WHEREAS, the State of Texas acquired and holds in its name right-of-way on State Highway 183 as described in Exhibit A attached hereto and made a part hereof, and WHEREAS, the State of Texas has determined that said right-of-way is no longer needed for the construction, maintenance and operation of State Highway 183, and WHEREAS, City Staff has siudied the public need for said right-oi way and have determined that said right-of-way is no longer needed for the use of citizens as a road or for public transportation purposes, and is not suitable for conservation, park, recreation and/or similar purposes. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, OF THE CITY OF FORT WORTH, TEXAS: 1. That the State's right-of-way shown on the attached Exhibit A is no longer needed for the use of citizens as a road and is not suitable for conservation, park, public transportation, recreation or similar purposes; 2. That the City of Fort Worth concurs in the State's plan to dispose of the right-of-way in accordance with the established laws and regulations of the State of Texas. Beginning at a State of Texas Highway Department Monument found for a southerly corner of said State of Texas tract and for the southwest corner of Lot 1, Block 1 of Meeker Retail Center, an addition to the City of Fort Worth in Tarrant County, Texas as said lot appears upon the map recorded in Cabinet B, Slide 418 of the Plat Records of Tarrant County, Texas, and being in the northeasterly line of State Highway No. 199 (Jacksboro Highway) from which the southeast corner of said Lot 1 bears south 55 degrees-41 minutes-29 seconds east, 320-46/100 feet along the long chord of a curve to the left having a radius of 1357-70/100 feet and an arc length of 321-21/100 feet. Thence northerly, along the proposed northeasterly line of State Highway No. 199 (Jacksboro Highway) the following: (1) north 43 degrees-15 minutes-35 seconds west, 86-90/100 feet to the proposed centerline station 11221+38-94/100, left 188-00/100 feet to a 5/8 inch iron rebar set; (2) north 22 degrees-38 minutes-16 seconds west, 69-41/100 feet to proposed centerline station 11220+75-00/100, left 215-00/100 feet to the beginning of a curve to the right having a radius of 158-37/100 feet to a 5/8 inch iron rebar set; (3) northeasterly along said curve to the right having a long chord of north 16 degrees- 59 minutes-23 seconds east, 167-44/100 feet and an arc length of 176-42/100 feet to the end of said curve and being in the proposed southeasterly line of State Highway No. 183 at centerline station 319+35-00/100, right 125�00/100 feet to a 5/8 inch iron rebar set. The basis for bearings is grid per the Texas State Plane Coordinate System North Central Zone (based on NAD 83 datum and control monuments provided by the Texas Department Of Transportation) Grantee's use of and access to the adjacent highway facility, of which the above described tract was a part, shall be and forever remain subject to the same regulation by legally constituted authority as applied to the public's use thereof, and being more particularly described by Paragraphs (A) and (B) herein below: (A) Access will be permitted to the existing tract of land abutting the highway facility from the beginning of the first call north 49 degrees-45 minutes-58 seconds west, 87-60/100 feet to the end of the first call and from the beginning of the fourth call north 49 degrees-00 minutes-44 seconds east, 364-74/100 feet and south 03 degrees-11 minutes-48 seconds east, 31-64/100 feet to ihe end of fhe fifth call.
