NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. The budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-09-2025, as amended, is hereby further amended by increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $13,698,960.00, transferred from available PayGo funds in the Water and Sewer Fund. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. This ordinance shall be cumulative of Ordinance No. 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with Jackson Construction, Ltd., in the amount of $12,592,547.50 for Water and Sanitary Sewer Replacement 2020, WSM-J project (City Project No. 103420); 2. Authorize Execution of Amendment No. 3 to City Secretary Contract No. 57029, an Engineering Agreement with Neel -Schaffer, Inc., in the amount of $100,000.00, for Water and Sanitary Sewer Replacement Contract 2020, WSM-J project (City Project No. 103420) for a revised contract amount of $717,272.00; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $13,698,960.00, transferred from available PayGo funds in the Water and Sewer Fund, for the purpose of funding the Water and Sanitary Sewer Replacement Contract 2020, WSM-J project (City Project No. 103420) and to effect a portion of Water's contribution to the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION The purpose of this Mayor & Council Communication (M&C) is to authorize execution of a construction contract with Jackson Construction, Ltd., and authorize Amendment No. 3 to an Engineering Agreement with Neel Schaffer, Inc. for the Water and Sanitary Sewer Replacement Contract 2020, WSM-J project. 1 of 5 FORT WORTH. On January 11, 2022, M&C 22-0049 authorized an engineering agreement with Neel -Schaffer, Inc., (city Secretary Contract No. 57029) in the amount of $543,512.00 for the preparation of plans and specifications for the Water and Sanitary Sewer Replacement Contract 2020, WSM-J project. The agreement was subsequently revised by Amendment No. 1 in the amount of $53,760.00 administratively authorized on September 22, 2023, for design of additional water and sanitary sewer mains on the project and Amendment No. 2 in the amount of $20,000.00 administratively authorized on December 8, 2025, for the preparation of plans and specifications for pavement replacement revisions. Amendment No. 3 in the amount of $100,000.00 will provide for additional construction phase services including site inspections, Request for Information (RFI) review, submittal review, and shop drawing review. Additionally, this Mayor and Council Communication (M&C) will authorize execution of a construction contract with Jackson Construction, Inc., in the amount of $12,592,547.50 for the replacement of deteriorated sanitary sewer and cast iron mains as indicated on the following streets. The project was advertised for bids on February 4, and February 11, 2026, in the Fort Worth Star -Telegram. Jackson Construction, Inc, is committed to 30 percent SBE participation. The City's SBE goal is 30 percent. In addition to the contract amount, $599,664.50 (Water: $426,416.00, Sewer: $173,248.50) is required for project management, material testing, and inspection. Project contingencies are provided in the amount of $406,748.00 (Water: $290,863.00; Sewer: $115,885.00). The sanitary sewer component of this project is part of the Sanitary Sewer Overflow Initiative Program of the Water Department. Approximately 17,400 linear feet of cast iron water pipe and 5,250 linear feet of deteriorated sanitary sewer pipe will be removed and replaced as part of this project. 3 of 5 FORT WORTH,U It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the Fiscal Year (FY) instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funding is budgeted in the Transfer to Water/Sewer account of the Water and Sewer operating budget for the purpose of funding the W/SS Replace Contract 2020 WSM-J project within the Water & Sewer Capital Projects Fund.
