AN ORDINANGE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS !N
THE WATER GAPITAL PROJECTS FUND IN THE AMOUNT OF $119,688.00 FOR THE
PURPOSE OF EXECUTING GRANGE ORDER NO. 1 TO CITY SECRETARY
CONTRACT NO. 37375 WITH MGCLENDON CONSTRUCTION, INC., FOR PAVEMENT
RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON
FORi3ES STREET, GRIGGS STREET, EASTOVER AVENUE AND MILLET AVENUE;
PROVIDING FOR A SEVERABILITY GLAUSE; MAKING THIS ORDINANGE
CUMULATIVE OF PRIOR ORDINANGES IN GONFLICT HEREWITH; AND PROVIDING
AN EFFEGTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fisoal Year 2008-2009, there
shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the
amount of $119,688.00 for the purpose of executing Ghange Order No. 1 to City Secretary Contract No.
37375 with McClendon Construction, Inc., for pavement reconstruction, and water and sanitary sewer main
replacement on Forbes Street, Griggs Street, Eastover Avenue and Millet Avenue.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SEGTION 3.
That this ordinance shat! be cumulative of Ordinance No. 18283 and aII other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Change Order No. 1 in the Amount of $146,638.00 to City Secretary Contract No. 37375 with
McClendon Construction Company, Inc., for Pavement Reconstruction and Water and Sanitary Sewer
Main Replacement on Portions of Forbes Street, Griggs Street, Eastover Avenue and Millet Avenue and
Adapt Appropriation Ordinance
REGOMMENDATION:

It is recommended that the City Council:
L Authorize the transfer of $119,688.00 from the Water and Sewer Operating Fund to the Water Capital
Projects Fund in the amount of $119,688.04;
2. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Water Capital
Projects Fund in the amount of $119,688.00; and
3. Authorize the City Manager to execute Change Order No. 1 in the amount of $146,638.00 to City
Secretary Contract No. 37375 with McClendon Construction Company, Inc., thereby revising the total cost
to $2,262,190.39.
DISGUSSION:
On June 3, 2008, {M&C C-22837} City Council authorized the award of a contract to McClendon
Construction Company, Inc., for the subject project. The project consists of pavement reconstruction and
water and sanitary sewer main replacement on Forbes Street (Miller Avenue to Hatcher Street}, Griggs
Street {East Berry Avenue to Forbes Street}, Eastover Avenue (Ramey Avenue to Avenue N}, Millet
Avenue {Bishop Street to Campbell Street}, and Millet Avenue (Wallace Street to Oillow Street}.
This change order includes quantity adjustments far water and sewer. The proposed water improvements
were extended beyond the original construction limits and the original plans did not include the required
construction sequencing necessary to complete the construction of the conneotion to the Eastwood
elevated storage tank. Additional work inciudes, cut-in 20 inch gate valve, 24 inch gate valves, 24 inch
waterline„ cut and ping 20 inr;h w°ateeiic7e, additionak temi,t>rary water, fitti}cgs, permanent hot mix asphalt
concrete repair and sanitary sewer manhoie.
This change order includes $144,688.00 for quantity adjustments to the water and $1,950.00 for the
sanitary sewer. The contractor is requesting $146,638.00 for the additional services and staff agrees that
the amount requested is reasonable for the work to be performed.

Funds in the amount of $37,757.00 were included for change orders on this contract {water $25,000.00
and sewer $12,757.00}. Additional funding in the amount of $119,688.00 is needed to complete the water
construction.
McClendon Construction Company, Ina, is in compliance with the City's MlWBE Ordinance by committing
to meet the MIWBE goal on this contract.
The project is located in COUNCIt_ DISTRICT 5, Mapsco 780, 78R and 78V.
FISCAL INFORMATION. l CERTIFICATION:
The Financial Management Services Director cerkifies that upon approval of the above recommendation
and adoption of the attached ordinance funds will 5e available in the current capital budgets, as
appropriated, of the Water Capital Projects Fund and the Sewer Capital Projects Fund.
