Dear Ms. Sreekumaran Unnithan:
Whereas Dunaway Associates was prepared to bid the above project in the summer of 2025,
and whereas upon City Review, adjustments were requested that were outside of the original
scope - notably the change of a 12" water main in White Settlement to a 16" water main and
the adjustment of M-206 from a 24" sanitary sewer to a 30" sanitary sewer, and whereas upon
further field investigation was provided showing that M-206 is collapsing at the manhole north
of the Tarrant Regional Water District Levee, and as a result several teleconferences were held,
one site visit, and schematics showing alternates and costs were prepared to help determine
a solution, and therefore the solution, as described by Dean Kuhn, representative for the
Tarrant Regional Water District that work would need to proceed as if a Section 408 permit
would be required, the following services are provided, a full detailed description of each
project modification is described below:
Upsizing the 12" water main in White Settlement to a 16" main.
2. Additional topographic survey and boundary survey to help establish the new
horizontal alignment of the re -aligned sanitary M-206 sewer main.
3. Additional topographic survey for the extension of the 16" water main between
Merrit Street and Priddy Streets.
4. Coordination with TRWD, USACE, including the production of exhibits, an
alternative and a site visit to help establish an alignment that would be
acceptable to all permitting parties,
5. Upsizing and realigning the 24" sanitary sewer main to a 30" main. Realignment
will be both horizontally and vertically and will be replaced by construction
methods other than slip lining. Abandonment plans for the remaining pipe,
6. Geotechnical boring as required by TRWD and the USACE for permitting open
cutting within the levee area.
7. Four temporary construction easements to support open cut operations,
8. USACE Section 408 Permitting as described in detail:

DUNAWAY
CPN 103411, Contract 2020 WSM-G Scope Adjustments - Amendment No. 1
June 24, 2026
Page 2
A. Section 408 Permitting Assistance - Dunaway will provide United States Army Corps
of Engineers (USACE) Section 408 Permitting assistance for the proposed project. As
part of this scope of work, a comprehensive analysis report will be created to
analyze the proposed alteration of the Sump #6 Levee, part of Fort Worth Floodway
Civil Works Project. Dunaway will create the submittal based on the Engineer
Circular 1165-2-220. Dunaway will coordinate the submittal of the Section 408
request Tarrant Regional Water District (TRWD) the USACE Section 408 Division.
USACE will have a 30-day period from date of submittal to conduct their
"completeness" review. Typical 408 requests go through two or three completeness
reviews. Dunaway will address any comments raised during the review process and
attend pertinent field/virtual meetings with USACE and/or subconsultants on the
Client's behalf to obtain an approved permit.
B. Waters of the U.S. Delineation - Environmental Scientists from Dunaway will conduct
a field assessment of the proposed site to assess potential aquatic resources. Field
staff will use a Global Positioning System (GPS) to map aquatic resources, including
wetlands; data collected in the field will be downloaded and prepared for
inclusion in the Waters of the U.S. Delineation Report. The Waters of the U.S.
Delineation Report will utilize existing datasets (USGS Topographic, USDA Soils,
USFWS NWI, etc.) along with data collected during the field assessment. The limits
and descriptions of delineated aquatic features found during the field assessment
will be described and shown within the report and site exhibits. A professional
opinion will be provided for each feature to determine whether the feature meets
the current regulatory definition of Waters of the U.S. The assessment will include
potential permitting scenarios for the project of the project and impact thresholds
associated with the use of such permits.
This scope and fee does not include any Section 404 permitting assistance with
USACE. If Waters of the U.S. are discovered within the site boundary and are
impacted by the proposed project, a Section 404 permit may be
necessary. Additionally, a Section 404 permit would require a Section 106 Cultural
Resources review and a species -specific impact assessment for Threatened or
Endangered (T&E) species -specific impact assessments or Section 7 consultation
with USFWS. If the habitat meets the criteria to support any of the listed T&E species
in Tarrant County, a species -specific field survey may be required. This scope and
fee does not include any archaeological review or surveys or T&E Species impact
assessment/field surveys.
C. USACE Regulatory/Section 404 Approval - If it is determined after completing the
Waters of the U.S. Delineation Task that the proposed sanitary sewer project would
have no potential to impact potentially jurisdictional Waters of the U.S., Dunaway
will prepare a No Permit Required submittal for USACE Regulatory review and

approval. If it is determined after completing the Waters of the U.S. Delineation Task
that the project would impact potentially jurisdictional Waters of the U.S., Dunaway
will provide USACE Nationwide Permitting assistance for the proposed sanitary
sewer project. Based on discussion with Dunaway's engineering team, impacts to
potentially jurisdictional aquatic features could occur under Nationwide Permit
(NWP) 58. Dunaway will prepare necessary items for a Pre -Construction Notification
for formal review of the proposed impacts to the aquatic features. As part of this
scope of work, an approved jurisdictional determination (AJD) request will be
submitted to determine the official jurisdictional status of stream features currently
proposed to be impacted with the existing site plan. Dunaway will address any
comments raised during the review process of the submitted report and attend
pertinent field/virtual meetings with USACE and/or subconsultants on the Client's
behalf to obtain an approved permit.
D. Project Specific Species Impact Assessment - As part of National Environmental
Policy Act (NEPA) due diligence and/or NWP assistance, a project specific species
impact assessment may be requested by USACE for the project. An assessment of
federally threatened, endangered, proposed, and candidate species, as well as
proposed and final designated critical habitat, will be conducted. The assessment
will determine whether the undertaking of the proposed project has the potential
to affect any of the listed species or their potential habitats. The assessment will also
determine if the project has potential for a species "Take", as defined by the United
States Fish and Wildlife Service.
This scope and fee does not include any species -specific field surveys or Section 7
consultation with the local United States Fish and Wildlife Service Office. If it is
determined during the Nationwide Permitting process that these may be
warranted, this would be considered additional services.
E. Cultural Resources Desktop Review - Coordination with USACE and the Texas
Historical Commission (THC) will be initiated through the submittal of a desktop
analysis, which will provide analysis and information pertaining to:
• Project location and design;
• Soils;
• Topography and geology;
• Known archeological sites, National Register properties and districts, historic -
aged buildings and structures, cemeteries, and historical markers within the
project area;
• Previously conducted archeological surveys within 1 mile of the project area;
• Cultural resources probability assessment; and
• Recommendations

Page 4
As a result of the coordination established through this task, the USACE and THC will
determine if an archeological survey is required for the project.
F. Archeological Survey and Agency Coordination - Required Antiquities Code of
Texas and National Historic Preservation Act (NHPA) Section 106 compliance will be
completed (if triggered). The following services will be performed, if requested by
the Texas Historical Commission:
• Obtain a Texas Antiquities permit from the THC to conduct the survey;
• Complete a full, intensive pedestrian survey to document archeological
resources 50 years or older that could be impacted by the project;
• Draft a technical report that documents the archeological background
review, survey methods, survey results, any necessary National Register of
Historic Places (NRHP) eligibility assessment, and recommendations; and
• Conduct all necessary coordination with THC to obtain agency comment.
If a survey is required, it is assumed that USACE and THC will require an assessment
of deeply buried deposits that could be impacted by proposed project. Backhoe
trenching for the project would occur where deeply buried archeological deposits
(greater than 3 ft [feet] below surface) could be impacted by the project.
Archeological survey standards require that a minimum of one trench be
excavated every 200 meters where potential for deeply buried archeological
deposits exist. As such it is anticipated that approximately one trench will be
required for the project. Backhoe trenches will be excavated to the maximum
vertical depth of the project, or to the extent of Holocene -age soils capable of
containing archeological deposits. Backhoe trench excavation will be monitored
for the presence of archeological materials. When each trench has been
excavated to a depth of approximately 4 feet, an Occupational Safety and Health
Administration (OSHA) competent field supervisor will assess the stability of the
trench prior to recording soil profile data. If soil stability is low, the trench may be
widened through benching and/or limited to a safe depth for detailed recording
of the soil profile. The physical properties of each natural stratigraphic level will be
recorded. Investigators will document the results of each backhoe trench on
standardized forms. A 5-gallon bucket of soil will be screened through 0.25-inch
hardware mesh from every third excavator bucket load during excavation. The
remaining excavated soil will be visually inspected as it is placed on the spoil pile.
Each backhoe trench will be backfilled following documentation of the completed
trench.
G. Above Ground Resources Survey - If an above ground resources survey is required
by the USACE or THC through coordination conducted through the Cultural
Resources Desktop Review, the following services will be conducted:
• A reconnaissance architectural survey of above ground resources that are
50 years in age or older within and adjacent to the project footprint;

DUNAWAY
CPN 103411, Contract 2020 WSM-G Scope Adjustments - Amendment No. 1
June 24, 2026

• Sufficient research to evaluate each resource's current condition in
comparison with its historical construction, as well as its historical
significance with its context;
• Evaluations of each identified architectural resource for listing on the NRHP;
and,
A technical report that documents the background research, survey
methods, survey results, NRHP eligibility assessment, and recommendations.
H. Deed and Title Archival Research - Although not anticipated, if a historic period
(greater than 50 years in age) residential site is encountered during the survey,
deed title and/or archival research may be required to determine if the site was
associated with any historically significant individuals or historical events that would
qualify the site for NRHP eligibility under Criteria A and B. Due to the uncertainty of
this task being required for the project and the unknown status of deed records of
the subject property, this task is presented as an if required task and would be
invoiced on a time and materials basis upon authorization from the Client. If
required, IES will prepare a deed chain -of -title table that details the grantor,
grantee, date, and deed record volume and page for each property transfer from
current to land patent or to the date of origin associated with the encountered
resource.

It is the practice of the Water Department to appropriate its Capital Improvement Program
plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as
projects commence, additional funding needs are identified, and to comply with bond
covenants.
Funding is budgeted in the Transfer to Water/Sewer account of the Water and Sewer
operating budget for the purpose of funding the Water and Sanitary Sewer Rehabilitation
