AMENDMENT NO. 2 STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 23145 (No M&C Needed) WHEREAS, the City of Fort Worth (City) and J.B. Davies, Inc., (Engineer) made and entered into City Secretary Contract No. 23145, (the Contract) which was authorized by the City Council by M&C C-16212 on the 12th day of August, 1997; and subsequently revised by one (1) previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for M-206 Drainage Area Sanitary Sewer System Evaluation Study and Improvements (Group 7, Contract 5). WHEREAS, it has become necessary to execute Amendment No. two (2) to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: l. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated February l, 2000, a copy of which is attached hereto and incorporated herein. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $342,878.77. 3. All other provision of the Contract which are not expressly amended herein shall remain in full force and effect. Davies has expended the Study Phase budget of the above referenced project. As you know, additional work beyond the originally agreed scope remains to be completed in this phase and that considerable work beyond the scope has already been completed. We respectfully request an amendment to the contract. There have been some unforeseen circumstances in the performance of the Study Phase in which we feel has led to the overage. Those circumstances are summarized below and detailed in the attached table: 1. Additional field and office work associated with researching unmapped sanitary sewer connections from the City of River Oaks and the Castleberry Independent School District. $2,916.00 2. The additional TV inspection work necessary in the M170 Basin will increase the amount of work to be conducted, with resulting delays in the completion of the supplemental feld report for that basin. The additional work consists of researching various maintenance and overflow records, checking against acrive on-going projects, and deternuning limits of existing shallow sewer lines. Maps will be prepared for use by Ace Pipe Cleaning, Inc. and City inspectors. Additional project tracking will be required, as well as reporting. $11,364.00 J.B. Davies recognizes the utility of maximizing the cleaning and TV inspection work in the Ace contract, for the investigation, consistent reporting and the improvement of the sewer system. However, there is legitimate additional cost involved in our review and mapping of the TV work to be conducted. We have prepared an attached table, which detail the contact amounts, amounts expended, amounts remaining, and the additional amount needed to complete the additional scope of services. As shown on the table, an amended amount totaling $14,280.00 is or has been required to complete the additional work. Please allow us to shift $2,911.81 of unspent funds from unused portion of the SSES Expenses to the M-170 basin portion of the funding needed to cover the additional services. This will reduce the amount of the amendment request to $11,368.19. Davies, Inc. for the additional engineering services that will or have been provided on the project as requested by the City. Davies, Inc. has requested a fee of $11,368.19 for the additional services to be provided thereby increasing the contract fee from $331,510.58 to $342,878.77. I believe this fee is fair and reasonable for the additional services that will be provided.
