HomeMy WebLinkAbout061583-A1 - Construction-Related - Contract - Halff Associates, Inc.CSC No. 61583-A1 AMENDMENT No.1 TO CITY SECRETARY CONTRACT No. 61583 WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 61583, (the CONTRACT) which was executed administratively on the 11th day of June 2024 in the amount up to $ 99,650.00; and WHEREAS, the CONTRACT involves professional services for the following project: Repetitive Loss Area Analysis Update 2024, CPN 105356; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee which was authorized by M&C 26-0545 on the 23rd day of June 2026 in the amount of $ 49,880.00; NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional professional services specified in proposal attached hereto and incorporated herein. The cost to City for the additional professional services to be performed by Engineer totals $ 49,880.00. (See Attached Funding Breakdown Sheet, Page -3-) PA Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of up to $ 149,530.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Under this scope, "ENGINEER" is expanded to include any sub -consultant, including surveyor, employed or contracted by the ENGINEER. In June 2024, the CITY engaged the ENGINEER to assist with the update to its Repetitive Loss Area Analysis (RLAA). FEMA recently provided the CITY with updated flood claims data that included two (2) new repetitive loss areas (RLAs) that need to be incorporated into the 2025 Draft RLAA Report. Additionally, the CITY has identified legacy repetitive loss properties previously removed from the FEMA repetitive loss list that have been added back to the FEMA list. These properties need to be investigated to confirm if they meet the repetitive loss definition or should be removed using the required FEMA form. OBJECTIVE The primary objective of this contract is to utilize the experience and knowledge of the ENGINEER to assist the CITY with activities needed to incorporate the two (2) new additional repetitive loss properties in the RLAA and with the preparation of forms to remove specific properties from FEMA's repetitive loss list, as appropriate. WORK TO BE PERFORMED RLAA Expansion ENGINEER will manage the work outlined in this scope to ensure efficient and effective use of ENGINEER's and CITY's time and resources. ENGINEER will manage change, communicate effectively, coordinate internally and externally as needed, and proactively address issues with the CITY's Project Manager and others as necessary to make progress on the work. The following is the anticipated scope to be completed by the ENGINEER depending on schedule and budget. Task 1. Project Organization and Scheduling 1.1. Schedule and host one virtual Kickoff Meeting with CITY staff to discuss project deliverables and basic schedule. 1.2. Schedule and host up to 6 virtual check -in meetings with CITY staff. (July through December 2026) Prepare meeting notes. 1.3. Prepare project status updates to accompany monthly invoices. 1.4. Coordinate with and respond to CITY staff throughout project. Data Collection a. The CITY recently received the current repetitive loss properties from FEMA and will provide that information to Halff. i. Check the repetitive loss properties to confirm that all properties listed are located within the CITY. ii. If there are incorrect properties listed, develop a list of properties identified. Prepare the appropriate information required in the FEMA form for up to 26 properties to request FEMA removal of incorrect properties. The CITY will populate, sign, and submit the FEMA form(s). 2.2. Repetitive Loss Areas Map and Property List a. Update the 2026 repetitive loss map areas for the current repetitive loss data to include the two (2) new rep loss properties. Map updates will follow the Privacy Act of 1974. i. Current repetitive loss data will be compared to the draft 2025 RLAA geographic database that Halff prepared. ii. Adjustments will include updates to the existing repetitive loss structures and adding the two (2) additional repetitive loss areas needed based on current FEMA loss data. b. Prepare a list of repetitive loss addresses from the repetitive loss areas from the map that can be used to notify owners. 2.3. RLA Property Owner Notification a. Identify information needed to expand the 2025 online survey to include the two (2) new RLAs. b. Revise the 2025 notification letter to be sent to addresses within the two (2) new repetitive loss areas that informs residents of site visits and online survey. CITY sends the notification letters to the two (2) new RLAs. c. Review and summarize survey responses for inclusion in the plan. 2.4. Site Visits and Data Collection a. Perform a desktop analysis of historical flood insurance claims, review existing storm drain infrastructure, available topographic contours, FEMA floodplains, and areas of potential high-water areas for the two (2) new RLAs. b. Use the online survey to gather information on types of properties, historical flooding issues, and flood protection measures taken by property owners for the two (2) new RLAs. c. Perform a windshield survey of addresses in the two (2) new RLAs using the FEMA National Flood Mitigation Data Collection Tool (limited data view). Prepare individual RLA reports for each property within the two (2) new RI -As for inclusion in the RLAA report. 2.5. Review and Update Potential Mitigation Measures a. Review existing mitigation measures for the two (2) new RI -As with CITY staff. Adjust potential mitigation measures, as appropriate. 2.6. Document Findings a. Update and revise the recommended actions plan for the two (2) new RLAs based on feasibility and cost. Each repetitive loss area will have a separate analysis and summary report. b. Combine recommended action plans for the two (2) new RI -As into the 2025 draft RLAA Report. 2.7. Update the 2025 draft RLAA to include the two (2) new RI -As, as well as Tasks 2.1 through 2.5 specified within this scope of work. Submit draft report to CITY for one (1) round of review and comment. Address CITY comments to create the revised draft report. 2.8. Coordinate with CITY for CITY to make available the revised draft report (with private information redacted) to owners of properties in the repetitive loss areas for review and comment. Public comments and revisions will be incorporated into the final report, as appropriate. 2.9. Address CITY and public comments. Submit final report to CITY for adoption. Assumptions • CITY will provide recent FEMA repetitive loss information. • CITY will complete the appropriate FEMA form(s) to remove and correct repetitive loss areas, as desired. • CITY will provide existing GIS layers, including claims, policies, repetitive losses based on CITY spreadsheet, and other relevant layers. • CITY will distribute notification letters to two (2) new RI -As. • CITY will review and provide feedback in a timely manner. Non -Labor Expenses. Non -labor expenses shall be reimbursed as Direct Expenses at invoice or internal office cost. Direct Expenses (non -labor) include, but are not limited to, mileage, travel and lodging expenses, mail, supplies, printing and reproduction services, other direct expenses associated with delivery of the work; plus applicable sales, use, value added, business transfer, gross receipts, or other similar taxes. iii. Subcontract Expenses. Subcontract expenses and outside services shall be reimbursed at cost to ENGINEER plus a markup of ten percent (10%). iv. Budgets. ENGINEER will make reasonable efforts to complete the work within the budget and will keep the City informed of progress toward that end so that the budget or work effort can be adjusted if found necessary. ENGINEER is not obligated to incur costs beyond the indicated budgets, as may be adjusted, nor is the City obligated to pay ENGINEER beyond these limits. If ENGINEER projects, in the course of providing the necessary services, that the PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether by change in scope of the project, increased costs or other conditions, the ENGINEER shall immediately report such fact to the City and, if so instructed by the City, shall suspend all work hereunder. When any budget has been increased, ENGINEER's excess costs expended prior to such increase will be allowable to the same extent as if such costs had been incurred after the approved increase. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. The ENGINEER shall be paid by the City based upon an invoice created on the basis of statements prepared from the books and records of account of the ENGINEER, based on the actual hours and costs expended by the ENGINEER in performing the work. B. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER. DISCUSSION Approval of this Mayor and Council Communication (MSC) authorizes execution of Amendment No. 1 to City Secretary Contract No. 61583, a Professional Services Agreement with Halff Associates, Inc. to finish the Repetitive Loss Area Analysis (RLAA) update including additional work for newly identified repetitive loss areas. In July 2024, the Stormwater Management Program initiated the five-year update of the City's RLAA in advance of the Floodplain Management Plan (FMP) Update. The RLAA is a key requirement of the FMP under the Federal Emergency Management Agency's (FEMA) Community Rating System (CRS). A Repetitive Loss (RL) is defined by FEMA as a structure insured through the National Flood Insurance Program (NFIP) with at least two paid flood loss claims of more than $1,000 each in any 10-year period since 1978. In 2024, there were a total of forty-one RL Areas identified throughout the City. The RLAA is a mitigation plan that delineates areas around each RL property to identify factors that contribute to flooding and to assess nearby properties for similar flood risks. It also identifies potential mitigation strategies for each area, including actions that can be taken by the City or by individual property owners. Updated NFIP claim data received in 2025 requires the addition of two new RL Areas to the plan. The RLAA follows a five -step process in accordance with the FEMA CRS manual. The updated plan will guide floodplain management and flood -risk -reduction efforts for the next five years and support the City's ongoing goals of protecting people, property, and the natural functions of Fort Worth's floodplains. The initial agreement was executed administratively on June 11, 2024, for an amount in the amount up to $99,650.00. The consultant proposes completing the current and additional work for a revised contract amount not to exceed $149,530.00. Staff considers the fee to be fair and reasonable for the scope of services.
