HomeMy WebLinkAbout28560-06-2026 - City Council - OrdinanceCITY OF CROUVLEY ORDII�AI�CE fVO. 05�2026�593 CITY OF FORT VUORTH ORDI�IAIVCE �10. -` �� ��l� �- ��� a�� JOINT ORDIi�ANCE AND �OU�IDARY AGREEMENT �IIIHEREAS, the City of Fort Worth and the City of Crowley have received a requ�st by Braum's, Inc, for a boundary adjustment to accommodate construcfiion of a new store on a site currently located within the City of Fort Worth city limits and City of Crowley city limits; and WHEREAS, the City of Fort Worth (hereinafter called "FORT WORTH") is a home-rule city located in Tarranfi, Wise, Parl<er, Johnson and Denton Counti�s; and WHEREAS, the City of Crowley (hereinafter called "CROWLEY") is a home-rule city located in Tarrant and Johnson Counties; and WHEREAS, FORT WORTH and CROWLEY share a common boundary; and WHEREAS, FORT WORTH and CROWLEY now desire to adjust the boundary between the two cities to promote orderly development to insure public safety and effective delivery of municipal services; and WHEREAS, Section 43.015 of the Texas Local Government Code authorizes adjacent municipalities to malce mutually agreeable changes to their boundaries that are less than 1,000 feet in width; and WHEREAS, Section 43.142 of the Texas Local Government Code allows a home-rule municipality to disannex areas in the municipality in accordance with the rules as may be provided by its City Charter; tVOW, THEREFORE, BE IT ORDi41NED AND MUTU�4LLY �►GREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE CITY OF CROWLEY: Section 1 Pursuant to Section 43.015 of the Texas Local Government Code, FORT WORTH and CROWLEY hereby agree that the boundary between the cities will be adjusted as set out herein so that 0.167- acres of land located in the John Steele Survey Abstract Number 1381 in the FORT WORTH city limits, as described and shown in Exhibit "A", and with a width of less than 1,000 feet, will be located in the city limits of CROWLEY. In accordance with this Joint Ordinance and Boundary Agreement, FORT WORTH hereby relinquishes the 0.167 acres described in Exhibit "A" to CROWLEY and disannexes and discontinues such property as part of FORT WORTH city limits. In accordance with the terms of this Joint Ordinance and Boundary Agreement, the City of Crowley accepts and annexes 0.167 acres into its city limits as reflected in Exhibit "A" attached and incorporated herein. - __ •� - This ordinance shall be cumulative of all provisions of the ordinances of the City of Crowley and the City of Fort Worth, except where the provisions of this ordinance are in direct conflict with fihe provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. �`�x��C�7i,�i. It is hereby declared to be the intenfiion of the City Councils of FORT WORTH and CROWLEY that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or secfiion of this ordinance shall be declared unconstitutional by the valid judgment or decree of any cour� of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of fihis ordinance, since the same would have been enacted without the incorporation in fihis ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. � . _ •° � The City of Crowley and the City of Fort Worth do hereby covenant and agree to protect, preserve and defend the herein described boundary adjustrnent. SECTION 5 The City of Crowley and the City of Fort Worth agree and ordain that the adoption by both cities of this Joint Ordinance and Boundary Agreement, and the boundary change resulting �From this Agreement do not mitigate, diminish or lessen in any way the rights that either party may have, at law or in equity, to challenge or contest any other annexations, attempted annexations or extraterritorial jurisdiction claims made by the other party. Approve the attached Joint Ordinance and Boundary Agreement between the Cities of Fort Worth and Crowley to transfer 0.167 Acres of Land on FM 1187, east of East Main Street, from Fort Worth to Crowley; and 2. Authorize the Mayor to execute the attached Joint Ordinance and Boundary Agreement. DISCUSSION: During autumn of 2025, Rachel Roberts, Planning and Development Director for the City of Crowley, contacted staff and requested a meeting to discuss a boundary adjustment between the City of Fort Worth and the City of Crowley on the behalf of a property owner developing a property in Crowley. The property is located east of Main Street, north of Farm to Market Road (FM) 1187 (Rendon Crowley Road) and west of Union Pacific Railroad. The property owner is proposing a commercial development for a Braum's Ice Cream & Dairy Store at this property, as shown in Exhibit A. The proposed development spans both Fort Worth and Crowley city limits. The property owner desires for the entire site of a proposed restaurant to be located within one municipal jurisdiction. As such, the City of Crowley is requesting a boundary adjustment to bring one commercial lot located adjacent to the northeast corner of FM 1187 (Rendon Crowley Road) and Main Street from Fort Worth city limits into Crowley city limits. In 2021, the two cities approved a boundary adjustment to realign their city limits, placing the larger parcel which is the site of the proposed building within Crowley city limits. This development will be getting water/wastewater service from the City of Crowley. The 0.167 acre parcel that is the subject of this proposed boundary adjustment is part of a drive lane and Public Access Easement (PAE) to access the property. The City of Fort Worth does not receive taxable value from parking lots or PAEs that serve facilities outside of the Fort Worth city limits. In the interest of promoting orderly development, it is recommended by staff that this parcel also be wholly within the City of Crowley. The proposed Braum's site is adjacent to FM 1187, which is included in the Master Thoroughfare Plan (MTP) . This roadway is classified on the MTP as a Commercial Connector, three-lane, no special facility, standard non-traversable median, no parking, off-street side path, 130-foot-wide facility [CCO-L3-TO-NTMS-PO-BOP (130)]. There will not be right-of-way dedication required from Fort Worth. It is a Texas Department of Transportation (TxDOT) managed roadway and TxDOT may still require public improvements. The Texas Local Government Code, Chapter 43.015, authorizes adjacent municipalities to make mutually agreeable changes in their boundaries for areas that are less than 1,000 feet in width. The purpose of these changes in boundaries is to promote orderly development, public safety and effective delivery of municipal services. If the City Council approves the proposed boundary adjustment, the ordinance will be executed between the Cities of Fort Worth and Crowley. The proposed boundary adjustment is located within Fort Worth city limits and is part of COUNCIL DISTRICT 6. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
