NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. In addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Project Other Fund in the amount up to 104,200.00, subject to the receipt of the grant, in the form of Transportation Development Credits for the purpose of funding the 55FTW Gate 1 Turn Lane Design project (City Project No. 104125). SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. This ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund in the amount up to $45,000.00, subject to receipt of the grant, all of which is Federal funding for the purpose of funding the 55FTW Gate 1 Turn Lane Design project (City Project No. 104125); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project Other Fund in the amount up to 104,200, subject to the receipt of the grant, in the form of Transportation Development Credits for the purpose of funding the 55FTW Gate 1 Turn Lane Design project (City Project No. 104125); and 4. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION 1 of 4 FORT WORTH. This Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of Amendment No. 1 to the Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) for the BUS 287 & Meacham Boulevard Entrance project (internally known as 55FTW Gate 1 Turn Lane Design) (City Project No. 104125) to increase the total AFA amount from $784,216.00 to $790,619.00 with City participation in the amount of $230,000.00 and Transportation Development Credits (TDC) in the amount of 104,200 for the City's 20% match, plus cost overruns. On November 28, 2023, the City Council adopted Resolution No. 5845-11-2023 to authorize execution of the AFA with TxDOT (City Secretary Contract No. 61509, M&C 23-1012). Amendment No. 1 is needed to modify the total AFA amount to reflect the revised project total, including TDC. The scope of this project includes design, engineering, environmental services, and construction of a new right -turn lane off North Main Street at Meacham Airport's northernmost entrance. This project is currently in the advertisement phase. The City of Fort Worth (City) will be responsible for securing the federal funding reimbursements for the construction of this project. City funds have been appropriated to this project for design, right-of-way, utilities, and project management. This AFA Amendment No. 1 modifies the agreement to include funding as shown in the table below. Specifically, the State is responsible for all Direct and Indirect State costs. The City will be responsible for cost overruns. The action in the M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. The project is located in COUNCIL DISTRICT 2. This contract will be with a governmental entity, state agency or public institution of higher education. FISCAL INFORMATION/CERTIFICATION The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund and the Grants Capital Project Other Fund. The Transportation and Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Transportation and Public Works Department 3 of 4 FORT WORTHfU has the responsibility to validate the availability of funds.
