SUBJECT: NOTICE OF TERMINATION OF CITY CONTRACT NO.
63589: LAKE WORTH TRAILS PHASE 1C (City Project No. C01920)
Dear Mr. McGregor:
I am writing to formally confirm that the City of Fort Worth has terminated the
contract for the above -referenced project. As you know, the proposed redesign of
the retaining wall along the trail would result in costs that exceed the maximum
increase of 25% over the original contract amount allowed by state law. We
appreciate your work to this point and apologize for the inconvenience.
We appreciate the patience and the co-operative efforts of Cole Construction, Inc.,
throughout this project. We have reviewed your submittal for the work performed
and agree to reimburse $188,113.43 as indicated on the enclosed worksheet.
The City is re-scoping the project and will be issuing a call for bids in the near
future. Cole Construction Inc. is welcome to provide a bid.

ARTICLE 11 — COST OF THE WORK: ALLOWANCES; UNIT PRICE WORK; PLANS
QUANTITY MEASUREMENTS
11.01 Cost of Work
A. Cost Included: The term ........ Such costs shall not include any of the costs
itemized in Paragraph 11.1.B, and shall include but not be limited to the
following items:

ARTICLE 15- SUSPENSION OF WORK AND TERMINATION
15.01 City May Suspend Work
A. At any time and without cause, City may suspend the work or portion thereof
by written notice to Contractor and which may fix the date on which Work will
be resumed. Contractor shall resume the Work on the date so fixed. During
temporary suspension of the Work covered by the Contract Documents, for
any reason, the City will make no extra payment for stand-by time of
construction equipment and or construction crew.
