or less.

and is not to be used to convey or establish interests in real property except those rights
and interests implied or established by the creation or reconfiguration of the boundazy of
the political subdivision for which it was prepar•ed.

SECTION 2.
The above, described territory is shown on Map Exhibit A attached hereto and expressiy
incorporated herein by reference for the purpose of depicting the location of the hereinabove
described territory.
SECTION 3.
That all portions of the roads and railway rights-of-way, collectively comprising
approximately 41.696 acres of land, are hereby annexed to the City of For-t Worth as a part of the
city for all municipal purposes, and the city limits are extended to include such roads and railway
rights-of-way being all that certain land particularly described below and depicted as on Exhibits
"B" and "C" attached to and incorporated in this ordinance for ali purposes.
SECTION 4.
That the above descr•ibed ten•itoty in sections 1 through 3 are hereby annexed shaii be paz�t
of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of
the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shail be entitled to
all of the rights and privileges of ali the citizens in accordance with the Municipal Services
Agreement and shall be bound by the acts, ordinances, resolutions and regulations of the City of
Fort Worth, Texas.
SECTION 5.
That the Municipal Services Agreement attached hereto as E�ibit "D" is approved and
incorporated into this ordinance for all purposes.
SECTION 6.
This ordinance amends every prior ordinance in conflict herewith, but as to ail other
ordinances oi• sections of ordinances not in direct conflict, this ordinance shall be, and the same is
hereby made curnulative.
SECTION 7.
It is hereby declared to be the intent of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this ordinance of any
unconstitutional pluase, ciause, sentence, paragraph or section.

SECTION 8.
The City Council hereby declares it to be its purpose to annex to the City of Fort Worth
every part of the area described in Sections 1 through 3 of this ordinance, regardless of whether
any part of such described area is hereby not effectively annexed to the City. Should this ordinance
for any reason be ineffective as to any part or parts of the area hereby annexed to the City of Fort
Worth for fuli purposes, the ineffectiveness of this ordinance as to any such part or parts shall not
affect the effectiveness of this ordinance as to the remainder of such area.
SECTION 9.
This ordinance shall be in full force and effect upon adoption.

COMPREHENSIVE PLAN CONSISTENCY
Comprehensive Plan Alignment:
Staff have evaluated the proposal and identified the following areas of consistency and concern regarding the
site's long-term development:
The location of General Commercial and Urban Residential development along the I-20 corridor at this major
intersection makes appropriate use of the visibility and highway access of the site. However, the inclusion of
High Intensity Mixed-Use as a major component of the project site aligns more fully with the City's
Comprehensive Plan goals of creating mixed-use centers and compact, walkable districts. A commercial node with
a significant Mixed-Use component in this location is highly appropriate due to its high visibility along I-20 and
the approved commercial zoning adjacent to the subject property in the neighboring Walsh Ranch development.
Staff have significant concerns regarding the "I" Light Industrial component, particularly if the applicant pursues
a fully data center-centric development scenario. A data center or other industrial layout is generally inwardly
focused and not intended for pedestrian activity and activation, which undermines the activity center's
walkability, compatibility, and long-term development intensity.
Economic Impact
While a data center may offer a high property tax yield potential due to its significant business personal property
value, it creates low-performing community economic potential for this specific strategic location. In addition to
potential rapidly depreciating server equipment, Staff cannot confirm it as a primary economic driver due to its
limited job growth, total absence of sales-tax generation, and lack of complementary uses or pedestrian activation.
The annexation aligns with the following Comprehensive Plan policies:
• Identify and designate on future land use maps regional and community mixed-use growth centers in
rapidly developing areas, based on proximity to future rail transit and key transportation intersections.
• Evaluate and revise zoning and land use regulations to allow and encourage dense mixed-use
development (office, hotel, retail/restaurant, and residential) along key corridors radiating out from
downtown Fort Worth.
• Promote sustainable development patterns that include greater density at appropriate locations,
mixed-use development, public transit, park-and-ride facilities, and access management (e.g.
encouraging shared driveways and limiting the number of curb cuts) to reduce vehicle trips.
• Promote fiscally sustainable growth on the periphery of the city by encouraging development adjacent
to existing adequate infrastructure and discouraging leapfrog development.
• Diversify the City's tax base by encouraging the development of industrial, commercial, and office
uses that provide high-quality jobs.
Land Use Recommendation:
The adopted 2023 Comprehensive Plan Future Land Use (FLU) Map designates the 183-acre annexation area as
General Commercial, Suburban Residential, and Medium Density Residential. Based on the proposed zoning
designations, staff propose an amendment to the Future Land Use Map to change portions from General
Commercial, Suburban Residential, and Medium Density Residential to General Commercial, Light Industrial,
and High Intensity Mixed-Use. Both the current FLU Map and the recommended FLU Amendment Map are
shown below. City staff support the Recommended Future Land Use Map, and the implementing FLU Map
amendment if the annexation is approved. The City Plan Commission reviewed the annexation proposal and
Future Land Use Map and voted to make the following recommendation to the City Council.

location and lane miles of any public streets, it must be assumed for the purposes of this analysis that only
private streets will be included in the annexation area.
This fiscal impact analysis relies on the site and proposed development data provided with the annexation
application. Without this important data being included with the application, actual future fiscal impacts to the
City may be very different from what is described in this report.
Due to the lack of any detailed concept plan, preliminary plat, or site plan being provided by the applicant for
the Dean North Annexation application, City staff propose to review such materials when provided to the City
for the purpose of updating this Fiscal Impact Analysis to determine if the impact becomes a net negative when
such information is considered.
Based on the limited information provided by the applicant, a positive fiscal impact of the proposed annexation
can be reasonably anticipated with General Commercial, High Intensity Mixed-Use, and Light Industrial
development. In addition, based on these land uses, the annexation aligns with departmental goals and
Comprehensive Plan policies. Therefore, City staff recommend that AX-25-006 be considered for annexation
at this time. Furthermore, staff recommend that the above amendments be adopted to the Comprehensive
Plan's Future Land Use Map.

RECOMMENDATION
It is recommended that the City Council:
1. Conduct a public hearing for the proposed owner-initiated annexation of
approximately 184.378 acres of land and approximately 41.696 acres of Interstate 20, in
Parker County, known as Dean North, located west of Farmer Road and north of
Interstate 20, as shown on Exhibit A;
2. Authorize execution of a municipal services agreement between the City of Fort Worth
and property owner, John Henry Dean III and Shirley Lawson Dean Foundation; and
3. Adopt an ordinance annexing AX-25-006 for full purposes.
DISCUSSION
The purpose of this Mayor and Council Communication (M�C� is to conduct a public hearing
for the proposed owner-initiated annexation of approximately 184.378 acres of land and
approximately 41.696 acres of Interstate 20, in Parker County, known as Dean North, located
west of Farmer Road and north of Interstate 20, as shown on Exhibit A, to authorize the
execution of a Municipal Services Agreement between the City of Fort Worth (City� and the
property owner, John Henry Dean III and Shirley Lawson Dean Foundation and to adopt an
ordinance annexing AX-25-006 for full purposes.
On December 17, 2025, representatives for the property owner, John Henry Dean III and Shirley
Lawson Dean Foundation, submitted a request for full-purpose annexation of the property
shown on Exhibit A into the City. The subject property is located entirely in that portion of the
City's extraterritorial jurisdiction, which is in Parker County. The site is located west of Farmer

Road and north of Interstate 20. The owner-initiated annexation, which is approximately
184.378 acres of land and includes approximately 41.696 acres of Interstate 20, is consistent
with the urban development annexation criteria as established by the City's Annexation
Policy.
The subject area is currently agricultural and vacant land. The property owner proposes the
land use for the site to be developed for commercial, industrial, and residential. The future
land use map in the 2023 Comprehensive Plan designates the property as "Suburban
Residential", "General Commercial", and "Medium Density Residential". Per Subdivision
Ordinance, Section 31-2(b) (1), the City Plan Commission is required to study and make a
recommendation on proposals for voluntary annexations that are inconsistent with the
Comprehensive Plan. On March 12, 2026, the City Plan Commission voted seven to three in
favor for a recommendation of approval to City Council for the Dean North Annexation
application (AX-25-006�, which is inconsistent with the adopted Comprehensive Plan.
On May 13, 2026, the related zoning case (ZC-26-042� was heard by the Zoning Commission.
The commission voted to recommend approval of the zoning request. The requested zoning
is as follows: "Tract 1" (60.023 ac.) "G" Intensive Commercial; "Tract "2 (124.365 ac.� "PD"
Planned Development for all uses in "G" Intensive Commercial, "I" Light Industrial, "R1" Zero Lot
Line/Cluster, "R2" Townhouse/Cluster, "UR" Urban Residential, "D" High Density Multifamily with
a maximum of 2,000 multifamily dwelling units, excluding "A-5" One-Family Residential
development, permanent asphalt or concrete batch plant, data center. Including
development standards for multifamily uses to have a maximum of 48-feet within 250-feet
of one-family uses, light industrial fences, walls, screening fences and railings allowed on or
near property line, chain link fencing not permitted in Tract 2. Multi-Family development
�MFD� site plan waiver requested and PD site plan required. The zoning case for the property
is on June 23, 2026, City Council agenda for consideration.
The site is not currently in the City's Certificate of Convenience and Necessity (CCN) nor is it
in another Utility. This site is included in the City's 20-year Planned Service Area.
Subchapter C-3 of Chapter 43 of the Texas Local Government Code (LGC) provides for the
process of annexation of an area upon the request of an owner of land. Section 43.0672 of the
LGC requires a municipality that elects to annex an area upon the request of an owner first
negotiate and enter into a written agreement with the owners of land in the area for the
provision of municipal services.
The agreement must include:
1. A list of each service the municipality will provide on the effective date of the
annexation; and
2. A schedule that includes the period within which the municipality will provide each
service that is not provided on the effective date of the annexation.

The municipal services agreement includes these provisions in accordance with state law.
Emergency services will be provided through the City. The City's Fire Department will provide
emergency and fire protection services comparable with the provision of services available in
other parts of the municipality with topography, land use and population density similar to
the level of service contemplated or projected in the area. The City will also provide operation
and maintenance of water and wastewater facilities; roads and streets, including road and
street lighting; and of any other publicly owned facility, building, or service in the annexed
area.
The proposed uses were considered while assessing the financial impact on the General
Fund. The city tax revenue is expected to have a positive fiscal impact over the next 10 years
after the proposed development has been built. Based on the operating costs projected by
the Police, Fire, Code Compliance, Parks and Recreation, and Transportation and Public Works
Departments, the fiscal impact shows that the City is expected to make a return on public
investment by the first year and a positive impact will continue thereafter. Due to the area
meeting the City's annexation criteria and the positive fiscal impact over the next 10 years,
staff recommends approval of the requested owner-initiated annexation, AX-25-006.
Section 43.0673 in Subchapter C-3 of Chapter 43 of the Texas Local Government Code (LGC),
requires a municipality that elects to annex an area upon the request of an owner to provide
notice of public hearings on the proposed annexation. Notice was posted on the City of Fort
Worth Annexation webpage on Friday, May 22, 2026, and was published in the Fort Worth
Star-Telegram on Friday, June 12, 2026. Additional notices were sent certified mail to public
entities to include Parker County and Tarrant County Appraisal Districts, Emergency Services
District No. 1, Parker County Judge, Aledo Independent School District and public utilities.
The City Council will conduct a public hearing on the proposed annexation. The public
hearing provides for persons interested in the annexation the opportunity to be heard. After
the City Council has conducted the one required public hearing, the Council may close the
hearing and vote on authorizing the City Manager to execute the Municipal Services
Agreement between the City and property owner and to adopt an ordinance annexing this
property.
Upon approval of the annexation request, the property will become part of COUNCIL DISTRICT
3.
This contract requires a Form 1295.
FISCAL INFORMATION%CERTIFICATION
The Director of Finance certifies that based upon approval of the above recommendations
and adoption of the attached ordinance, the annexation will have a long-term positive
impact on the General Fund.
