The pre -final design for this segment of the trail, Section 4, was completed in 2023 by Halff under City Contract #51936. The project was then put on hold by the City of Fort Worth (CoFW). The design included a culvert crossing at Walker Branch to accommodate the proposed trail and a future park road, as directed by CoFW. Halff was requested by CoFW to provide a proposal for restarting the project, finalizing the design, and providing bidding/construction phase services. The finalized design will be included in a new set of construction drawings with a shortened trail alignment spanning from approximate STA 102+00 to STA 109+50, as shown on the 2023 pre -final drawings and illustrated on an Exhibit in Appendix A. Assumptions: 1) The 2023 trail design will be utilized, refined, and issued for bid and construction. 2) The final trail segment included in the design package will be approximately 750 linear feet long. 3) The 90% design package will be prepared and submitted after the kickoff meeting. 4) The proposed culvert crossing will be below the 100-year base flood elevation. 5) A permanent trail easement through the Ken Newell property has been acquired by the CoFW. Temporary construction easements will not be required. 6) The CoFW is responsible for acquiring Right of Entry (ROE) necessary for this project. 7) Construction access shall be coordinated with property owners by CoFW. 8) The project as currently designed received U.S. Army Corps of Engineers (USACE) verification under the Clean Water Act Section 404 Nationwide Permit 14 — Linear Transportation Projects. Under the current verification all work within Waters of the United States (WOUS) must be completed by March 14, 2027. It is assumed that the work will not be complete by this date and the project will have to be reverified under NWP 14 for losses to waters of the United States. This requires the resubmittal of a preconstruction notification to the USACE and a potential 60 calendar day review period. 8144 Walnut Hill Lane, Suite 550, Dallas, TX 75231 1 halff.com 7 of 22 .ee haLff SCOPE OF SERVICES BASIC SERVICES — Lump Sum Task 1: Proiect Management Halff will communicate with internal staff, subconsultants, and the CoFW to coordinate the design, permitting, and other services included in the Scope of Services for this project. The report will address the applicable regulatory framework, describe the assessment methodology, limitations and findings, provide site -specific conclusions and jurisdictional analysis of identified features. The report will include applicable maps/exhibits, site photographs, and data sheets/forms. 2) Threatened and Endangered Species Assessment: Because a Section 404 permit is a federal action, documentation must be provided to make an effect determination under the Endangered Species Act to remain in compliance with the conditions of the Section 404 permit program. The Threatened and Endangered Species Assessment will include the following: a) Obtaining an official species list for the project area and other related construction areas utilizing the United States Fish and Wildlife Service (USFWS) Information for Planning and Consultation (IPAC) service; b) Conducting background research including review of aerial photography, topographic maps, vegetation cover data, and soil survey maps to identify potential suitable habitat for species listed in the IPaC report; c) An opinion regarding the potential of the proposed projects to affect federally listed threatened and endangered species. 3) Cultural Resources Assessment: This project requires authorization by the United States Army Corps of Engineers (USACE) pursuant to Section 404 of the Clean Water Act, which is considered a federal 8144 Walnut Hill Lane, Suite 550, Dallas, TX 75231 1 halff.com 10 of 22 ON haLff action requiring compliance with Section 106 of the National Historic Preservation Act (Section 106). Section 106 requires that the project consider potential effects to archeological and above ground historic resources eligible for listing on the National Register of Historic Places (NRHP) through consultation with the Texas Historical Commission (THC) and any other applicable federal regulatory agencies. In compliance with Section 106, Halff will review the Texas Archeological Sites Atlas to determine whether any archeological sites and above ground historic resources (cultural resources) eligible for listing on the NRHP, or cemeteries are documented within or adjacent to the project's Area of Potential Effects (APE). Prior cultural resources documentation was submitted under the previous permitted activity; this task is solely for coordination with the USACE Regulatory Staff Archaeologist to determine if the prior cultural resources assessment and THC concurrence will suffice for any updated activities within the project area. Additional cultural resources survey activities (if required) or if additional coordination is necessary this will be provided under a separate scope of work. 4) Nationwide Permit PCN: It is anticipated that the project may be permitted under NWP 14. This scope and fee include preparing and submitting a PCN for written verification that the project may proceed under NWP 14. This task further includes the necessary coordination with USACE Regulatory Division for the processing of the permit along with any additional information requested. The contents of the NWP 14 PCN will include, but is not limited to: a) Name, address and telephone numbers of the prospective permittee; b) Location of the proposed project; c) A description of the proposed project; the project's purpose; direct and indirect adverse environmental effects the project would cause, including the anticipated amount of loss of water of the United States expected to result from the NWP activity, in acres, linear feet, or other appropriate unit of measure; d) Aquatic Resources Delineation; e) Compensatory mitigation plan documenting the purchase of mitigation credits; f) Threatened and endangered species assessment; and g) Cultural resources assessment 5) Tree Survey by ISA Certified Arborist: Halff shall conduct a field inspection that will identify the location, size, and species of trees in accordance with the City's Development Code Chapter 6 Article 3 Section 6.302.
