HomeMy WebLinkAbout26-28616 - City Council - OrdinanceORDINANCE NO. 26-28616 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORMWATER CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE 2022 BOND YEAR 3 — CONTRACT 14 PROJECT (CITY PROJECT NO. 104315) IN THE AMOUNT OF $450,000.00, AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORMDRAIN PIPE REHAB PROGRAMMABLE PROJECT (CITY PROJECT NO. P00114) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-09-2025, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Stormwater Capital Projects Fund, by increasing estimated receipts and appropriations in the 2022 Bond Year 3 — Contract 14 project (City Project No. 104315) in the amount of $450,000.00, and decreasing estimated receipts and appropriations in the Stormdrain Pipe Rehab programmable project (City Project No. P00114) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of Change Order No. 3 in the amount of $386,896.25 and the addition of 75 calendar days to City Secretary Contract No. 63609 with Stabile & Winn, Inc. for the 2022 Bond Year 3 - Contract 14 project (City Project No. 104315) for a revised contract amount of $10,193,602.75; 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund, by increasing estimated receipts and appropriations in the 2022 Bond Year 3 - Contract 14 project (City Project No. 104315) in the amount of $450,000.00, and decreasing estimated receipts and appropriations in the Stormdrain Pipe Rehab programmable project (City Project No. P00114) by the same amount; and 3. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Change Order No. 3 in the amount of $386,896.25, and the addition of 75 calendar days to City Secretary Contract No. 63609. On June 24, 2025, M&C 25-0590 awarded the City Secretary Contract No. 63609 in the amount of $9,802,228.50 to Stabile & Winn, Inc., for the construction of the 2022 Bond Year 3 - Contract 14 project (City Project No. 104315). Two subsequent change orders revised the contract. Change Order No. 1, in the amount of $4,478.00 and an additional 15 calendar days (administratively authorized December 4, 2025) added new pay items for the realignment and extension of the sanitary sewer line on Race Street to capture existing service and provided for the substitution of polyvinyl chloride (PVC) sanitary sewer services with ductile iron pipe (DIP) sewer services on West Beach 1of4 FORT WORTH Street. Change Order No. 2, in an amount of net zero dollars (administratively authorized February 8, 2026), provided an additional 5 calendar days and added items to replace the planned lime stabilization with cement stabilization due to laboratory testing that identified a plasticity index lower than that required by city standards for lime on Fairview Street and Karnes Street. This Change Order No. 3 will add new pay items for the installation of new stormwater pipe and inlet improvements at Watson Street and Meadowbrook Drive intersection, abandonment of existing damaged stormwater pipes, and associated pavement restoration required for the new stormwater pipe alignment. This change order will include new pay items for the replacement of damaged stormwater pipe and inlets at Anna Street and Lancaster Avenue intersection, discovered during street excavation. This change order will also include new pay items for the relocation of an existing chain link fence on Watson Street to accommodate the sidewalk installation, as well as replace an existing guardrail and concrete riprap in conflict with the proposed curb and gutter improvements at Race Street and Beach Street intersection. This change order provides the necessary funding to cover the cost associated with this additional scope of work. Transportation and Public Works' paving share of the change order is $26,548.75, and Stormwater's share is $360,347.50. In addition, $89,652.50 is being appropriated to cover contingency, project management, inspection, and material testing for the added Stormwater scope. Staff recommends the use of the project contingency, already appropriated in the project, to fund the paving portion of this change order. Staff has reviewed and verified the quantities for the additional work under this Change Order No. 3. Additionally, to complete the work, the contract will be extended by 75 calendar days. Additional funding in the amount of $450,000.00 is required to advance the extra work required by Change Order. The action in this M&C will amend the FY2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). This project is located in COUNCIL DISTRICTS 8 and 11. This contract requires a Form 1295. FISCAL IN FOR MATION/CERTIFICATION The Director of Finance certifies that funds are available in the Stormdrain Pipe Rehab programmable project within the Stormwater Capital Projects Fund and in the 2022 Bond Year 3 - Contract 14 project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Stormwater Capital Projects Fund and the 2022 Bond Program Fund for the 2022 Bond Year 3- Contract 14 project to support the above recommendations and execution of the change order.
