HomeMy WebLinkAbout26-6353 - City Council - ResolutionRESOLUTION 26-6353 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCED FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $2,005,510.00 WITH CITY PARTICIPATION IN THE FORM OF TRANSPORTATION DEVELOPMENT CREDITS IN THE AMOUNT OF 400,000, PLUS ANY COST OVERRUNS, FOR THE CS: LTJG BARNETT BRIDGE2 AT NASJRB PROJECT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes; and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision; and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds; and WHEREAS, the City desires to enter into an Advance Funding Agreement with the Texas Department of Transportation for the CS: LTJG Barnett Bridge2 at NASJRB Project, in the amount of $2,005,510.00 with Federal Participation in the amount of $2,000,000.00, State Costs in the amount of $5,510.00, and City Participation in the form of Transportation Development Credits (TDCs) in the amount of 400,000. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: The City Council authorizes the City Manager or Assistant City Manager to execute an Advance Funding Agreement with the Texas Department of Transportation for the CS: LTJG Barnett Bridge2 at NASJRB Project (CSJ: 0902-90-335) in the amount of $2,005,510.00 with City Participation in the form of Transportation Development Credits (TDCs) in the amount of 400,000, plus any cost overruns. Rescind Resolution No. 6204-12-2025; and 2. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-335) for the LTJG Barnett Bridge project (City Project No. 106110) in the amount up to $2,005,510.00 with local participation by Transportation Development Credits in the amount of 400,000, plus any cost overruns. DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to rescind Resolution 6204- 12-2025 (M&C 25-1096, December 9, 2025) due to the omission of required language, and adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $2,005,510.00 with local participation in the form of Transportation Development Credits in the amount of 400,000, plus any cost overruns, for the LTJG Barnett Bridge project (City Project No. 106110). The Federal participation portion will be in the amount of $2,000,000.00, and State participation in the amount of $5,510.00. The TDCs will be appropriated and tracked as a non -spendable item in the Grants Capital Project Other Fund. The scope of work for the project remains as described in M&C 25-1096. All other actions in M&C 25-1096 remain valid. This project is located in COUNCIL DISTRICT 7.A Form 1295 is not required because this contract will be with a government entity (TxDOT). FISCAL INFORMATION/CERTIFICATION 1 of 2 FORT WORTH. The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
