3.1. Section 551.071, CONSULTATION WITH ATTORNEY
3.1.1 To seek the advice of its attorney about pending or contemplated litigation,
settlement offers, or any matter in which the duty of the attorney to the City
Council under the Texas Disciplinary Rules of Professional Conduct of the State
Bar of Texas clearly conflicts with the Texas Open Meetings Act. [Tex. Govt. Code
§551.071]:
a. Legal issues concerning Cause Number 236-358398-24; City of Fort Worth v.
Texas Garden Club in the 236th Judicial District Court, Tarrant County, Texas;
and,
b. Legal issues concerning any item listed on today’s posted city council
agendas.
4.1. Section 551.072, DELIBERATIONS REGARDING REAL PROPERTY
4.1.1. Deliberate the purchase, sale, lease or value of real property where
deliberation in an open meeting would have a detrimental effect on the
position of the City in negotiations with a third party.
4.2. Section 551.087, DELIBERATIONS REGARDING ECONOMIC DEVELOPMENT
NEGOTIATIONS
4.2.1. Deliberate the commercial or financial information or the offer of a
financial or other incentive to a business prospect.
4.3. Section 551.076 and Section 551.089, DELIBERATIONS REGARDING SECURITY
4.3.1. Deliberate certain security matters in accordance with Sections 551.076
and 551.089 of the Texas Government Code.

physically present and presiding over the meeting. Members of the City Council may be
participating remotely in compliance with the Texas Open Meetings Act and the Council Rules
of Procedure.
