CONTRACT MODIFICATION REQUEST 15 WATER Village Creek Wastewater Treatment Plant Secondary Area Rehabilitation and Modifications City of Fort Worth, Texas Date: February 24, 2012 P275- Secondary Area and Rehabilitation and 70130 Project: Modifications Project No.: 0128980 Recipient: City of Fort Worth Subject: AB 12 & 13 Air Valve Rotation Contractor: Archer Western Contractors, Ltd. Engineer Carollo Engineers Contract Mod. No.: CMR 15 CMR 15 includes the cost of rotating the air release valve, so that the valve actuators are accessible to the plant staff. This is a CMR associated with Field Order 3 (see attached). Detailed cost breakdown for the construction work are attached with this document. Carollo Engineers and Archer Western Contractors, Ltd. acknowledge that the work shown in the referenced Contract Modification Request 15 (CMR 15) represents work items not included in the original bid and changes the as-bid price of work items that were included in the original bid. The nature of the change is adequately described in the justification provided with the CMR. The Contractor's contract modification proposal has been reviewed by the Engineer, and the Engineer has certified that there is incremental cost and is reasonable to accept "as-is." The Engineer has therefore recommended to City of Fort Worth to approve the CMR 15. The need for this work was discovered during construction of related work items. Therefore, consideration of procuring this work by any means other than by Contract Modification was neither practical nor desirable. Procurement of this item by Contract Modification to this contract is justified in that the work is directly related to and intermingled with other work, which was included in the original procurement by public bid. If the spall was not located at the steel beam to concrete connection, I would likely let it slide. However, its at a critical location and should be addressed now. The deficiency was not observed with the original grating system in place but was visible from the top side during our walkthrough. It is a relatively minor repair that I think will be in the$3k range. We can ask for pricing before authorizing them to proceed. We felt it important to point out so the City can determine whether to repair now or in the future. As a reminder, CO No.5 is still a substantial credit of bid item B-9 for discretionary concrete repair, and if the City elects to make this repair by using some of the money from that bid item on CO no. 5, 1 believe there would still be a net credit on the change order. I will leave it to Chris to provide opinion/assessment on how critical or urgent this repair is, but in light of the status of CO 5,the City may consider getting a price from the contractor based on bid item B-9.
