FIRST AMENDMENT TO TERMINATION OF
CITY SECRETARY CONTRACT NUMBER 62107
A COMMUNITY FACILITIES AGREEMENT BETWEEN
THE CITY OF FORT WORTH AND ALEMEDA ANUSA, LLC
This FIRST AMENDMENT TO TERMINATION OF CITY SECRETARY
CONTRACT NUMBER 62107 ("First Amendment") is made and entered into by and between
the City of Fort Worth ("City"), a home -rule municipal corporation of the state of Texas, and
Alemeda ANUSA, LLC ("Developer"), a Delaware limited liability company.
WHEREAS, the City and Developer entered into a Community Facilities Agreement
for the construction of public infrastructure improvements for a Project known as AutoNation
USA Camp Bowie, City Project Number 105565, City Secretary Contract Number 62107
("CFA"); and
WHEREAS, City and Developer executed a termination of the CFA, City Secretary
Contract No. 62107 -Ti ("Termination"); and
WHEREAS, City and Developer have discovered that the Termination inadvertently
excluded the water lab testing fees that were paid by the Developer and are to be refunded by
the City to Developer;
NOW THEREFORE, City and Developer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the Termination:

Section 2 of the Termination is amended in its entirety to be and read as follows:
Upon execution of this Termination, the City will refund to Developer the
estimated administrative material testing fees, water lab testing fees and construction
inspection service fees paid to the City in the amount of $12,285.00 and release the
financial guarantee Developer provided to the City for the CFA.
2.
All other provisions of the Termination which are not expressly amended herein, shall
remain in full force and effect.
All terms in this First Amendment that are capitalized,
meanings ascribed to those terms in in the Termination.

IN TESTIMONY WHEREOF, the City and Developer have executed this First
Amendment to be effective on the date signed by the City's Assistant City Manager.
