HomeMy WebLinkAbout025660 - Construction-Related - Contract - Town of Haslet� .., Adopted Resolution No,�� CON RACiENp Y � � � �� JOINT RESOLUTION AND AGREEMENT THE STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF TARRANT § WHEREAS, in 1987, the City of Fort Worth and the Town of Haslet adopted that certain Joint Resolution and Agreement providing for an adjustment of their respective corporate boundaries and extraterritorial jurisdiction ("ETJ"), which Joint Resolution and Agreement is identified as Resolution No. 1156, a copy of which is attached hereto and expressly made a part hereof; and WHEREAS, said Joint Resolution and Agreement provided in part that the Town of Haslet would disannex a portion of its city limits so that said area may be annexed and used by the City of Fort Worth for possible future construction of an additional runway at Fort Worth Alliance Airport (the "Additional Runway Tract"); and WHEREAS, Section 4 of said Joint Resolution and Agreement provides that in the event construction of the additional runway is not commenced within fifteen years after the date of the adoption of the Joint Resolution and Agreement, the City of Fort Worth will disannex said tract from its corporate limits and release all its ETJ rights to same so that the subject tract may be annexed by the Town of Haslet; and WHEREAS, the City of Fort Worth, having annexed the "Additional Runway Tract", has now determined that an additional runway will not be constructed on said Tract; and WHEREAS, the City of Fort Worth now desires to disannex said "Additional Runway Tract" and release it into the Town of Haslet's ETJ prior to the expiration of the fifteen years prescribed in the Joint Resolution and Agreement between the two cities; NOW, THEREFORE, BE IT RESOLVED AND AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE TOWN OF HASLET: Gf��9C��d ���G�G�� CU� c����US � c� _ . �e @�G'�bp.���-- 9 1. That the following boundary realignment between and the Town of Haslet, as hereinafter described, is in property owners and inhabitants of both cities. the City of Fort Worth the best interest of the 2. That pursuant to Section 4 of the attached Joint Resolution and Agreement entered into between the City of Fort Worth and the Town of Haslet, the City of Fort Worth agrees to disannex from its corporate limits and to release from its extraterritorial jurisdiction the following described property known as the "Additional Runway Tract", which property is depicted in detail on the map attached hereto, marked as Exhibit "A", and incorporated herein for all purposes: Being a tract of land situated in the G. Overton Survey, Abstract No. 1185 and the M.F.P.&P. RR. Co., Survey, Abstract Number 9135, Tarrant County ,Texas and being more particularly described by metes and bounds as follows: COMMENCING at a THD concrete monument found at the northerly end of a corner clip at the southwest corner of the intersection of Interstate Highway 35W and Keller-Haslet Road; THENCE N 89° 52'54"W, 2140.00 feet along the south right-of-way line Keller Haslet Road; THENCE N 09°52'54"W, 740.00 feet to the POINT OF BEGINNING; THENCE S 80° 07'06"W, 900.00 feet; THENCE N 09° 52'54" W, 3700.00 feet; THENCE S 80° 07'06" W, 600.00 feet; THENCE N 09° 52'54" W, 1500.00 feet; THENCE N 80° 07'06" E, 600.00 feet; THENCE N 09° 52'54"W, 1200.00 feet; THENCE N 80° 07'06" E, 900.00 feet; THENCE S 09° 52'54"E, 6400.00 feet to the POINT OF BEGINNING and containing 152.893 acres of land, more or less. �J)��D�OI�I� Gc��C��°�� 2 �QQ��/'� j�7�/j r�0�i ����G � °�7 Il La VUG�:r�11U9 �L7(!Vo 3. That the disannexation of the above described land by the City of Fort Worth shall automatically effectuate a release and relinquishment to the Town of Haslet of all extraterritorial rights which the City of Fort Worth may have in the described land. 4. That the City of Fort Worth and the Town of Haslet do hereby covenant and agree to protect, preserve and defend the herein described boundary adjustments. ,� That the City of Fort Worth and the Town of Haslet agree and resolve that the adoption by both cities of this Joint Resolution and Agreement, and the disannexation and annexation resulting therefrom, shal! not mitigate, diminish or lessen in any way the rights that either party may have, at law or in equity, to challenge or contest any other annexations, attempted annexations or extraterritorial jurisdictional claims made by the other party. � That the City of Fort Worth and the Town of Haslet understand and acknowledge that although the fifteen year period prescribed in the attached Joint Resolution and Agreement does not expire until the year 2002, the City of Fort Worth has determined that the "Additiona! Runway Tract" is no longer needed for the construction of an additional runway at Alliance Airport, and that the tract should be disannexed at this time and released from its extraterritorial jurisdiction so that the Town of Haslet may annex same. 7. That the City of Fort Worth and the Town of Haslet further acknowledge and agree that this Joint Resolution and Agreement is adopted and entered into by the respective cities solely for the purpose of disannexing the "Additional Runway Tract" from the City of Fort Worth and releasing its extraterritorial jurisdiction rights in same prior to the expiration of the fifteen year period prescribed in Section 4 of the 1987 Joint Resolution and Agreement, and for no other purpose; and that all other terms, conditions, covenants and agreements contained in the attached Joint Resolution and Agreement will remain in full force and effect. u ���� flG�� G'C�� JG�� I�`:':`� U Y C'DI�i U�:17 UWUJ Y 3 ���a ���'.���o ���o : That this Joint Resolution and Agreement shall become effective and shall become a binding agreement upon the City of Fort Worth and the Town of Haslet upon adoption of same in regular open city council meetings of the City of Fort Worth and the Town of Haslet. � That this Joint Resolution and Agreement, upon adoption by both cities, shall be executed in duplicate originals by the Mayor of each city. DRAWN TM DESIGNED CHECKED JFK �. . . ..�... _ F,�9x�TTz.�iY .�d.,�=L�(v JOIt�T RESOLUTION AND AGREEMENT THE STATE OF TEXAS § § KNOW ALL MEN 8Y THESE PRESENTS � COUNi'Y OF TARRANT � § WHEREAS, the CTty of Fort Worth ("Fort Worth") is a home rule city 1yi ng and being si tuated wi thi n the confi nes o�F the County of Tarrant, State of Texas; and� WHEREAS, Fort Worth �and Naslet each desires to adjust its respective corporate boundaries and extraterritorial jurisdiction ("ETJ") in the manner set forth herein to facilitate the development and maintenance of property within their respective jurisdictions; and WHEREAS, such,adjustments are permitted,under the 7aws of the State of Texas, including without limitation, Article 970a, Texas Revised Civil Statutes; and WNEREAS,. such adjustments are in the best interest of both Fort Worth and Haslet; NO'�l, THEREFORE, BE IT RESOLVED AND AGREED SY THE CITY COUNCIL OF THE CITY OF FORT WORTH ANQ THE�CI7Y COUNCIL OF TNE TOWN OF HASLET; Section 1. Haslet's ETJ sha11 be and is hereby expanded to encompass the entire territory described in ,Exhibit "A" (containing metes and bounds description and map) attached here�o and incorporated herein by reference for all purposes (the "Haslet ETJ Expansion Area"}. Said expansion shall become effective immediately as and to the extent permitted by law. If the Haslet ETJ cannot irr�mediately be expanded to the full extent of the Haslet ETJ Expansion Area due to statutory or other restrictions, then Ha51et may expand its EiJ to the full extent of the Haslet ETJ Expansion Area in phases from time to time as Haslet is legally permitted to do so. Fort Worth shall release its E7J in the Naslet ETJ Expansion Area from time io time if, as and to the extent that Haslet is leg�ally permitted to expand �ts ETJ into the Nasiet ETJ Expansion Area. Upon written request by Naslet, Fort Worth shall 5nmediately execute such instrunents, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Haslet to effectuate and ev�dence such release. Section Z. Subject ta the provisions of Section 4 be�ow, Fort Worth's ETJ shall be and is hereby expanded to encompass the entire terriiory described in Exhibit "B" lcontaining metes and bounds description and map) attached hereto and incorpora�ed herein by reference for all purposes (the "Fort Worth E'FJ Expansion Area"). Said expan,si on shal l become effecti ve irruriedi ately, except for the porti on thereof that is the Disannexation Tract (defined below), which tract shall becone a part of Fort Worth's ETJ as provided in Section 3 below. Haslet shall, and does hereby, release its ETJ in the Fort Worth ETJ Expansion Area, subject to the provisions of Section 3 below regarding the Disannexation 7r.act. Upon written request by Fort Worth, Haslet immediately shall execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Fort Worth to effectuate and evidence such release. A�. portion of the Fort Worth E7J Expansion Area is subject to being released to Naslet pursuant to the conditions set forth in Section 4. Section 3. A portion of the Fort W�rth ETJ Expansion Area presently is within the city limits of Haslet as described on the attached �xhibit "C" (containing metes and bounds description and map), hereinafter referred to as the "Disannexation Tract." •Haslet sha71 disannex the Disannexation� Tract. Haslet sha�l proceed with due diligence to conduct all proceedings and adopt all ordinances necessary to effect such disannexation as promptly as possible. Upon such disannexation becoming effective, the Disannexation Tract immediately shall constitute a part of Fort Wor�h's ETJ, and Haslet shall relea5e any ETJ rights or interest it may have in such tract effective as of the date of disannexation. Upon written request by Fort Worth,� Haslet immediately shall execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Fort Worth to effectuate and evidence such release. Section 4. A portion af the Fort Worth ETJ Expansion Area eventually may be used for an airport, and, if such airport is constructed, another portion of the Fort Worth ETJ Expansion Area described on the attached Exhibit "D" (containing metes and bounds descript�on and map) may be used for the future construction of an additional runway (the "Additional Runway 7ract"). In the event construction of the airport runway on the Additional Runway Tract has nat commenced (meaning commencement of the pouring of concrete for �he runway itself) within 15 years after the date of the adoption of this Joint Resoiution by Fort Worth, the Additional Runway Tract shail become a part of the Haslet E7J, and Fort Worth promptly shall release its ETJ in the Additional� Runway iract and, if necessary, disannex the Additional Runway 7ract so tha� it can become a part of the Haslet ETJ. If disannexation is required, Fort Worth shall con�uct a11 proceedings and adopt all�ordinances necessary to effect such•di�sannexation. If such release is to become effective, Fort Worth shall execute sucf� instruments,.enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Haslei to effectuate and evidence such release. Section 5. As part of its approval process, the Federal Aviation Administration (the "FAA") may require the realignment of the runway an the above referenced airport. The portion of the boundary of the Haslet ETJ Expansion Area between point "A" and point "B" as shown on Exhibit A includes the western boundary of the airport (the "Western Airport Boundary"). In the event that the FAA requires a realignment of ihe runway (the "Realigned Runway"} after the date that this resolution is passed and approved by the parties hereto, the City of Fort Worth and the Town or' Naslet agree to take all measures nece.ssary to adjust the Western Airport Boundary so that its new location bears generaliy the same .relation to the Realigned Runway as the western airport boundary shown in Exhibit "E" bears to the runway shown in Exhibit "E" (the "Rea7igned Western Airport Boundary"). Tn the event of a runway realignment, it is the intent of the parties t�at the boundary of the Haslet ETJ Expansion Area will be adjusted to inclu.de the Realigned� Western Airport Boundary so that the entire airport will be located with�in,the ETJ of the City of Fort Worth. The City of Fart Worth and the Town of Naslet agree to execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by the other party to � effectuate the above-stated intent of the parties. Section 6. Fort Worth and Haslet hereby covenant to protect, preserve and defend the ET� and municipal boundaries agreed to herein. Section 7. 7he agreements hereinabove set forth shall become binding upon Fort Worth and Haslet upon the adoption of this Joint Resolution in regular open City Council meetings of both Fort Worth and Naslet, shall be eX�cuted in several originals and- shail be set out in full in ihe minutes .of bo�h Fort Worth and Haslet. " -�:��' t � S .i�k DISCUSSION: � - On April 14, 1987, the City Council, through M&C G-7028, approved a Joint Resolution and Agreement between the City of Fort Worth (Fort Worth) and the Town of Haslet (Haslet) to adjust the corporate boundaries and extraterritorial jurisdiction (ETJ) of the two cities. The purpose of the Joint Resolution and Agreement, identified as Resolutio� (No. 1156), was to facilitate the proposed annexation and development of the Fort Worth Alliance Airport site. Because of the overlapping ETJ, and because a portion of the proposed airport site was located within the city limits of Haslet, it was necessary that Fort Worth and Haslet enter into a Joint Resolution and Agreement so that in the future, Alliance Airport would be located entirely within the corporate boundaries of Fort Worth. A portion of the Joint Resolution and Agreement specifically provided that Haslet would disannex a 152.893 acre tract of land so that Fort Worth could construct an additional runway some time in the future, if necessary. Accordingly, Haslet disannexed the 152.893 acre tract, which was then annexed by Fort Worth. The Joint Resolution and Agreement further provides that if the construction of the additional runway does not commence wittiin 15 years after the date of the adoption of the Joint Resolution and Agreement, Fort Worth would disannex the 152.893 acre tract and release all ETJ rights it may have in the tract, so that the subject property could then be annexed by Haslet. To date, the City of Fort Worth has not constructed a runway on the subject property, and with two years left in the 15 year period, there are no plans to do so. Accordingly, it is the recommendation of City staff that the City Council adopt the attached Joint Resolution and Agreement whereby Fort Worth , will agree to disannex the subject property prior to the expiration of the prescribed 15 year period, and release it,from. Fort Worth's ETJ so that Haslet may then annex it into its corporate limits. . The�� City` of `�Fort� Worth received credit for approximately $350,000 expended for infrastructure' improvements during the development of Alliance Airport adjacent to the subject property, against the purchase of the park site on North Beach and Shiver Road.
